Background

UN Women, grounded in the vision of equality enshrined in the Charter of the United Nations, works for the elimination of discrimination against women and girls; the empowerment of women; and the achievement of equality between women and men as partners and beneficiaries of development, human rights, humanitarian action and peace and security. UN Women in Georgia supports state and non-state partners towards the achievement of substantive gender equality in Georgia. In line with national and international commitments, UN Women works on the levels of policy and legislation, institutions, and grassroots, to achieve transformative results for increased gender equality and greater protection of the rights of women and girls.

In September 2019 UN Women Georgia with the generous support of the Government of Norway launched a three-year project “Good Governance for Gender Equality in Georgia (GG4GEG). The project responds directly to gender equality and gender mainstreaming commitments undertaken by the Government of Georgia at the international and national levels and aims to strengthen governance systems for gender equality in Georgia. Within the framework of the GG4GEG project, UN Women provides robust support to

institutional mechanisms of Georgia, namely the Parliamentary Gender Equality Council.

Georgia has made significant strides in promoting gender equality and eliminating violence against women through changes in legislation or policy, including measures to implement the country’s international obligations. However, there are still significant gaps in legislation, policy, and practice that require complex, and continuous work on the part of the State. In this regard, European Union has issued 12 recommendations as a part of Georgia's EU membership application process that Georgia is to implement and report back to EU before the end 2022. One of these 12 recommendations is to "notably consolidate efforts to enhance gender equality and fight violence against women". To fulfil this recommendation, national gender equality mechanisms (Gender Equality Council of the Parliament and Inter-Agency Commission for Gender Equality) have conducted number of meetings with CSOs and development partners and have come up with a draft roadmap of priority issues to be addressed before the end of 2022. This priority list includes revision of Georgia´s Gender Equality Law.

The Gender Equality Law (GEL) of Georgia, adopted in 2010, sets out the fundamental guarantees for equal rights, freedoms, and opportunities for women and men defined by the Constitution of Georgia and depicts the legal mechanisms and conditions for their implementation in the relevant areas of public life. Despite some positive changes introduced in 2018, the GEL needs further revisions to adequately emphasize the importance of gender mainstreaming, it also lacks enforcement mechanisms, hampering the effective implementation of the law and creating a substantial barrier for a) the effective implementation of gender equality goals and gender mainstreaming in practice and b) active coordination between relevant mechanisms/agencies.

UN Women plans to support Parliamentary Gender Equality Council to conduct an in-depth review of the GEL to expand its content, specify the constituent components of the rights listed there, regulate the functions and obligations of the national gender equality mechanisms to ensure their functionality and practicality.

To support this initiative, UN Women will hire a national consultant to provide technical support to revise the GEL and enhance its compliance with Georgia’s current international and national commitments. The overall objective of this consultancy is to develop amendments indicating specific procedures / enforcement mechanisms to ensure effective implementation of the provisions of the Law. The consultant will work under the supervision of UN Women Georgia Country Office and in close coordination with the Parliamentary Gender Equality council and respective stakeholders and will be responsible for the tasks outlined below.

Duties and Responsibilities

The duties and responsibilities of the National Consultant are:

  • Review and analyse relevant international and national legal/policy frameworks, including Georgia’s international and national commitments to gender equality and gender mainstreaming to identify issues / topics to be reflected, further emphasized in the GEL;
  • Review and analyse findings of surveys, of local legislation on gender equality;
  • Hold and participate in workshops, consultation meetings, discussions as required to ensure highly participatory approach to the revision of GEL;
  • Collect, process, and analyse inputs from stakeholders;
  • Develop draft legislative amendments’ package on the Georgia's Gender Equality Law;
  • Develop and present final legislative amendments’ package.

Deliverables:

  • Desk review conducted and detailed workplan submitted to UN Women (5 working days) – by 15 October 2022;
  • Based on the analysis of the desk review and outcomes of the consultation meetings, first draft of legislative amendments package developed and submitted to UN Women (10 working days) – by 20 December 2022;
  • In line with the feedback received from UN Women, Parliamentary Gender Equality Council and other stakeholders’ final legislative amendments’ package revised and submitted to UN Women (5 working days) – by 30 January 2023.

Required Skills and Experience

Education:

  • At least Master’s degree in law, human rights, gender/women’s studies, or related field

Experience:

  • At least 3 years of experience working on issues related to gender, human rights, development issues and the sustainable development agenda
  • At least 2 years of experience in research and analysis, drafting policy documents, assessment reports and alike
  • Familiarity with gender legislation and methodologies will be an asset.
  • Experience in working with governmental stakeholders will be an asset.

Language:

  • Fluency in Georgian and English

Evaluation Procedure:

The candidates will be evaluated in three stages: according to minimum qualification criteria; technical and financial evaluation.

The candidates must possess following minimum qualification criteria to be eligible for further technical evaluation:

  • At least Master’s degree in law, human rights, gender/women’s studies, or related field
  • At least 3 years of experience working on issues related to gender, governance, public administration, human rights and/or development issues.
  • Fluency in Georgian and English

Technical evaluation criteria (including minimum qualifications):

  • At least Master’s degree in law, human rights, gender/women’s studies, or related field (max 80 points)
  • At least 3 years of experience working on issues related to gender, governance, public administration, human rights, development issues and the sustainable development agenda (max 90 points)
  • At least 2 years of experience in research and analysis, drafting policy documents, assessment reports and alike (max 100 points)
  • Familiarity with gender mainstreaming tools (PGA) and methodologies will be an asset (max 30 points)
  • Experience in working with governmental stakeholders will be an asset (max 30 points)
  • Fluency in Georgian and English (max 20 points)

Maximum total technical score amounts to 350 points. Only candidates who have passed over the minimum qualification criteria and have accumulated at least 245 points out of maximum 350 under technical evaluation will qualify for the next stage i.e. evaluation of their financial proposals.

Evaluation of submitted financial offers will be done based on the following formula: S = Fmin / F * 150

S – score received on financial evaluation;

Fmin – the lowest financial offer out of all the submitted offers qualified over the technical evaluation round;

F – financial offer under consideration.

The winning candidate will be the candidate, who has accumulated the highest aggregated score (technical scoring + financial scoring).

Management arrangements:

The contractor will report to and work under direct supervision of UN Women GNP Programme Analyst.

Financial arrangements:

Payment will be disbursed upon submission and approval of deliverables and certification by UN Women Programme Analyst that the services have been satisfactorily performed as specified below:

  • Deliverables 1 - 25 %
  • Deliverable 2, 3 – 75 %
