The United Nations Office for Project Services (UNOPS) helps the United Nations (UN) and its partners provide peace and security, humanitarian, and development solutions. UNOPS services cover infrastructure, project management, procurement, financial management and human resources.

In response to the request of the Government of Ukraine, UNOPS opened an office in Ukraine in 2017, which provides a broad spectrum of services to the Government and the people of Ukraine. Currently, the office is classified as an Operations Centre, with a portfolio of projects exceeding USD 100 million, in the areas of rule of law, environment, energy efficiency, crisis recovery, good governance, human resources management, procurement, and logistics.

The Support for Rule of Law Reforms in Ukraine (PRAVO Police) is a project funded by the European Union that has the overall objective of supporting the strengthening of the policing, prosecution and civilian governance in Ukraine and to align them with the best European and International practices. On matters of substance, the project relies on the EU Advisory Mission (EUAM) to Ukraine.

The Project is partnered with the following national agencies: the Ministry of Internal Affairs of Ukraine, the National Police of Ukraine (NPU), the Office of the Prosecutor General (OPG), the State Bureau of Investigations (SBI). Activities include providing technical support tailored to the needs of each individual agency, while some interventions address larger scale and cross-cutting issues, including inter-agency cooperation and data exchange.

One such activity relates to the development and roll-out of a new integrated Electronic Criminal Case Management System (eCMS) – an electronic system to be used for the storage and exchange of data on criminal offences at the pre-trial investigation stage and on judicial proceedings. Its users are the OPG, the NPU, the Security Service of Ukraine (SSU), the National Anti-Corruption Bureau of Ukraine (NABU), the SBI, the State Fiscal Service of Ukraine, courts and others. An integrated system for the entire chain of Law Enforcement Agencies (LEAs) with investigative powers, will allow the streamlining of case management within and between stakeholder agencies in the processing and exchange of key case information and documents leading to prosecutions or other procedural conclusions or resolution of cases. This will contribute to more efficient electronic interaction among investigators, prosecutors and judges at the pre-trial investigation stage, speed up the decision-making process, decrease routine administrative processes and reduce costs.

Development of the system should be carried out in close coordination with each relevant agency and take into consideration each agency’s vision of the eCMS, their internal ICT landscape and specific needs (analytics, user interface, performance, etc.) and cybersecurity aspects. The new system will be based on modern information technologies and the best EU practices.

The support from the Project will be in stages. As a starting point, the Project will contribute to the planning of the preparatory stage, which includes development of the action plan on eCMS development and coordination with relevant partners. The role of the OPG in this process will be critical. As an initial step, the OPG will establish the interagency-working group (IWG), and will facilitate its meetings. The IWG will be comprised of all relevant LEAs, courts, other governmental agencies and experts from EUAM and UNOPS. One key task of the IWG is to identify the parameters and functionality of the eCMS, which will meet the expectations of its users and be in line with the best European standards for this type of system (the Concept of eCMS to be approved by IWG). The IWG will agree on the sequencing of actions (development and rollout of eCMS in Ukraine), and on subsequent migration of data from (or interoperability with) the existing Unified Register of Pre-Trial Investigations (the ‘Register’).

The IWG will identify areas where additional work would be required prior to launching an eCMS system, such as specific options within a fully featured solution that would be acceptable to all relevant stakeholders. The ultimate outcome of IWG meetings would be a jointly agreed solution on how to achieve automation of the entire document flow pertaining to the pre-trial criminal investigation process. The IWG will elaborate on the options to increase the number of future users, as compared to the current Register user base, through providing access to the system for judges and defense attorneys.

Purpose and Scope of Assignment

The ICT Specialist - eCase Management Systems (Consultant) will work under the supervision and guidance of the Programme Manager of the PRAVO Police Project. The Consultant will work closely with the Project Manager – e-Case Management Systems (to be recruited by the PRAVO Police). He/she will work both within the PRAVO Police team and within a wider stakeholder group focused on law enforcement and judicial reform in Ukraine. Accordingly, in addition to the specific requirements of the role there are norms to respect and wider strategic advice that will be sought from the Consultant. The Consultant will ensure that the PRAVO Police activities related to eCMS and possible further development and delivery of the system meet the quality and sustainability requirements of UNOPS, beneficiaries and partners. The Consultant must consider the framework provided in the PRAVO Police Description of Action and other relevant project documentation, relevant national policies and standards, good international practices and taking into account the inputs provided by the key stakeholders, primarily the EUAM. The selected candidate will deliver the activities listed below.

1) Support the IWG on development of requirements for the eCMS and related products

● Identify the measures and interventions that would contribute to enhancement of case management and information/data exchange between stakeholder agencies in pre-trial procedures for the OPG, LEAs in and courts (investigating judges), considering best EU practices most applicable for the local context;

● Provide specialist advice to PRAVO Police project team on eCMS interventions, relevant procedural and technical matters;

● Collaborate with the representatives of the EUAM, the Support Group for Ukraine (SGUA), the Delegation of the European Union to Ukraine (EUDEL) and national beneficiary institutions on the design and implementation of the eCMS;

● Cooperate with EU funded and other projects dealing with the establishment of the eCMS, while focusing on actions that targeted the NABU and Specialized Anti-Corruption Prosecutors Office (SAPO);

● Attend the meetings of the IWG and provide support to the OPG in development of the Concept of eCMS to be approved by IWG, including developing proposals on the scope of the eCMS to be implemented within PRAVO Police support;

● Attend meetings with stakeholder institutions and engage in discussions on identification of the user requirements for the new eCMS;

● Advise on the proposed solution’s interoperability with the legacy and foreseen systems;

● Identify the potential risks, issues, and impacts arising from the implementation of the eCMS interventions as well as suggest counter-measures for prevention;

● Participate in any foreseen selection process of suppliers of ICT services and goods;

● Contribute to development of PRAVO Police plans and reports related to ICT products.

2) Contribute to the development of specifications (ToR) for the eCMS solution and recommendations on their implementation

The ICT Specialist - eCase Management Systems will contribute to development of the Concept for establishment for a new eCMS (to be approved by IWG), including such aspects as functionality and interoperability with the databases of different LEAs and Courts. The focus of analysis will be on the workflow driven processing and exchange of key case information and documents leading to prosecutions or other procedural conclusions or resolution of cases. More generally, it will cover ownership and sustainability, security and privacy issues, migration of data and the licensing scheme.

The ultimate results of this activity will be as follows:

  • Overall system functional design of the proposed eCMS solution developed based on the Concept of eCMS;
  • Advise for IWG on high-level and detailed functional and nonfunctional requirements for the eCMS in line with agreed to-be working processes based on the LEAs (including the prosecution service) and pre-trial objectives provided;
  • the IWG approach to the eCMS architecture, technical standards, system integration, design and protocols, and security standards is well reflected in ToR for the procurement and delivery of eCMS products and solutions;
  • ToR for the procurement and delivery of eCMS products and solutions (described in the Concept of eCMS for hardware / software / licenses procurement), including cost estimation produced.

The Consultant must bear in mind that all solutions must be capable of implementation within the Project timescale and must demonstrably lead to more effective case management procedures because the implementation of this solution will be subject to a separate component within PRAVO Police support intervention. In case such solutions cannot be delivered by the Project, the Consultant must escalate risks of non-delivery or incomplete delivery of products to PRAVO Police and to the stakeholders.

Overall, the Consultant will be expected to contribute to the following activities:

  • Analyze available eCMS Concepts and requirements of LEAs, advise on user requirements (functional and technical), and proposed options of eCMS. The off-the-shelf eCMS products available on the market should be considered as well;
  • Advise to the IWG or sub-working groups established by the OPG on the architecture and the functional and non-functional (technical) requirements of the eCase Management Solution;
  • Identify possible integration with external systems such as external registers, databases, document management systems;
  • Identify and define the security requirements and criteria for the development and deployment of the eCMS;
  • Identify and define the possibility and requirements of potential historical data migration from physical case files, available registers and third party databases;
  • Develop ToR for the procurement and delivery of eCMS products and solutions which are acceptable for all relevant national stakeholders and are in line with the Criminal Procedure Code of Ukraine and best practice, considering IWG approach;
  • The deliverables mentioned below should contain cost estimation for the proposed solutions based on market research including assessment of compatibility, maintenance requirements and cost estimation;
  • Consult PRAVO Police on the scope of services, criteria for selection and award for the supply and implementation of the eCMS;
  • Define the high level eCMS implementation plan along with the time and cost estimations;
  • Draft the description of interventions and essential requirements for further support in implementing and rolling out the new eCMS solution across all relevant stakeholder institutions.

3) Provide expert support in the process of procurement of the eCMS from suppliers and its further implementation

As directed by the Programme Manager, the ICT Specialist - eCase Management Systems will contribute to communication with suppliers of eCMS at all stages, including tendering, assessment of commercial proposals from bidders, assessment of compliance of products to the approved specifications (ToR for the procurement and delivery of eCMS products and solutions).

4) Quality Assurance

The Consultant will:

● Set quality requirements and criteria that should be met by the eCMS and related products delivered through PRAVO Police, while considering inputs from the EUAM, the EUDEL, and national beneficiaries, in keeping with the best European and International practices;

● Conduct peer reviews and other quality checks in order to ensure that any ICT infrastructure, equipment and solutions that might be delivered by service providers meet set requirements, are fit for purpose and sustainable;

● Advise on the detailed and concrete steps required for the installation, operation and maintenance of IT infrastructure and equipment delivered to beneficiaries, as per agreement with PRAVO Police;

● Identify and report to the PRAVO Police on potential risks, issues, and impact arising from the delivery of the ICT infrastructure, tools and solutions, providing highly technical/ inputs when required

● Recommend a detailed description of each expected stage of implementation so that the system would be introduced at a level, which would equate to EU and international best practice from business, technical and quality standards standpoints.

● Ensure putting PRAVO Police ICT related activities, external and internal, in full compliance with UNOPS rules, regulations, policies and strategies.

5) Knowledge Management

The Consultant will:

● Engage in the development of PRAVO Police ICT standards and strategies;

● Interact with HQ and ICT staff from UNOPS and other UN agencies in the area to share and exchange information and expertise on applications and tools;

● Contribute to knowledge networks and communities of practice;

● Identify lessons learned and provide recommendations.

Monitoring and Project Controls

  • The Consultant has provided quality inputs at the preparatory stage – as relates to the development of requirements and specifications of the eCMS, in line with all the elements listed in the section 2 of this ToR
  • Any eventual PRAVO Police ICT products are developed and implemented in line with best international practices and standards, where applicable, and fulfil Ukrainian standards
  • PRAVO Police ICT products are fit for purpose and sustainability is thoroughly considered, as confirmed by PRAVO Police team

Education

  • Master’s degree in information sciences, computer sciences, mathematics, electronic engineering or related field is required.
  • A bachelor’s degree in the relevant discipline may be considered in lieu of the master’s degree, combined with 2 years of additional relevant experience.
  • Certification in IT Project Management is an asset.

Experience

  • Minimum five (5) years with Master’s degree or seven (7) years with Bachelor’s degree of progressive experience relevant for the assignment in the field of information technology is required. Technical knowledge of operation and functionality of IT systems at the national institutions relevant for the assignment should be demonstrated in the CV of the candidate.
  • Experience in designing and/or implementing projects in the area of e-document and/or e-case management system for a government agency is a strong asset. The candidate should provide evidence of working on similar to the development of eCMS assignments (in the capacity of an IT specialist – business process analytics/architecture) in the past.
  • Previous experience working with ICT infrastructure in the area of Rule of Law will be an asset.
