Provide consultancy for capacity building in torture prevention

You have:

  • Advanced degree in Law, Social Sciences or other related fields
  • At least seven years of professional experience in law, human rights, political, social sciences or related field
  • At least five years of experience working with national preventive mechanisms or organizations on torture prevention and/or places of detention
  • At least seven years of experience in developing policy documents and training curricula
  • Knowledge of international human rights standards related to torture and ill-treatment and persons deprived of liberty
  • English is required; Knowledge of Khmer is desirable

Result of Service This is a 3-month full-time (including one month remote work) consultancy with below schedule of delivery: - Target date of output/work assignment a. : 1 October to 30 October 2022 - Target date of output/work assignment b.: 1 November to 31 December 2022 - Target date of output/work assignment c.: 1 October to 30 October 2022 - Target date of output/work assignment d.: 1 November to 15 November 2022 - Target date of output/work assignment e.: 10 December to 20 December 2022

Payments The consultancy fees will be paid in monthly installments, upon submission of satisfactory monthly reports demonstrating progress against expected outputs. The final payment will be paid upon satisfactory completion of the consultancy, including the last monthly report and all deliverables included in the ToRs

Duties and Responsibilities Cambodia became a Party to the Convention against Torture (CAT) in November 1992 and to the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (OP-CAT) in March 2007.

In light of OP-CAT requirements, in August 2009, Cambodia established by a Sub-decree a national preventive mechanism (NPM), with the name “National Preventive Mechanism against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment”.

On 22 August 2017 and 22 November 2017, the King adopted the Royal Decrees on the establishment of the new mechanism namely the “National Committee against Torture” (NCAT) and on the designation of new members, respectively. A new Sub-decree setting out the framework for the NCAT Secretariat was issued on 27 February 2018, repealing the 2010 Ministerial Proclamation.

OHCHR Cambodia has initiated its technical assistance to NCAT since 2009 consisting mainly in capacity building activities, workshops and seminars, and organized the United Nations Special Prevention from Torture Committee visits in 2009 and 2013. OHCHR also conducted joint visits with NCAT in 2011, 2012 and 2014, and shared publications among other activities.

In 2021, NCAT requested OHCHR to provide capacity-building to staff members in the form of a Training of Trainers. OHCHR conducted a needs assessment in 2021. On 3 March 2022, NCAT and OHCHR co-organized a full day workshop on “Challenge and Opportunity for Torture Prevention Work” to further discuss capacity building needs and opportunities. The meeting defined a work plan to be pursued by NCAT with the technical assistance of OHCHR.

In follow-up, OHCHR will support the development of policies, especially Standard Operating Procedures (SOPs) on visits to places of detention, interviews and investigations. Also, OHCHR plans to support also the drafting of a new law for NCAT rendering the entity more independant and launching a number of training courses.

This consultancy is part of the assistance provided by OHCHR to NCAT with the aim of building institutional capacity as well as individual staff capacity in the area of torture prevention and investigation. This support will be achieved through the following specific outcomes:

- Outcome 1: Law of NCAT revised and complaint with norms of independence of NPMs;

- Outcome 2: Capacity of NCAT, as an institution, and its staff members is enhanced to effectively carry out torture prevention work through the development of appropriate policy documents, and

- Outcome 3. NCAT has the required SOPs, materials and curriculum in place to conduct awareness raising activities efficiently.

Qualifications/special skills Academic Qualifications: Advanced degree in Law, Social Sciences or other related fields Experience: At least seven (7) years of professional experience in law, human rights, political, social sciences or related field.

At least five (5) experience working with persons with national preventive mechanisms or organizations working on torture prevention and/or places of detention.

At least seven (7) experience in developing policy documents and training curricula.

Knowledge of international human rights standards, especially those related to torture and ill-treatment and persons deprived of liberty. Language: English is required. Knowledge of Khmer is desirable
