PURPOSE OF CONSULTANCY

Carry out a desk review of the relevant legal and regulatory framework including the Law on Healthcare, Law on Communicable Diseases and other systemic laws with a view to assessing the need for any legal adjustments and recommending amendments to ensure functionality of the PHEOC.

BACKGROUND

WHO is implementing an EU funded project concerning the establishment of PHEOC in Montenegro and we are looking for a qualified legal expert to provide legal assistance, review relevant legislation, including recommendations and proposals on legal intervention to support the establishment of the new institution.

To support the development of emergency management activities, WHO CO Montenegro is looking for a qualified Legal Expert to provide legal assistance – review relevant legislation including recommendations and proposals on legal intervention (e.g. Law amendment, adoption of the regulation, etc.) and draft amendments to existing Laws or new legal provisions necessary for a functional PHEOC. Legal recommendations should be closely aligned with the standards and requirements of the health sector. This includes ensuring that the legal framework improves the efficiency and effectiveness of responses to public health emergencies.

DELIVERABLES

  • Action plan with a detailed timetable that includes, inter alia, the methodology/approach to the assignment; (within the 1 week of contract signature).
  • Legal analysis of legislation conducted - with specific practical recommendations for legal and regulatory adjustments to ensure the PHEOC functionality, containing:

a) a diagnostic review of the relevant laws, including but not limited to the Law on Health Care, Law on communicable diseases, and suggested amendments thereto,

(b) the formulation of recommendations regarding the institutional legal framework,

(c) the formulation of amendments to any other relevant laws,

(d) as well as a review of the legal role of the key institutions involved.

  • Minutes from the expert consultations.
  • Submit the final Reports above informed by comments received and finalized in compliance with relevant WHO standards and EU requirements.

QUALIFICATIONS

Educational Qualifications

Essential: Advanced degree in Law (Master’s degree or equivalent).

Experience required

Essential

  • Prior experience in carrying out needs assessments and developing legislative and regulatory frameworks.
  • 10 years of working experience in drafting legal documents.

Desirable

  • Relevant legislative work experience, in the health sector would be an asset.
  • Experience working with government officials, the United Nations, and/or other intergovernmental organizations is a plus.

Understanding of health system functioning and health systemic laws

Expert-level knowledge of the Montenegrin and EU legislation.

Proven expert ability to engage with national stakeholders, provide technical briefings, and support capacity-building projects.

LOCATION

The Consultant is expected to work both:

On site: WHO Country Office, Montenegro, Podgorica AND Off site: Home-based

TRAVEL

The consultant is NOT expected to travel.

REMUNERATION

  1. Remuneration: Daily rate EUR 184
  2. Expected duration of contract: 20 working days, from 25 January until 30 April 2024
