Result of Service Deliverable 1: Inception report (3 pages)

The inception report will include evaluation methodology, a detailed work plan, data collection instruments (including interview questionnaires), and field visit plans.

Deliverable 2: Provide inputs to the training agenda and identification of key experts and participants

The consultant will provide inputs for a UNICRI training agenda covering all relevant explosive-related topics. This will include inputs for identifying and inviting relevant key experts and participants with expertise in explosives.

Deliverable 3: 1st draft report with a preliminary roadmap

The draft report will include an analysis of the regulatory impact of the draft law on the use of explosive materials for civilian purposes. The report will include a preliminary roadmap for improving or changing these areas to achieve the desired outcomes, incorporating best practices and concrete, actionable steps based on the identified needs and gaps.

Deliverable 4: 2nd draft report with a preliminary roadmap

Once the inputs from UNICRI and MIA are incorporated into the first draft, the consultant will share the second draft with the UNICRI project team.

Deliverable 5: Final report and PPT presentation

The consultant should include all recommendations and submit the following:

- Final report - PowerPoint presentation of the report to be presented at a validation workshop in Chisinau

Duties and Responsibilities 1. Background of the assignment:

United Nations Interregional Crime and Justice Research Institute (UNICRI) is a United Nations entity established in 1968 to support countries worldwide in preventing crime and facilitating criminal justice. UNICRI is mandated to assist intergovernmental, governmental, and non-governmental organizations in formulating and implementing improved policies in the field of crime prevention and criminal justice. UNICRI's goals are:

to advance understanding of crime-related problems;

to foster just and efficient criminal justice systems;

to support the respect of international instruments and other standards;

to facilitate international law enforcement cooperation and judicial assistance.

To support the Republic of Moldova in implementing the Home Affairs Development Strategy - Together4Home Affairs (Ministry of Internal Affairs), UNICRI organized two mission visits to Chisinau in June and September 2022. These visits identified key areas of focus for Moldovan law enforcement, including trafficking in persons, drug trafficking, trafficking of arms, cybercrimes, and community policing strategies. In February 2023, UNICRI organized, in cooperation with EUROPOL, a workshop to present to Moldovan relevant stakeholders selected European best practices on the management of bomb alert cases. The workshop was organized based on a specific request of the Ministry of Internal Affairs. At the margin of the workshop, the Ministry asked for assistance from UNICRI to develop a study to draft a new law on the regime of explosive materials for civilian use was also discussed.

Following discussion, further research, and data analysis, UNICRI recommended implementing a multi-year program to address specific priorities through a comprehensive and integrated approach involving different government agencies and stakeholders. The programme envisages the design of improved security and justice policies and the delivery of ad hoc training to address current emergencies faced by law enforcement.

To align Moldova's national legislation with the European Union's regulations and prepare for accession to the EU, the draft law on the regime of explosive materials for civilian use is an important step. This law is part of the execution of several important plans, including the Roadmap of the Ministry of Internal Affairs, the Action Plan of the Government, and the Crime Prevention and Combating Program for 2022-2025.

The purpose of the draft law is to ensure that the recommendations formulated by the European Commission are fully, qualitatively, and timely implemented by transposing the European Directive 2014/28/EU of the European Parliament and the Council into national law. This directive aims to harmonize the legislation of the Member States relating to the making available on the market and supervision of explosives for civil uses.

2. Specific tasks to be performed by the consultant:

Under the supervision of the Programme Officer, in close collaboration with the project team and with the overall guidance and approval of the Senior Programme Officer (Deputy Director), the incumbent will perform the following tasks:

Phase One: Prepare a brief inception report (2 working days)

- Meeting with Senior Programme Officer (Deputy Director) and Programme Officer to discuss scope, methodology and timeline; - Prepare inception report outlining the key steps/methodology with specific deliverables and timeline; contextual analysis (3 pages).

Phase Two: Review, assess, and provide inputs for the training agenda (10 working days)

- Conduct a comprehensive desk review of current policies, guidelines, and regulations related to the making available on the market and supervision of explosives for civil uses, including relevant legislation, operational procedures, organizational structure, staffing, and equipment; - Conduct a five-day mission in Moldova for field research, including site visits, stakeholder interviews, and data collection and analysis to inform the study and validate findings; - Assist the UNICRI project team in organizing and facilitating a training workshop on the making available on the market and supervision of explosives for civil uses. This will include providing inputs for a training agenda, identifying key experts and participants, and post-training evaluation.

Phase Three: Prepare and present the preliminary draft report and roadmap and contribute to training delivery (15 working days)

- Based on the analysis and consultation with various stakeholders, prepare a comprehensive report that analyses the regulatory impact of the draft law on the use of explosive materials for civilian purposes and provides, in an addendum, a roadmap with practical guidance that outlines concrete and actional steps for improving capacity; - Contribute to training delivery with the UNICRI project team and key experts in Chisinau on the the making available on the market and supervision of explosives for civil uses; - Present the draft report in Chisinau to the UNICRI project team, key government representatives, MIA officials, and relevant stakeholders to gain feedback and ensure that the proposed steps are feasible and relevant to the context.

Phase Four: Improve the roadmap based on feedback from MIA and UNICRI (8 working days)

- Present and discuss the improved report document and proposed roadmap to the Senior Programme Officer (Deputy Director) and Programme Officer that considers their feedback and feedback from meetings with MIA officials.

Phase Five: Finalize the report and validate the roadmap (5 working days)

- Draft report and roadmap shall be presented in a stakeholder workshop to be convened at the national level in Chisinau with the UNICRI project team, key government representatives, and MIA officials.

Qualifications/special skills Advanced university degree (i.e., Master or equivalent) in law or a related field is required. At least five (5) years of relevant work in conducting assessments, investigations, and evaluations related to the use of explosives, preferably within law enforcement agencies or international organizations is required. Relevant professional experience in the area of civilian use of explosives is highly desirable. Relevant professional experience related to Moldovan legislation is desirable. Previous relevant experience with the United Nations or similar large international or regional organisations is desirable.

Languages For the position advertised, fluency in English is required. Knowledge of Romanian is desirable.
