Background

I. Organizational Context

The United Nations Entity for Gender Equality and the Empowerment of Women (UN Women), grounded in the vision of equality enshrined in the Charter of the United Nations, works for the elimination of discrimination against women and girls; the empowerment of women; and the achievement of equality between women and men as partners and beneficiaries of development, human rights, humanitarian action and peace and security. Placing women's rights at the center of all its efforts, UN Women leads and coordinates United Nations system efforts to ensure that commitments on gender equality and gender mainstreaming translate into action throughout the world. It provides support to Member States’ efforts and priorities in meeting their gender equality goals and for building effective partnerships with civil society and other relevant actors.

In Türkiye, in line with its global Strategic Plan (2022-2025) and Country Strategic Note (2022-2025), and the overall UN Sustainable Development Cooperation Framework for Türkiye (UNSDCF) (2021-2025), UN Women works towards the overarching goal of “Women and girls including those at greatest risk of being left behind fully exercise their human rights, enjoy a life free from violence and discrimination, and lead, influence and benefit from sustainable and inclusive socio-economic development towards the advancement of gender equality in Türkiye.” UN Women works in four thematic areas: (i) governance and participation in public life; (ii) women’s economic empowerment; (iii) ending violence against women and girls; and (iv) women, peace and security, humanitarian action and disaster risk reduction. UN Women contributes to three UNSDCF outcomes: 1) Women and girls have improved and equal access to resources, opportunities, and rights, and enjoy a life without violence and discrimination; 2) By 2025, Persons under the Law on Foreigners and International Protection are supported towards self-reliance. 3) By 2025, governance systems are more transparent, accountable, inclusive and rights-based with the participation of civil society, and quality of judicial services is improved.

Towards these goals, UN Women implements programmes and projects that aim to advance gender equality, improve women’s access to opportunities, rights and services in political, social and economic life and combat gender stereotypes, discrimination and violence, as required by international and national legal and policy commitments. UN Women collaborates with numerous partners – central and local level government authorities, civil society organizations, including women’s organizations and platforms, academia, private sector companies, other UN agencies. It commits itself to the Leaving No One Behind principle, by supporting targeted actions to remove the obstacles that marginalized and vulnerable groups of women face in accessing their rights and to promote them as agents of change.

UN Women has collaborated with Fenerbahçe Sports Club under the framework of the HeForShe movement, with the support of Tüpras, since 2018. This collaboration represents a first and unique undertaking to make the sports club more inclusive and egalitarian through a holistic framework of analysis, capacity building and

measurable actions. Under this collaboration, a gender analysis of Fenerbahçe Sports Club and Affiliated Companies was conducted in 2019 in five strategic areas in sport: 1. Participation 2. Leadership 3. Coaching 4. Gender-based violence (verbal and discourse-level) 5. Representation in media. In 2021, UN Women conducted an assessment of the findings of the initial gender analysis, which included a brief comparative study (similar international practices). Tailor-made targeted gender awareness trainings for capacity building and mobilization of male and female allies in Fenerbahce Sports Club (staff, management, athletes and technical personnel) have been designed and delivered.

Fenerbahçe Sports Club has become a national champion of gender equality in and through sports as it has implemented gender-responsive plan for gender equality and women’s empowerment, and has become the first sports club in Türkiye and Europe that signed United Nations Women’s Empowerment Principles (WEPs) and the first sports club in Türkiye that committed to UN Women’s Sports for Generation Equality principles.

In 2020-2021, UN Women Türkiye developed the Guidelines for Gender-responsive Sports Organizations on the basis of the UN Women’s Sports for Generation Equality Principles, taking into account the experience of Fenerbahçe Sports Club over the past years. The Guidelines are the first of their kind attempt to translate the Sports for Generation Equality principles into a step-by-step guide of how to develop strategies and translate these into measurable actions.

The partnership includes creating a model for the sports ecosystem, including sports clubs, federations, and local amateur sports organizations to implement the Guidelines for Gender-responsive Sports Organizations developed by UN Women, in partnership with Fenerbahçe Sports Club under the previous collaboration. It extends the work done in the first phase of the partnership with professional branches of Fenerbahçe Sports Club to five amateur branches: rowing, athletics, swimming, table tennis, boxing.

In 2021-2022, UN Women Türkiye and Fenerbahçe Sports Club developed Fenerbahçe Sports Club’s Action Plan on Gender Equality 2022-2025 to increase women’s representation in Fenerbahçe Sports Club’s leadership, management and coaching personnel and increase women athletes’ participation, development of an organizational policy on preventing and combating discrimination and gender-based violence. Four different trainings modules were developed: (i) gender equality awareness, (ii) engaging men in gender equality and transforming harmful masculinities, (iii) preventing violence against women and (iv) gender-responsive sports media reporting. In 2022, UN Women Türkiye initiated the development of the “Safeguarding Policy against Discrimination, Sexual Harassment and Abuse in Sports by Fenerbahçe Sports Club” (Safeguarding Policy).

Within this context, a specific activity of the collaboration aims to support Fenerbahçe Sports Club in finalization, endorsement and institutionalize the “Safeguarding Policy against Discrimination, Sexual Harassment and Abuse in Sports by Fenerbahçe Sports Club” to contribute prevention of violence against women in sports. For this purpose, UN Women developed a training on preventing violence against women in sports for Fenerbahçe Sports Club which aimed Fenerbahce Sports Club’s athletes and technical staff of amateur branches, to explore gender equality issues, causes and prevention of violence against women in sports.

In this context, UN Women Türkiye is looking for one National Consultant to support the in finalizing the draft “Safeguarding Policy against Discrimination, Sexual Harassment and Abuse in Sports by Fenerbahçe Sports Club” and institutionalization of the Safeguarding Policy in Fenerbahçe Sports Club with a perspective of sports law. There will be another National Consultant for Gender Equality (GE) and Safeguarding in Sports working this topic and the National Consultant for Sports Law is expected to work with the National Consultant for GE and Safeguarding in Sports on finalizing the draft Safeguarding Policy and developing the related training materials.

Duties and Responsibilities

II. Functions

Under overall guidance of UN Women Deputy Country Director and the direct supervision of Programme Analyst, the National Consultant is expected to provide consultancy services for the below-listed tasks and work closely with the National Consultant for GE and Safeguarding in Sports for all deliverables indicated within this term of reference.

  • Desk review on national and international legal developments and dynamics in addition to best practices relevant to safeguarding in sports,
  • Contribute to reviewing and finalizing the draft “Safeguarding Policy against Discrimination, Sexual Harassment and Abuse in Sports by Fenerbahçe Sports Club” which was initiated by UN Women, and the draft code of conduct and reporting mechanism initiated by Fenerbahçe Sports Club under the previous collaboration together with the national consultant on sports law together with the National Consultant for GE and Safeguarding in Sports. S/he is expected to counsel on sports law with a gender perspective.
  • Periodical review of implementation of the Safeguarding Policy to reflect any legal or regulatory change,
  • Assist in identifying areas where the capacities of Fenerbahçe Sports Club can be strengthened to enhance the implementation of the measures imposed by the Safeguarding Policy,
  • Participate in meetings with the project partners in order to finalize and institutionalize the Safeguarding Policy.
  • Contribute to developing “Safeguarding in Sports” training materials which will be developed by the UN Women’s National Consultant for Safeguarding in Sports with a sports law and gender perspective.

The consultant is expected to work closely and in coordination with the project team including another National Consultant involved in development and delivery of all materials. The abovementioned tasks are indicative and subject to further detailing through specific service requests to be made by UN Women Türkiye Office during the course of the contract duration.

III. Deliverables and Payment Schedule

Duration of the assignment is from 31 August 2023 to 30 August 2024. The Consultant is expected to spend up to 16 working days on a non-consecutive basis throughout the assignment. The Assignment will include interim deliverables, which will be defined in the specific service requests to be made by UN Women to the consultant.

*The number of working days are solely provided to give the National Consultant an idea on the work to be undertaken.

All deliverables shall be received and cleared by UN Women in Türkiye. All reports shall be presented in Turkish in principle, and in English upon request and need, in electronic version. All products shall be presented in Turkish.

The mentioned number of working days has been estimated as being sufficient/feasible for the envisaged volume of work to be completed successfully and is proposed as a guideline for the duration of assignment. It cannot and shall not be used as criteria for completion of work/assignment. The provision of envisaged deliverables approved by the UN Women in Türkiye shall be the only criteria for Consultants’ work being completed and eligible for payment/s.

Payment Schedule:

The amount paid to the Consultant shall be gross and inclusive of all associated costs such as Travel, social security, pension and income tax etc. Payments will be made upon approval of deliverables by UN Women Türkiye, along with the Certification of Payment Form (COP) on the basis of the lump-sum price of that respective deliverable and pertaining payment documents signed by the National Consultant in addition to the timesheet indicating the days allocated for the specific deliverables and approved by the responsible Programme Analyst. While the National Consultant may invest less or more than estimated number of working days for each deliverable different than the estimated working days stipulated in the table in Section III, the amount of payment to be affected to the National consultant within the scope of this Assignment will be based on the lump-sum prices of the deliverables.

If any of the deliverables stipulated in above table are not produced and delivered by the National Consultants in due time and to the satisfaction of UN Women Türkiye, no payment will be made even if the National Consultants have invested time to produce and deliver such deliverables.

During assignment’s related missions, the National Consultant may use the facilities of the office (i.e. internet access, printing, copying, local phone calls, etc.). However, s/he is expected to use his/her own personal computer.

Mandatory Training Courses:

The Consultant shall complete all the mandatory and other required UN training courses and modules on time. The certificates shall be submitted to the supervisor.

The Consultant will be responsible for all travel arrangements and expenses and daily subsistence allowances associated with undertaking this assignment. All travels shall be coordinated with UN Women Türkiye Office and shall be included in the total contract amount of the Consultant.

Indicatively two domestic travels to Istanbul are expected to take place. Each mission is expected to last one day. The financial proposal template is explanatory in this regard. The taxi fees for attending the meetings are also under the responsibility of the Consultant. In case of unforeseeable Travel exceeding the travel budget of the Consultant, such costs should be agreed upon between UN Women and the Consultant prior to the Travel, and will be reimbursed, in line with the UN Women travel policy.

In the context of the assignment, wherever possible, the meetings should be carried out through online conferencing such as Skype, Zoom, MS Teams, etc.

For all the travels under this assignment, the Consultant is required to provide UN Women with the requested travel documentation in a timely manner, both before and after the travels. Please note that failure to do so may result in no entitlement.

IX. Evaluation of Applicants

Candidates will be evaluated using a cumulative analysis method taking into consideration the combination of the applicants' qualifications and financial proposal. The contract will be awarded to the Consultant whose offer receives the highest score out of below defined technical and financial criteria. Only candidates obtaining a minimum of 49 points in the technical evaluation would be considered for financial evaluation.

The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal. All other price proposals receive points in inverse proportion. A suggested formula is as follows:

An interview/written test may be used as part of the evaluation procedure.

Annex I: Price Proposal Guideline and Template

The prospective Individual Consultant should take the following explanations into account during submission of his/her price proposal.

1.Daily fee

The daily price proposal should indicate a "lump sum amount" which is "all-inclusive"; All costs (professional fees, communications, consumables during field related missions, etc.) that could possibly be incurred by the Contractor needs to be factored into the proposed price.

UN Women will not withhold any amount of the payments for tax and/or social security related payments. UN Women shall have no liability for taxes, duties or other similar charges payable by the Individual Contractor in respect of any amounts paid to the Individual Contractor under this Contract, and the Contractor acknowledges that UN Women will not issue any statements of earnings to the Individual contractor in respect of any such payments.

2.Travel costs

Daily Substance Allowance (DSA) Cost x 2

(This is in line with the maximum estimated number of travels for this assignment. The missions may be for one day DSA based on the number of nights spent in the city of mission. As per UN Women guidelines; the DSA consists of accommodation (50%), breakfast (6%), lunch (12%), dinner (12%) and miscellaneous expenses (20%). The DSA fee of the Consultant should indicate the lump sum fee for accommodation, breakfast, lunch, dinner and miscellaneous expenses. The Consultant will receive reduced DSA for the items as per the percentages stated above covered within the organization provided by UN Women. Important notice: For each night away from the duty station, the Consultant will be paid one day DSA.)
