Overview

Conduct legal analysis on rights of persons with disabilities in Uzbekistan.

You have:

  • Advanced university degree in law (LLM or equivalent) or in the social sciences.
  • 7 years of relevant professional experience in human rights and legal analysis related to the rights of persons with disabilities.
  • Demonstrated expertise in international human rights standards and the CRPD.
  • Working knowledge of English and Russian is required.

Result of Service

During the implementation of the assigned tasks, the selected consultant will discuss with OHCHR ROCA progress in the provision of services and development of deliverables. If necessary, the implementation approach will be changed. The selected consultant will provide mapping and gap analysis report (approximately 20-25 pages), including: a brief summary of mapped relevant national legal provisions; analysis of gaps and inconsistencies with Article 12 of the CRPD; assessment of implications of the reservation to Article 12 of the CRPD; technically grounded recommendations for legal reform; additional recommendations on how persons with disabilities most affected by provisions on legal capacity can be meaningfully included in policy discussions about the introduction and implementation of supported decision-making in Uzbekistan and executive summary (3-4 pages) highlighting key findings and recommendations. To accomplish the above tasks, the consultant is requested to: • Identify and analyse legal provisions regulating legal capacity, deprivation or restriction of legal capacity, guardianship, consent, representation, and decision-making affecting persons with disabilities based on a comprehensive legal mapping of national legislation relevant to legal capacity of persons with disabilities (carried out by another consultant),; • Assess the identified legal provisions against Article 12 of the CRPD, General Comment No. 1 of the UN Committee on the Rights of Persons with Disabilities, and other relevant international human rights standards and recognized good practices; identify legal gaps, inconsistencies, and norms that conflict with or fall short of international standards and good practices, including reliance on substitute decision-making regimes; • Analyse the legal implications of Uzbekistan’s reservation to Article 12 of the CRPD and identify legislative changes required to enable its withdrawal; identify, where relevant, comparative examples and good practices from other jurisdictions on supported decision-making and legal capacity reform which could be introduced in Uzbekistan; • Formulate technically and legally grounded recommendations for legislative reform aimed at fully aligning national law with Article 12 of the CRPD; • Formulate recommendations on how persons with disabilities most affected by provisions on legal capacity can be meaningfully included in policy discussions about the introduction and implementation of supported decision-making in Uzbekistan.

Duties and Responsibilities

Under the overall guidance and supervision of the OHCHR ROCA Human Rights Officer based in Uzbekistan, the consultant will: • Conduct a desk review of relevant national legislation, policies, and regulatory frameworks related to legal capacity and the rights of persons with disabilities; • Analyze the compatibility of national legislation with Article 12 of the CRPD; • Review the implications of Uzbekistan’s reservation to Article 12 of the CRPD, including its practical and legal effects on the realization of legal capacity for persons with disabilities; • Identify gaps and barriers in the current legal and institutional framework that prevent persons with disabilities from exercising legal capacity on an equal basis with others; • Consult with key organizations of persons with disabilities (OPDs), civil society organizations, and other relevant actors, to collect qualitative insights if needed.
