Background

The Revitalized Agreement on the Resolution of the Conflict in the Republic of South Sudan (R-ARCSS) signed in September 2018 has included Transitional Justice, Accountability Reconciliation, and Healing as one of its main chapters. The agreement called for the establishment of three transitional justice institutions; namely; the Commission for Truth, Reconciliation, and Healing (CTRH); An Independent Hybrid Judicial body, to be known as the Hybrid Court for South Sudan (HCSS); and Compensation and Reparation Authority (CRA).

The Inter-Governmental Authority for Development (IGAD) in a partnership with UNWOMEN South Sudan will assist the Revitalized Transitional Government National of Unity (RTGNOU) to integrate gender in the planned Transitional Justice (TJ) mechanisms and systems as stipulated in the agreement in Chapter 5, through support to a study that will assist in understanding the TJ structures in place, reflect the best practices and provide recommendations that will promote a gender transformative approach to TJ, where gender equality is both a goal of TJ; and part of the process within TJ mechanisms.

Duties and Responsibilities

Under the supervision of UN Women Deputy Country Representative and the guidance of the Programme Officer of UNWOMEN South Sudan and the Senior Gender Advisor of IGAD in collaboration with the Senior Transitional Justice Advisor of IGAD, the consultant will:

1. Undertake desk review and mapping of existing materials pertaining to the intersection of the TJ and gender in South Sudan;

2. Plan and facilitate individual, small group interviews and a virtual consultation with IGAD Senior Transitional Justice and others;

3. Develop a practice-oriented study that examines the role that women, women’s organizations, and survivors of human rights violations and SGBV in leadership and decision making on TJ including by:

  • Setting out the national, regional, and international normative framework for women’s meaningful participation in TJ processes;
  • Examining how women's participation and leadership contributes to placing women’s priorities and needs at the center of the TJ process and ultimately, to the transformation of gender inequality;
  • Presents a select number of examples of the impact of women’s leadership and participation on TJ processes and their outcomes, with a focus on examples that highlight good practice and lessons learned from other countries;
  • Engage with the National Taskforce on Inclusion of Refugees and IDPs in the implementation of the R-ARCSS to inform reform in transitional justice and durable solutions.

4. Come up with concrete recommendations on how women and girls can meaningfully and actively participate in the TJ processes by being part of the TJ mechanisms as well as by engaging with the mechanisms. The recommendation should take into account the lived realities, the current socio-economic situation of women in the society, and the place of women in SS communities. How to mainstream and integrate gender issues in the TJ process and mechanisms should also be part and parcel of the consultant's work.

Required Skills and Experience

Experience:

  • At least 5 years of experience in research, work on issues of women’s rights and women, peace and security is required;
  • Experience in conducting and publishing research documents and policy brief is required;
  • Experience working on research on transitional/access to justice issues on women is an asset;
  • Experience in regional organizations or international organizations is an asset;
  • Knowledge of national, regional, international human rights standards and principles and the ability to apply to strategic and/or practical situations is an asset;
  • Excellent drafting and editing skills and the ability to produce a final quality report is an asset.

Language:

  • Fluency in written and spoken English is required;
  • Knowledge of the major South Sudanese local languages.
