Background and Justification:

Violence against women is a violation of human rights and a form of gender-based discrimination that takes many forms and it is rooted in inequalities between men and women. Estimates of the scale of the problem, especially during COVID19 pandemic, are alarming. Such violence has a major impact on victims and imposes a significant cost burden on society as a whole, but even more on societies in transition, with considerable segments of population living in poverty. The instruments put in place by the United Nations and Council of Europe, including the 'Istanbul Convention', to which Romania has acceded, are benchmarks in efforts to combat violence against women. The EU is tackling the problem in various ways, but yet has no binding instrument designed specifically to protect women from violence. National legal framework in Romania was amended with important changes in the last years, however, however, there is little implementation as the stakeholders (social assistance providers, health providers, forensic experts and law enforcement) are reluctant to consider it a priority, especially in rural areas.

Over the past years and following the ratification of the Istanbul Convention in March 2016, Romania assumed an ambitious and comprehensive reform on domestic violence legislation and proper implementation of the Istanbul Convention.

The efforts of the Romanian Government on ensuring a coherent approach on combating the phenomenon of domestic violence are marked also by the setting up in 2015 of the National Agency for Equal Opportunities for Women and Men (NAEO), a central institution functioning under the subordination of the Ministry of Labour and Social Justice. Through the Government Decision regulating its organisation and functioning, the newly created institution was given the mandate of exercising the functions of strategy development, regulation, representation and state authority in the field of domestic violence, with responsibilities in development, coordination and implementation of Government policies and strategies on domestic violence.

In this context, at governmental level it is acknowledged that not only the existance of legal framework in place and its harmonization with the provisions of the Istanbul Convention is sufficient, but that real results can not be achieved in the absence of specific and coherent intervention procedures and methodologies for different categories of specialists, necessarily duplicated by articulated training. Objectively, for the effective application of all primary legal provisions, it is necessary to provide the necessary support for the development of the secondary legislation and to implement all appropriate measures of support and protection for the victims, as well as for the perpetrators.

Also, the public consultations organized with relevant actors in this field revealed the absence of dedicated services for victims of sexual violence (Art.25 IC). At this point in time, the national legal framework does not provide the conditions for developing such services and victims of sexual abuse do not benefit from a comprehensive intervention.

Purpose of the assignment

Under the supervision of UNICEF’s Programme Specialist for Local Implementation and in close cooperation with: UNICEF Child Protection Officer, an international consultant and a team from the National Agency for Equal Opportunities between Women and Men, the consultant is expected to provide support for the design of a set of standard operation procedures in the field of sexual violence, to be followed by all institutional actors involved (both for rural and urban areas).

The national consultant is expected to do:

  1. review or current legal provisions ( primary and secondary legislation) related to sexual violence in Romania and service provisions for victims of sexual violence at national level ( to be developed also in relation to the provisions of the Istanbul Convention) ;
  2. desk review of reports and analysis on sexual and gender based violence in Romania;
  3. analysis of the current institutional practices in terms of provision of services, with an in deph analysis of existing gaps and inconsistencies in service provisions ( basic and specialized services) for victims of sexual violence;
  4. technical assistance and support for the development of the national methodology for victims of sexual violence.

Deliverables

  1. A summary report on the key findings, with a power point presentation and hand outs on the key findings, to be used as part of the training to be organized with NAEO staff.
  2. A list of legal amendments still required and a chart with corresponding secondary legislation clarifying the interinstitutional dimension in coordination.
  3. Standard operating procedures and a national methodology of intervention in support of victims of sexual violence.

Proposed Payment Schedule and Estimated Budget:

As per UNICEF policy, payment is made against approved deliverables.

The fee may be reduced if deliverables are not fulfilled to the required standards and quality.

Reporting Requirements:

The consultant will report to the UNICEF Programme Specialist for Local Implementation and work closely with: UNICEF Child Protection Officer, UNICEF international consultant, NAEO experts and counsellors.

The consultant will provide an update on a weekly basis (by email and/or Zoom as required) with regards to progress, challenges encountered, support required and proposed solutions.

The national consultant is expected to work together with the international consultant.

Considering the context generated by the COVID 19 pandemic, most of the work is expected to be done online.

Timing/duration of contract: 30 working days

To qualify as an advocate for every child you will have…

The consultant must offer the following demonstrated experience, knowledge and competencies:

  • At least 10 years of Senior-Level professional work experience – demonstrated experience in the field sexual and gender based violence at national level (SGBV)
  • Previous analytical and report writing experience, with EU or international organisations, demonstrated ability for preparing situation analyses, legal framework analyses, propose methodologies and elaborate standard operating procedures in the field of SGBV;
  • Advanced university degree in social sciences or other related field, preferably with specialized training in gender equality;
  • Proven knowledge of the national and EU legal framework in the field of gender equality and sexual violence
  • Professional experience in Romania, working with multiple stakeholders from the NGO sector and public administration
  • Fluent Romanian; Excellent knowledge of English.

  2. a financial offer Financial bid_national consultant_gross per day.docx, specifying the requested gross daily fee in RON taking into consideration that the consultant will be responsible for paying all his/her due income taxes as per fiscal legislation.

Mobility is a condition of international professional employment with UNICEF and an underlying premise of the international civil service.

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures, and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws.
