How can you make a difference?

The newly enacted Juvenile Justice Act (Law No: 18/2019), based on restorative justice principles, envisions to regulate all matters relating to children in conflict with the law through a system dedicated to deterring children from offending, incoporating child-friendly approaches and providing rehabilitation to enable social reintegration. As the first ever law for administration of justice for children in conflict with the law it sets standards and requirements for the whole juvenile justice system. One of the major requirements at court level is that the Act stipulates that judges of courts which adjudicate cases of children shall be comprised of judges of both genders, who are specifically trained with respect to rights of children, juvenile justice system and to adjudicate cases of children. This calls for thorough understanding of the juvenile justice system, and the biological and the socio-economic factors that may have influenced children coming into contact with law.

The Judicial Academy has now identified specific training areas that would be required for judges, namely – (1) Emotional and social development of the child, and changes that come with age and maturity of the child; (2) The rights and needs of children with disabilities/special needs; (3) The rights and needs of children in special circumstances; (4) How to best to reflect on the needs and circumstances of girls to ensure their protection; (5) The implications on the emotional, social and cognitive development of children who have been subjected to different forms of violence and neglect; (6) The national laws and regulations in place for child rights/protection and juvenile justice, relevant international conventions, and rules of procedures/operating procedures currently being practiced; (7) Various considerations that have to be made in determining the best interests of the child; (8) How to determine the information provided by a child’s Social Inquiry Report, for the purposes of the Court; (9) Communcation skills in dealing with children; (10) How to utilize psychological assessments and testings for the purposes of the Court; (11) Mediation skills; (12) Legal standards for balancing the interests of the victim, perpetrator and the public; (13) Any other information and trainings required to strengthen the juvenile justice system; and (14) Special considerations to be made in taking the statement of a child. Trainings identified for probation officers and other technical officers include 1; Communcation skills in dealing with children, life skills training and parenting skills for probation officers, 2. Statistical data maintenance and analysis training. In the framework of its cooperation with the Government of the Maldives, UNICEF is recruiting an international consultant to support the Judicial Academy in developing and delivering these specialized trainings for judges and probational/technical officers which are necessary for the rollout and implementation of the Juvenile Justice Act.

The Purpose of the assignment:

The purpose of this consultancy is to provide technical assistance to the Judicial Academy in developing and delivering trainings for Judges who adjudicate cases of children in superior Courts and appellate courts and probational/technical officers necessary for the rollout and implementation of the Juvenile Justice Act.

Duty station: The consultant will be home based and provide the support virtually and work closely in collaboration with the local consultant based at the Judicial Academy.

Supervisor: The consultant will be supervised by the Child Protection Programme Specialist in close collaboration with the Judicial Academy and the Juvenile Court.

Key Tasks for the Assignment:

The tasks included in the consultancy must be carried out in close consultation and under the guidance of the Judicial Academy. The major tasks for the proposed consultancy include:

  1. Rapid assessment of training needs and review of existing trainings
  2. Training modules:i) training module as identified during the rapid training needs assessment and, ii) a ToT/facilitation guide/component) – covering the content areas identified.
  3. Training of a batch of judges/magistrates (first batch).
  4. Training of trainers (trainers may be selected from the first batch. To be decided during the consultancy in consultation with Judicial Academy and Juvenile Court ).
  5. Training for probabtional/technical officers Co-facilitation of training (this can be the second batch) and to certify the trainers based on their performance (can be evaluated during the sessions).
  6. Drafting of a final report on the whole consultancy and on a way forward including the long term training required for effective and efficient implementation of the Juvenile Justice Act and the Child Rights Protection Act.

  2. Co-facilitation of training (this can be the second batch) and to certify the trainers based on their performance (can be evaluated during the sessions).

  1. A final report on the whole consultancy.

To qualify as an advocate for every child you will have…

The applicant should have the following academic qualification, working experience, skills and competencies:

  • Advanced university degree in law, criminology, sociology, psychology or a relevant field.
  • A minimum of 8 years working experience in the juvenile justice sector.
  • Prior knowledge in drafting, developing and delivering training programmes for judges/judiciary
  • Ability to keep to tight timelines.
  • Strong drive for results.
  • Highly developed communication, networking, and interpersonal skills.
  • Working with teams of diverse capacities.
  • Proficiency in written and spoken English.
