Background

The Joint UNDP/UN Women/UNICEF Sawasya Programme is the United Nations foremost programme aimed at promoting and advancing the rule of law, justice, security and human rights in Palestine. The programme represents the primary programmatic vehicle of the United Nations for advancing the rule of law, integrity, gender justice and human rights in Palestine for the period 2018-2023. Bringing together the main UN entities (UNDP, UN Women and UNICEF) mandated and invested in these areas in an integrated programme framework, the programme seeks to elevate the state building enterprise for a progressively functioning and increasingly inclusive rule of law system that respects, protects and fulfils human rights and gender equality and promote peace and security. The programme builds on established partnerships with government institutions and civil society organizations and capitalizes on the extensive reach of the involved UN entities across the West Bank, including East Jerusalem, and the Gaza Strip.

Under output 1.3, Sawasya II is supporting the reunification process of justice and security institutions in the West bank and Gaza, and has been working in close coordination with civil society organizations to support their efforts in advancing the reconciliation agenda, through monitoring, advocacy and networking to integrate transitional justice mechanisms in the reconciliation process.

In 2016, the programme in its first phase supported the development of a report titled “Prospects for Justice Sector Reintegration in the State of Palestine”[1] which assessed the evolution of the main justice institutions in the West Bank and Gaza since the divide of 2007, and provided recommendations and practical mechanisms for their reintegration, highlighting in particular the needs in terms of mandate and functions; human resources and infrastructure.

Following the recent presidential announcement of first parliamentary and presidential elections in 15 years, which will take place between 22 May and 31 August, the Sawasya II programme seeks the services of an international expert in integration of justice sector institutions, to update the 2016 report by producing an up-to-date assessment of capabilities and limitations of justice institutions in Gaza and WB, and specific recommendations for reintegration to uphold the rule of law and ensure Palestinian people’s access to justice in this critical time.

Duties and Responsibilities

FUNCTIONS/KEY RESULTS EXPECTED

The international expert will be expected to work on updating Prospects for Justice Sector Reintegration in the State of Palestine report, that was developed in 2016. More specifically, the expert is expected to produce an up-to-date assessment of existing capacities and limitations of justice institutions in Gaza and WB, and to provide specific recommendations for a smooth reintegration of justice institutions while ensuring that judiciary remains operational and efficient during this transition phase in accordance with international standards and best practice.

TARGET GROUP

  • Justice institutions in the West Bank and Gaza (Ministry of Justice, High Judicial Council, Attorney General Office, Supreme Judge Department, High Judicial Shari’a Council).
  • Civil society organizations in Gaza and the West Bank specialised in law, judiciary reform, human rights, women’s rights and transitional justice initiatives.
  • Law faculties in the West Bank and Gaza
  • The Independent Commission for Human Rights (ICHR)

DELIVERABLES

The international legal expert will be responsible for the delivery of the following expected deliverables and report to the Sawasya II programme Technical Specialist:

  • By end of first month: Inception report of 5-7 pages summarizing key meetings and information collected to date, along with final report outline and identifying any obstacles or challenges to completing the assignment as expected.
  • By end of second month: Produce an updated version of the 2016 report “Prospects for Justice Sector Reintegration in the State of Palestine”, with an executive summary, key findings and recommendations.
  • End of Assignment: The expert is expected to hold a series of stakeholder consultations to share and discuss the final draft including key national justice sector actors in the WB and Gaza, CSOs and Sawasya II programme management team.

REQUIREMENTS FOR THE SUCCESSFUL COMPLETION OF THE ASSIGNMENT

  • Close consultation with Sawasya II programme team in Gaza and the WB.
  • Provide technical advice, examples and comparative experiences of justice sector reform and reintegration scenarios and options from other contexts that could be relevant to the Palestinian context.

Education

  • Advanced University degree in Law, international Law, Human rights or other related fields.

Experience

  • Minimum 10 years of professional experience in rule of law and human rights.
  • Extensive knowledge and experience in assessing and analysing opportunities for reforming justice institutions and laws in a sensitive political environment.
  • Proven experience in working within the Palestinian legal system (Gaza and West Bank).
  • Proven experience in comparative assessment, review and analysis of justice sector needs, including in relation to structure, mandate, human resources, administrative decision making, case processing and infrastructure needs.
  • Previous experience working in conflict/post conflict situations constitutes an advantage.
  • Experience working with UNDP rule of law programmes is an asset.
  • Sound knowledge and understanding of the political dynamics in the Middle East and in the State of Palestine in particular.

Languages

  • Fluency in English is required
  • Good communication in Arabic is desired

INSTRUCTIONS TO APPLICANTS

Introduction

UNDP/PAPP seeks technical proposals from qualified individual consultants to update the 2016 report titled "Prospects for Justice Sector Reintegration in the State of Palestine, and produce an up-to-date assessment of capacities and limitations of justice institutions in Gaza and WB, and specific recommendations for reintegration to uphold the rule of law and ensure Palestinian people’s access to justice, as outlined under the Terms of Reference.

Documents comprising the Technical and Financial Proposals

Interested individual consultant must submit the following documents/information, which comprises the Technical& Financial Proposals:

  1. Provide Curriculum vitae form including past experience in the field of rule of law, human rights and reforming justice sector institutions.
  2. Proposed methodology to achieve the tasks included in the ToR (not more than 5 pages)
  3. Completed financial proposal form, found under Annex III: the financial proposal is all-inclusive and shall take into account various expenses incurred by the consultant while fulfilling its mission (e.g. transportation cost…).

Evaluation

Preliminary examination

UNDP/PAPP will examine the Proposals to determine whether they are complete, and whether they are substantially responsive to the qualification and experience minimum requirements. A Proposal determined as not substantially responsive will be rejected by UNDP/PAPP and may not subsequently be made responsive by the Applicant by correction of the non-conformity.

Detailed examination

Individual consultants will be evaluated based on a cumulative analysis taking into consideration the combination of the applicants’ qualifications and financial proposal.

Only those candidates who will obtain min. 70 points for the technical evaluation will be assessed for the financial proposal evaluation.

Individual Contractor (IC) will be evaluated based on Cumulative Analysis. The respective weight of the proposals is:

Award of Individual Contract

The procuring UNDP entity reserves the right to accept or reject any Proposal, and to annul the solicitation process and reject all Proposals at any time prior to award of contract, without incurring any liability to the affected applicant or any obligation to inform the affected applicant or applicants of the ground for the UNDP’s action.

The award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Highest score / combined score calculation methodology:

100 points shall be allocated to the lowest total fees proposed among those invited candidates which were successful in the evaluation of the technical proposal (i.e. obtained a technical score of 70 or more). All other fees proposals shall receive points in inverse proportion to the lowest total fees; e.g. [100 Points] x [US$ lowest total fees] / [US$ other] = points for other proposer’s fees.

The General mark or combined score for each proposal will be arrived as follows:

Rating the Technical Proposal (TP):

TP Rating = (Total Score Obtained by the Offer / Max. Obtainable Score for TP) x 100

Rating the Financial Proposal (FP):

FP Rating = (Lowest Priced Offer / Price of the Offer Being Reviewed) x 100

FINANCIAL PROPOSAL FORM

Your financial offer in USD shall specify a lump sum figure all-inclusive and shall take into account various expenses incurred during the contract period and shall form the amount of the resulted contract between the winning Consultant/Contractor and UNDP. No other entitlements will be considered after submission of financial proposals.

The financial proposal shall include a breakdown of this lump sum amount (number of anticipated working days, all envisaged travel (such as but not limited to all travel to join duty station/repatriation travel), per diems/daily allowances). Fee Breakdown should be attached under a separate sheet.
