Duties and Responsibilities The United Nations (“UN”) Team of Experts on the Rule of Law and Sexual Violence in Conflict (“TOE”) was created by Security Council resolution 1888 (2009) to assist national authorities in strengthening the rule of law, with the aim of ensuring criminal accountability for perpetrators of conflict-related sexual violence (CRSV). This resolution recognized that CRSV is a threat to international peace and security, and that Member States affected by conflict need assistance to address impunity in order to prevent and deter future violations. The Team is based at the UN Headquarters in New York and deploys regularly to some of the world’s most challenging contexts. It has a unique “co-lead” structure that includes members from several UN entities to enable the UN to deliver as one in assisting Member States to address CRSV. The Team is led by a Team Leader who reports to the Special Representative of the Secretary-General on Sexual Violence in Conflict (SRSG-SVC), and currently comprises experts from the Department of Peace Operations (DPO), the Office of the United Nations High Commissioner for Human Rights (OHCHR), the Office of the SRSG-SVC and the United Nations Development Programme (UNDP), who each report to both the Team Leader and their respective entities.\ The TOE is seeking a technical consultant on Ukrainian criminal law and practice who has knowledge and familiarity of the Ukrainian criminal justice system; its applicable legal codes; and its case law The Consultant provides assistance to the TOE in reviewing Ukrainian national legislation, CRSV cases and policy decisions and in formulating legal advice for national judicial authorities on matters related to accountability for CRSV crimes.

The consultant’s work will ultimately enhance the TOE’s ability to advise national authorities on the rule of law response to conflict-related sexual violence in an impartial manner and facilitate the Team’s communication and coordination with national authorities in Ukraine.

The consultant will be required to prepare: a. Mapping of key stages of pre-trial proceedings under Ukrainian Criminal Procedure Code b. Overview of existing legal provisions on areas relevant to the TOE engagement in Ukraine, such as victims’ support, victims’ participation in the judicial proceedings, and informed consent. c. Summary and analysis of key CRSV cases d. Drafts of legal memoranda, including on the incorporation of crimes against humanity in the Ukrainian legislation, new draft legislation, and proposed amendments to the Ukrainian Criminal Code.

In addition, the consultant will assist with the preparation and follow up actions of meetings with Ukrainian authorities; provide specific research, as requested, and provide occasional translations of legal documents.

Qualifications/special skills A minimum of 5 years of professional work experience in law. In-depth knowledge of the Ukrainian criminal justice system. Excellent writing and analytical skills. Languages Fluency in written and spoken English. Fluency in written and spoken Ukrainian. Knowledge of Russian is desirable
