Young people are keen to take control of their lives and engage with and support others. Yet many of them in Albania face uncertainties about their future, as a result of technological change, demographic trends, climate change, discrimination, social exclusion, fake news and populism with yet unknown effects on jobs, skills or the way our democracies work. More than ever, they need to be resilient and able to adapt to these challenges. They should acquire the necessary skills to contribute to prosperous, democratic and cohesive societies. In today's interconnected world, many young people are concerned about global issues such as climate change or peace and security.

Despite the economic development of the country, inequalities persist. Socio-economic and democratic exclusion go hand in hand. Youth struggling with disadvantages are generally less active citizens and have less trust in institutions. Albania cannot afford wasted talent, social exclusion or disengagement among its youth. Young people should not only be architects of their own life, but also contribute to positive change in society. The new Minister of State for Youth and Children has an ambitious plan on youth engagement. The Minister has committed to creating better opportunities for youth and children by working through cross-sectoral alignment towards a better system for youth and children to reflect their aspirations, creativity, and talents.

To support the Ministry of Youth and Children in the noble mission of attaining the highest standards of youth and children rights in Albania, UNICEF is seeking to hire a national consultant, a legal expert who will provide legal advice and support to children and youth legislation framework in Albania.

How can you make a difference?

UNICEF Albania, in a consorted action with the Minister of State for Youth and Children is seeking to hire a national Consultant who will be responsible for supporting the Minister of State for Youth and Children in the area of legal reforms covering children and youth.

The assignment will be conducted by a national consultant in a collaborative effort with other partners including UNICEF, Minister of State for Youth and Children, other line ministries etc. The national consultant will be required to work in the premises of Ministry of Youth and Children.

The national consultant will be responsible to assist in reviewing current youth and children legislation/bylaws, and strategies and prepare legal amendments where necessary.

The national consultant will be responsible for the coordination with other line Ministries on the legal framework on youth and children and propose changes as agreed.

Deliverable 1. A desk review of the national and international legal framework. (November 2021-March 2022)

Tasks:

• Define scope of the legal/policy review
• Desk review of the most important national and international legal frameworks (EU law and policy on children and youth) such as laws, by-laws, DCM, guidelines, ministerial orders and strategies for youth and children.
• Conduct meeting with MOYC, other line Ministries to identify gaps in laws, by laws, circulars etc. which need to be updated to be in line with the new vision of the MOYC.

Deliver a monthly report to UNICEF with regards to the revision of the legal framework on youth and children

Deliverable 2. Provision of legal assistance on law and by laws improvement (March 2022-June 2022)

-Provides Due-diligence of legal procedures in youth and children.

-Provides legal assistance and review to the agencies under the Minister in their process of reformation/ updating their plans etc.

-Provides improved updated by laws, laws, circulars around children and youth as agreed with MOYC.

-Provides legal advice on the compatibility of the national youth strategy (on the make) with the country and International legislation and frameworks.

-Delivers a monthly report to UNICEF with regards to the advancement of her/his work on the above deliverables

Deliverable 3. Proposed legal framework amendments and by-laws related to children and youth (June 2022 - Nov 2022)

Tasks

-Draft the preliminary draft-laws/by laws proposal and share it with the main state actors and UNICEF.

-Finalizes revising from legal perspective youth strategy, action plans for youth, laws for actual reforms to be taken.

-Follows up and analysis of incoming and outgoing legal documents.

- Provides daily assistance on the legal issues to the MOYC

-Delivers a monthly report to and UNICEF regarding the above deliverables.

To qualify as an advocate for every child you will have…

• Excellent language skills in both Albanian and English.
• BA/LLB in Law
• Preferably: Specialized in (LLM/Master’s) in Public Law
• At least 5 years of relevant working experience in domains requiring knowledge of public law/human rights law/other related branches of law
• The candidate should demonstrate strong research skills, have experience in drafting strategies, legislative measures (laws, decision of council of ministers, instructions).
• Very motivated to achieve the work objectives and to work flexibly in a dynamic working environment.
• Able to promote a collaborative spirit and work in team.

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures, and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws.
