Background

While the Sri Lanka Police Service (SLPS) has a proud history, over the years its roles, responsibilities and services to the public have been tainted with accusations politicization and militarization. With now over a decade since the Civil War, Sri Lanka policing must transition in the citizen-State relationship and build trust in the police as an institution that protects constitutional rights without discrimination. Greater decentralization, depoliticization and demilitarization of SLPS is essential to facilitate greater accountability, enhanced effectiveness, increased trust and, importantly, to address criminal activity in the country. Over the years, various commissions were established to examine SLPS and make recommendations for improvements. However, subsequent revisions have primarily focused on administrative aspects, with little or no changes made for holistic reform to SLPS or its institutional, legal, policy and operational areas that would enhance community trust in its services.

Against this backdrop, UNODC, as the lead United Nations agency in supporting Member States to strengthen their law enforcement institutions, to assist the government to initiate overall reform of SLPS. This position will be located within the UNODC Programme Office for Sri Lanka. The incumbent will work under the direct supervision of the Head of Office a.i., Programme Offices for Sri Lanka and the Maldives.

SCOPE OF WORK

The National Consultant is expected to work in close partnership with the international Consultant in:

  1. Identify areas to strengthen within institutional, legal, policy, operational and administrative; thus, providing the solid foundation necessary to transition Sri Lanka Police from military to service orientation.
  2. Review the human resource management processes and identify areas where changes can be introduced to ensure inclusive and representational Police service.
  3. Review the current training curricula and training needs.

Duties and Responsibilities

EXPECTED OUTPUTS AND DELIVERABLES

The consultant will be responsible for:

  • Assist the international consultant to review of the Sri Lanka Police structure covering its institutional, legal, policy, operational and administrative areas. Identification of gaps and potential interventions based on the findings to be included.
  • Assist the international consultant review of the Police curriculum and academic training structure. Review to identify best practices, challenges/ gaps and potential UNODC interventions based on the findings.
  • Assist the design and development of the draft strategic plan of action
  • Coordinate with relevant stakeholders and conduct consultations together with the international consultant in order to validate the findings of the above reviews
  • Support revising of the draft review reports and the plan of action as needed.

Output / Estimated Duration to Complete / Target due dates

1) Review of the Sri Lanka Police structure covering its institutional, legal, policy, operational and administrative areas. Review to include international best practices as examples. Identification of gaps and potential UNODC interventions based on the findings to be included - 4 Weeks - April 2021

2) Review of the Police curriculum and academic training structure. Review to identify challenges/ gaps and potential UNODC interventions based on the findings - 4 Weeks - May 2021

3) Develop a draft strategic plan of action - 2 Weeks - May 2021

4) Conduct validation consultations with relevant stakeholders and refine the draft review reports and the plan of action accordingly - 3 Weeks - June 2021

5) Submit finalised review report and strategic plan of action - 1 Week - June/ July 2021

TIMEFRAME

The period of the assignment will be for 5 months starting from 1 March 2021.

Competencies

  • Excellent knowledge of international practices in police ethical behavior, use of force, standard operating procedures, communication, and police work assessments is required.
  • Working experience in law enforcement and the rule of law is required.
  • Proven experience in providing technical advice, including development of training curricula and conducting training is required.
  • Extensive experience in policy level analysis is required.
  • Ability to interact with governmental agencies and other relevant stakeholders to operate effectively; establish and maintain effective partnerships and harmonious working relations is essential.
  • Good interpersonal skills are required.
  • Ability to access the main sources of information is required
  • Strong writing skills are required.
  • Ability to operate effectively in a multi-cultural, multi-ethnic environment with sensitivity and respect for diversity and gender is essential.
  • Familiarity with the United Nations system and procedures is desirable.

Required Skills and Experience

Education:

An advanced university degree (Master’s degree or equivalent) in law, public administration, business administration, criminology or related areas is required. University education may be substituted by extensive relevant experience.

Experience:

Minimum of 10 years’ experience in working with law enforcement agencies in the areas of police oversight, training, and intelligence.

Language:

Strong oral and written communication skills in English. Fluency in one of the local languages (Sinhala/Tamil) is required.

Annex I – Offeror’s Letter to UNDP Confirming Interest and Availability for the Individual IC, including Financial Proposal Template

FINANCIAL PROPOSAL

All Inclusive Lump Sum Fee: LKR (___________)

Please use the Annex 2 of the Offerors Letter to UNDP Confirming Interest and Availability to furnish the financial proposal.

Note: Payments will be based on invoices on achievement of agreed milestones i.e. upon delivery of the services specified in the TOR and certification of acceptance by the UNDP. The applicant must factor in all possible costs in his/her “All Inclusive Lump Sum Fee” financial proposal including his/her consultancy and professional fee, honorarium, communication cost such as telephone/internet usage, printing cost, return travel from home to office, ad-hoc costs, stationery costs, and any other foreseeable costs in this exercise. No costs other than what has been indicated in the financial proposal will be paid or reimbursed to the consultant. The UNDP will only pay for any unplanned travel that deemed necessary to carry out the work of the TOR outside the duty station on actual basis and on submission of original bills/invoices and on prior agreement with UNDP officials. Daily per diems and costs for accommodation/meals/incidental expenses for such travel shall not exceed established local UNDP DSA rates.

For an Individual Contractor who is of 65 years of age or older, and on an assignment requiring travel, be it for the purpose of arriving at the duty station or as an integral duty required under the TOR, a full medical examination and statement of fitness to work must be provided. Such medical examination costs must be factored into the financial proposal above. Medical examination is not a requirement for individuals on RLA contracts.

EVALUATION CRITERIA

Individual consultants will be evaluated based on the cumulative analysis method. The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as being: 1) Responsive/compliant/acceptable; and 2)Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation. Technical evaluation (70%) and financial criteria (30%) will be applied. Financial score shall be computed as a ratio of the proposal being evaluated and the lowest priced proposal received for the assignment.

PAYMENT FOR SERVICES

Payments will be based on deliverables certified by the Head of Office, a.i. The Consultant shall receive payments as monthly instalments (05) upon the submission of the progress made on the expected outputs/deliverables, specified under section “C” above and relevant invoices.
