Background:

The OSCE Programme Office in Dushanbe (POiD) together with the Office of the Co-ordinator of Economic and Environmental Activities (OCEEA), in close collaboration with the Ministry of Labour, Employment and Migration of the Republic of Tajikistan (MoL), will support Tajikistan in assessing the effectiveness of labour migration policies in the country. The project intends to provide the Ministry of Labour of Tajikistan with a solid knowledge base to orient national labour migration policies and maximize their impact on development.

Tajikistan is increasingly faced with challenges related to the effective management of labour migration. According to various sources (MPI; UN; IOM), the Tajik migration outlook has turned from a country of internally displaced persons and refugees to one of the largest regional exporters of labour. However, this qualitative and quantitative transformation of migration flows has not matched fully with an adequate shift in the national labour migration policies.

To this end, the project will analyze strengths and weaknesses of the current policy framework and will suggest measures to expand the positive impact and reduce unwitting counterproductive effects. Within the project, a Working Group consisting of International and National consultants/experts will develop a set of methodological tools that will allow the Tajik government to assess periodically how the overall migration policy framework is fit to achieve the objectives and priorities set by the State authorities.

This overall process – referred to as “Fitness Check” - will result in an overall baseline assessment that can orient migration policy choices, including the National Strategy on Labour Migration, and measure progresses in the policy framework against the evolving economic and social context.

Objective of Assignment: The POiD intends to hire a National Consultant as a member of the project’s Working Group to carry out a review of labour migration policies and practices in Tajikistan.

Duration of Assignment: 4 months.

Tasks and Responsibilities: Under the supervision of the Economic Officer at the POiD, and a part of the Working Group, the consultant will perform the following tasks:

  1. Setting up methodological tools: support the working group in refining the methodological note and identifying the most suitable tools to collect the necessary data to perform the assessment;
  2. Contextual analysis – contribute in analysing the Tajik migration policy context throughout the migration cycle - pre-departure, transfer, work experience abroad, return and its current implementation (laws, regulations, international labour agreements, migration services) through collection, systematization and analysis of existing documentation, data and reports. To this end, act as a liaison between the working group and other ministries and experts at national level, as necessary.
  3. Evidence gathering – assist in carrying out consultations with relevant stakeholders, i.e. State authorities, private sector, civil society including migrants, to assess positive aspects as well as weaknesses of the current implementation of policies and services throughout the migration cycle - pre-departure, transfer, work experience abroad, return.. The consultation will also touch upon emerging needs, obstacles, gaps and opportunities for improvement. To this end, assist in identifying key stakeholders and keep information flowing with relevant State authorities, in particular with the Ministry of Labour, Migration and Employment;
  4. Checking the fitness of existing baseline against government objectives: assist in carrying out an in-depth consultation with State authorities, in particular with the Ministry of Labour, Migration and Employment, with the aim of provision of concrete suggestions towards improvement and inclusion of changes in relevant legal acts and development of project of laws. To this end, assist in ensuring constant coordination and consultation with key State authorities.

Deliverables:

  • Report of the Analysis of legal support of migration policy in the Republic of Tajikistan (after performing all the tasks under contextual analysis);
  • Consultation Report – Stakeholder Analysis (with detailed documentation of performed interviews etc.) and Draft normative legal acts to improve the legal regulation of the sphere of migration.

Necessary Qualifications:

  • University degree in Law, Social Science, Political Science, Statistics or Economics;
  • Minimum 5 years of experience in jurisprudence;
  • Experience in the analysis of legislation and development of draft regulations;
  • Fluency in Tajik, Russian. Knowledge of English would be an asset.

Remuneration Package:

Remuneration will be based on the selected consultant's/expert's qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
