Background:

In line with its Economic development initiatives portfolio for 2022 and the priorities of the host country in improving the investment climate and promotion of the investment opportunities of Tajikistan, the OSCE Programme Office in Dushanbe (POiD) plans to support the State Committee on Investment and State Property Management (Committee)of the Republic of Tajikistan in review and assessment of the current investment related legislation to identify key findings for further its possible modernisation with aim to enhance promotion of the investment potential and opportunities in the country.

To support the State Committee on Investment and State Property Management of the Republic of Tajikistan in review and assessment of the current legislation on investment activities, the OSCE Programme Office in Dushanbe will involve a National Consultant, who will work in close cooperation with the international consultant, Committee and other relevant institutions to accomplish this activity with outlined key finding on modernisation of the current legislation on investment activities and to identify key findings for compliance of the legislation with current needs of the sector.

Objective of Assignment:

The assessment and review of the legislation relevant to the investment activities in Tajikistan requires comprehensive approach in gathering and analysing legislative documents and data, as well as international expertise in assessment of such documents. Therefore, the Office plans to hire a National Consultant in close cooperation with an International Consultant to conduct the review and assessment of the legislation of Tajikistan on investment activities and identify key finding on directions for further modernisation of the legislation.

Duration of Assignment: 2 months.

Tasks and Responsibilities: Under the supervision of the Economic Officer and International expert, the consultant will perform the following tasks:

  1. Jointly with the international consultant study international experience regarding legislation in the field of investment and its modernization;
  2. Development of a review of international experience and experience on the concept of "investment" and its structure;
  3. Development of the matrix/table on the legislative conditions of other countries in regards to regulation of relations with investors through electronic technologies;
  4. Identify key findings on further modernization of the current legislation on investment activities;
  5. Development of a draft regulatory legal acts on the introduction of amendments and additions to the Law of the Republic of Tajikistan "On Investments";
  6. Development of the detailed and step by step structural process on implementation of key findings on modernization of the legislation on conduction of investment activities in Tajikistan;
  7. Coordinate and communicate the implementation process of the assignment with the POiD, international consultant and the Committee;
  8. Taking into consideration above set tasks, produce a comprehensive report on the conducted evaluation and assessment of the current legislation.

Deliverables:

  • A draft regulatory legal act was developed to introduce amendments and additions to the Law of the Republic of Tajikistan “On Investments”;
  • A draft matrix/table on the legislative conditions of other countries in regards to regulation of relations with investors through electronic technologies is developed;
  • The current legislation is reviewed and assessed, key findings on further modernization of the current legislation on investment activities are identified;
  • A detailed and step by step structural process on implementation of key findings on modernization of the legislation on conduction of investment activities in Tajikistan is developed;
  • Detailed report on the reviewed and assessed legislation is developed and submitted to the State Committee on Investment and State Property Management.

Necessary Qualifications:

  • University degree in management, economics or equivalent;
  • Minimum 5 years of professional experience in the field of Investment promotion, development of policy, regulations and guiding documents on investment promotion, entrepreneurship and business processes;
  • Knowledge of legislation and policies in the field of investment promotions and entrepreneurship. Knowledge of the policy and legislation of the Central Asian countries in the field of investment promotion and entrepreneurship opportunities is an asset;
  • Ability to apply analytical methods and data collection, including empirical analysis and gap analysis;
  • Professional fluency in English, Russian and Tajik languages, both oral and written;
  • Available to travel within Tajikistan.

Remuneration Package:

Remuneration will be based on the selected consultant's/expert's qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
