How can you make a difference?

The newly enacted Juvenile Justice Act (Law No: 18/2019), based on restorative justice principles, envisions to regulate all matters relating to children in conflict with the law through a system dedicated to deterring children from offending, incorporating child-friendly approaches and providing rehabilitation to enable social reintegration. As the first ever law for administration of justice for children in conflict with the law it sets standards and requirements for the whole juvenile justice system. One of the major requirements at court level is that the Act stipulates that judges of courts which adjudicate cases of children shall be comprised of judges of both genders, who are specifically trained with respect to rights of children, juvenile justice system and to adjudicate cases of children. This calls for thorough understanding of the juvenile justice system, and the biological and the socio-economic factors that may have influenced children coming into contact with law.

The Judicial Academy has now identified specific training areas that would be required for judges, namely – (1) Emotional and social development of the child, and changes that come with age and maturity of the child; (2) The rights and needs of children with disabilities/special needs; (3) The rights and needs of children in special circumstances; (4) How to best reflect on the needs and circumstances of girls to ensure their protection; (5) The implications on the emotional, social and cognitive development of children who have been subjected to different forms of violence and neglect; (6) The national laws and regulations in place for child rights/protection and juvenile justice, relevant international conventions, and rules of procedures/operating procedures currently being practiced; (7) Various considerations that has to be made in determining the best interests of the child; (8) How to determine the information provided by a child’s Social Inquiry Report, for the purposes of the Court; (9) Communication skills in dealing with children; (10) How to utilize psychological assessments and testing’s for the purposes of the Court; (11) Mediation skills; (12) Legal standards for balancing the interests of the victim, perpetrator and the public; (13) Any other information and trainings required to strengthen the juvenile justice system; and (14) Special considerations to be made in taking the statement of a child. Trainings identified for probation officers and other technical officers include 1; Communication skills in dealing with children, life skills training and parenting skills for probation officers, 2. Statistical data maintenance and analysis training. In the framework of its cooperation with the Gvernment of Maldives, UNICEF is recruiting a national consultant to support the Judicial Academy in developing and delivering these specialized trainings for judges and probation/technical officers which are necessary for the rollout and implementation of the Juvenile Justice Act. The national consultant will work in close collaboration with an international consultant.

The Purpose of the assignment:

The main purpose of hiring a local consultant is to collaborate with the international consultant in developing and delivering trainings for probation/technical officers and for Judges who adjudicate cases of children in superior Courts, appellate courts in order to complete the rollout and implementation of the Juvenile Justice Act.

Duty station: The consultant will be based at the Judicial Academy in Male’ Maldives and shall work closely with the guidance and collaboration of the international consultant (guided virtually).

Supervisor: The consultant will be supervised by the Programme Specialist for Child Protection, Child Rights and Gender, UNICEF MCO, in collaboration with the Judicial Academy and the Juvenile Court supported by the International consultant.

Key Tasks for the Assignment:

The consultant will carry out major tasks proposed for the consultancy in close consultation and under the guidance of the Judicial Academy as outlined below;

  1. Arranging consultation meetings, as per the requirements identified by the international consultant, with key stakeholders (Drug Court, Juvenile Court, High Court, Supreme Court, Department of judicial administration, Judicial Service Commission and Maldives Judicial Academy)
  2. Translating relevant and necessary acts and regulations to inform the training needs and areas.
  3. Assist the international consultant in preparing training modules, reports and assessments by organizing and facilitating consultations and trainings with the support of Judicial Academy.
  4. Translating the Training modules (in Dhivehi): i) training module and, ii) a TOT/facilitation guide/component).
  5. Assisting the international consultant with the delivery of the training to selected Judges and Judicial officers on the developed training modules.
  6. Assisting the international consultant in facilitating at least one TOT training workshop and preparing a post-training evaluation and impact assessment.

  2. Training Module for judges/judicial personal

  1. Assisting the international consultant for the Training of a batch of judges/ and other relevant staff (first batch).

Report on first training.

5 days.

  1. Assisting the international consultant in conducting Training of trainers (these trainers can be selected from the first batch).

Report on ToT training

3 days.

  1. Assisting the international consultant to conduct Co-facilitation of training (this can be the second batch) and to certify the trainers based on their performance. (can be evaluated during the sessions).

Report on second training.

5 days.

  1. A final report on the whole consultancy.

Final report. (Translated to Dhivehi)

5 days.

Estimated duration of contract: 50 working days from the start date of the consultancy contract.

To qualify as an advocate for every child you will have…

  • A post graduate degree or equivalent qualification /degree in law, criminal law, criminal justice, or any other relevant discipline.
  • A minimum of 3 years’ experience in criminal litigation or in adjudication.
  • Previous experience in criminal litigation and adjudication are desirable.

  • Prior experience in delivery of training

  • Ability to keep to tight timelines.
  • Strong drive for results.
  • Highly developed communication, networking, and interpersonal skills.
  • Working with teams of diverse capacities.
  • Proficiency in written and spoken English and Dhivehi.
