ORGANIZATIONAL CONTEXT

These jobs are found in Headquarters (HQ), Regional Bureaux (RBs) or Country Offices (COs) and job holders report to a more senior Programme Policy Officer. Job holders operate with a high degree of independence, manage more junior staff to ensure that programme and policy objectives are achieved in full. They are usually involved in a wide variety of programme and policy activities and analytical work, some of which may be of a considerable complexity. At this level job holders are expected to contribute to performance improvement.

JOB PURPOSE

The PIA Consultant will conduct an assessment and evaluation of the current practice in WFP Nepal with regards to data privacy and data protection vis-à-vis WFP’s corporate guidelines, theory and other relevant literature in the field and produce a report with clear analysis and recommendations.

The PIA Consultant will be based in Kathmandu or remotely depending on COVID-19 restrictions and the field activities needed for PIA completion. S/he will be under the guidance of Head of Programme and the technical supervision of the Regional Privacy Impact Assessment Advisor.

BACKGROUND

WFP Nepal has been implementing its five-year Country Strategic Plan (CSP) 2019-2023. It contributes to five Strategic Outcomes (SOs) that are aligned to five Strategic Results of Sustainable Development Goals (SDG) 2 (Zero Hunger) and SDG 17 (Partnerships for Development). The five Strategic Outcomes (SO) are: SO 1: affected populations in Nepal have timely access to adequate food and nutrition during and in the aftermath of natural disasters and/or other shocks. SO 2: Food Insecure people in targeted areas have improved nutrition throughout the key stages of the life-cycle by 2025. SO 3: Vulnerable communities in remote, food-insecure areas of Nepal have improved food security and resilience to climate and other shocks by 2030. SO 4: The Government of Nepal has strengthened capabilities to provide essential food security services and respond to crises by 2023. SO 5: Government efforts towards achieving Zero Hunger by 2030 are supported by inclusive and coherent policy frameworks across all spheres of government by 2023. To be able to serve the people in need, WFP processes large amounts of beneficiary data within its own programmes and operations, including emergency assistance, and primarily uses a digital platform SCOPE as the technological solution for beneficiary information and transfer management platform. WFP also registers feedback and complaints from communities through its community feedback mechanisms (CFM) where it operates, which includes personal information. In addition, under the coordination of UNRCO, UN Agencies in Nepal have been developing UN Common Cash Framework, with aim of collaboration in various stages of humanitarian cash response in Nepal among UN Agencies, including beneficiary information registration and management. This framework enables UN Agencies working within the framework to share the beneficiary data and or use a single platform for registration and transfer management. WFP has offered its platform, SCOPE, to other UN Agencies for the same if necessary. However, the impact on beneficiary data protection and privacy has not been evaluated yet, which is necessary to identify risks and mitigation measures. Managing and sharing peoples’ personal data and identity is extremely sensitive. Unintended use of personal data, especially if used outside its legitimate purpose, may cause harm to the people WFP seeks to assist. Protecting personal data is therefore about protecting people’s life, dignity and integrity, which is the core commitment set forth by WFP 2020 Protection and Accountability Policy. Moreover, with the WFP Guide to Personal Data Protection and Privacy (2016) and draft Beneficiary Identity Management Guidance (2020), WFP has taken concrete steps to put forward beneficiary data protection in the way it operates and has developed Data Protection Toolkit (2019) to support this objective. A key tool used in data protection work in WFP is a Privacy Impact Assessment (PIA) which is aimed at identifying, evaluating and addressing the risks (e.g. protection, legal, principled humanitarian action, etc.) arising from the processing of personal data related to a specific activity, project, programme, initiative or, in this case, a whole Country Strategic Plan (CSP). The PIA exercise is expected to access the impact on data protection and privacy of beneficiaries throughout WFP Nepal operations, its beneficiary information management platform, SCOPE, including the possible implementation of UN Common Cash Framework. The PIA is a multifunctional exercise, which draws from the expertise of units such as IT, SCOPE, partnerships, programme and protection.

TERMS AND CONDITIONS

JOB TITLE: Privacy Impact Assessment (PIA) Consultant TYPE OF CONTRACT: National/International Consultancy I UNIT/DIVISION: Programme DUTY STATION (City, Country): Kathmandu, Nepal (Combination of Remote and In-country assignment) DURATION: 40 days within 3 months on When Actually Employed (WAE) basis

KEY ACCOUNTABILITIES (not all-inclusive)

Conduct and complete the Privacy Impact Assessment for WFP Nepal operations in collaboration with other relevant units in WFP. Completing the PIA includes, but is not limited to:

• Develop a deliverable-based workplan for the assignment including a two-pager inception report indicating understanding of the task along with methodology to be used, with the completed PIA report as the final product • Conducting secondary literature and data review to understand the: - Socio-political situation and relevance of identity and personal data therein; - Protection issues experienced by crisis and poverty affected people, with special focus on issues where identity, or lack of identity, or any particular status of the person (e.g., ethnicity, language, disability, gender, displacement, etc.) is a triggering factor; - Legal framework on data privacy and protection in Nepal, including applicability of UN privileges and immunities, domestic legislation and regulations of relevance to people’s identity (e.g., Know Your Client regulations; anti-terrorism laws; anti-money laundering laws; any other public health or public security law requiring access to personal data) and possibility that partners or third parties are obliged to disclose data to authorities; - Known or foreseeable actors that might be interested in requesting/accessing/seizing personal data collected by WFP to pursue humanitarian and non-humanitarian purposes; - Risks of possible unintended use of personal data and consequences on WFP’s beneficiaries. • Conducting internal consultations with relevant WFP staff, including heads of units, heads of field offices, activity managers, and colleagues working on data protection at the country, regional and headquarters level; • Conducting external consultations with relevant humanitarian agencies and sectors (e.g., UNHCR, UNICEF, UNFPA, UN Women, IOM), technical working groups, government ministries, WFP CPs and Protection Sector and affected people of various gender, age, disability and other diversity. • Engaging in field visits necessary to complete data collection, consultations and focus group discussions for the PIA, including to observe informed consent being obtained from beneficiaries for data collection and registration, with a view to developing informed consent guidance document for partners; • Analysis of data flows, data security, data quality and data subject rights in WFP operations at WFP country and field-office level; • Analysing WFP Nepal current status with respect to implementation of privacy and personal data protection, including issues such as data quality, data subject rights, data security standards, and risk analysis as per the Data Protection Toolkit; • Risk analysis overview and recommendations. • Completing drafting the report including all annexes, consulting relevant colleagues for inputs on the final draft and presenting it to Heads for endorsement of the recommendations.

STANDARD MINIMUM QUALIFICATIONS

Education: Advanced university degree in one of the following disciplines: social sciences, law, humanitarian assistance, data protection and privacy or another field related to international relations, human rights, or political science.

Language: Fluency (level C) in written and spoken English. Working knowledge of other languages spoken in Nepal is desirable.

DESIRED EXPERIENCES FOR ENTRY INTO THE ROLE

• Knowledge of legal frameworks on human rights, data protection and privacy and international humanitarian law. • 3 - 5 years of relevant work experience in the field of protection or legal research; • Solid analytical and writing skills; • Ability to conduct work remotely with little oversight at times; • Team spirit and excellent interpersonal relations. • Experience in digital privacy is desirable • Flexibility to travel to and live in difficult environments;
