Scope of Work

The Legal Consultant is expected to conduct daily routine legal support (operative legal administrative support) as per need and legal review and analyses/clarifications especially focused on:

  • how certain issues related to child rights are regulated in Slovak Republic (e.g. child guardianship, placement of children in alternative care, proceedings related to children victims and witnesses of crime, displacement, refugee status, rights of minorities etc.);
  • on the roles and responsibilities of relevant public actors related to the emergency situations in Slovak Republic, including but not limited to emergency caused by refugee influx caused by the war in Ukraine;
  • on EU legal framework related to above-mentioned child rights issues, especially related to the EU Council Directive 2001/55/EC of 20 July 2001 on minimum standards for giving temporary protection in the event of a mass influx of displaced persons and on measures promoting a balance of efforts between Member States in receiving such persons and bearing the consequences thereof (Temporary Protection);
  • other aspects of the legal framework in Slovak Republic, the European Union and international public law as per need.

The Legal Consultant will be expected to participate in meetings organized or attended by UNICEF Slovakia, to take notes on identified legal issues and to provide clarifications as needed.

A specific workplan will be prepared at the beginning of each month.

Purpose of the Assignment

The purpose of this assignment is to provide legal support, namely - review the existing legal framework and provide clarifications regarding the legislation of Slovak Republic on diverse issues related to children’s rights, including the regulations on refugees and migration.

Individual Contractor's Work Place and Official Travel

The assignment will be based in Bratislava, Slovakia. The Individual Contractor is required to work on a part-time basis for the period of the contract.

Estimated Cost of the Consultancy & Payment Schedule

Payment will be made on submission of a monthly invoice and satisfactory completion of the above-mentioned deliverables. Please indicate an all inclusive fixed monthly fee in EUR to undertake this assignment.

To qualify as an advocate for every child you will have…

  • Advanced university degree in Law or Jurisprudence
  • Passed Bar exam and/or license to practice law before the courts in Slovak Republic would be an asset;
  • Familiarity with the local legislation and international instruments and situation in the field of child rights/child protection and refugees/displaced population;
  • Minimum of 10 years of experience practicing law;
  • Excellent command of English and Slovak languages (writing, speaking, listening)
  • Experience of working with or consulting to the United Nations, affiliated agencies or other international organizations is desirable;
  • Solid experience and/or specialisation in child rights, Family law, human rights law or international public law, as well as experience in legal analysis and report writing and/or in writing policy papers from a child rights’ perspective is highly desirable;
  • Availability of up to 2 days per week;
  • Analytical, research and reporting abilities.

It should be noted that selected candidate will be responsible for arranging for their own health and medical insurance. This consultancy does not provide any other benefits other than the consultancy fee and 1.5 days leave entitlement per month and the UN official holidays. Selected consultant will be responsible for complying with local tax requirements and any tax liabilities that may arise as a result of the consultancy with UNICEF.

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures, and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws.
