Mid-term review of the 2020-2024 Joint Programme of the United Nations Team of Experts on the Rule of Law and Sexual Violence in Conflict

Result of Service The mid-term review of the joint programme will cover the period from January 2020 through June 2022 and will entail an analysis and recommendations on the following topics in relation to the goals and objectives of the joint programme:

Strategic Approach: What features, characteristics, and approaches have shaped the Team of Experts’ work in operationalizing its Security Council mandate? What vision and priorities have shaped the Team of Experts’ actions? Have these been adequate and effective in delivering on its mandate? Have the objectives under the five years joint programme been adequate? Do the objectives need to be reviewed ? What innovative ideas and approaches have been utilized by the Team of Experts in addressing sexual violence? What factors within and outside the UN have affected the Team of Experts’ approach?

Impact: Within the existing UN structure and broader global trends, what has been the contribution of the Team of Experts at international, regional and national levels to prevent and respond to sexual violence in a sustainable manner, specifically in the areas of rule of law, justice and security? Drawing from concrete engagements, has the Team of Experts’ expert technical, financial, operational, and strategic support been relevant and responsive to the needs and priorities of Member States in addressing sexual violence? Has the Team of Experts delivered on the objectives included in the joint programme?

Coordination and Partnership: To what extent has the Team of Experts promoted coordination, cooperation, and partnership at the international, regional, and national levels with Member States, within the UN system, with regional bodies, and with other relevant actors at headquarters and the field?

Organizational Arrangements and Resources: How has the structure, size and composition of the Team of Experts shaped its work? Has the structure, size and composition of the Team of Experts been adequate to deliver on its mandate, objectives and demands from member states? How has the Security Council mandate’s call for use of existing human resources and voluntary contributions shaped the work of the Team of Experts? How do these factors impact on the effectiveness of the Team?

To conduct the assessment/review, the successful individual will:

1. Participate in conference calls and meetings with the Team of Experts regarding the scope of work, timeline, and expectations for the report. 2. Conduct a desk review of relevant materials; 3. Develop a draft annotated outline for the report, based on the terms of reference; 4. Discuss the work of the Team of Experts with members of the Team of Experts, co-lead entities, Member States, donors, beneficiaries, and other relevant interlocutors; 5. Conduct headquarters and field-based interviews in person/virtually; 6. Prepare and share a draft of the report for discussion with the Team of Experts; 7. Submit the final report to the Team of Experts; and 8. Present the final report to co-lead entities, Member States and other relevant interlocutors in New York.

Duties and Responsibilities The United Nations (UN) Team of Experts on the Rule of Law and Sexual Violence in Conflict (Team of Experts) was created by Security Council resolution 1888 (2009) to assist national authorities in strengthening the rule of law with the aim of ensuring criminal accountability for perpetrators of conflict-related sexual violence. This resolution recognizes that conflict-related sexual violence is a threat to international peace and security, and that Member States affected by conflict need assistance to address impunity in order to prevent and deter future violations.

The Team of Experts is based at the UN Headquarters in New York and deploys regularly to some of the world’s most challenging contexts. It has a unique “co-lead” structure that includes members from several UN entities to enable the UN to deliver as one in assisting Members States to address conflict-related sexual violence. The Team of Experts is led by a Team Leader who reports to the Special Representative of the Secretary-General on Sexual Violence in Conflict (SRSG-SVC), and currently comprises experts from the Department of Peace Operations (DPO), the Office of the United Nations High Commissioner for Human Rights (OHCHR), the Office of the SRSG-SVC, and the United Nations Development Programme (UNDP), who each report to both the Team Leader and their respective entities.

Within the broader objective of strengthening the rule of law with respect to conflict-related sexual violence and in line with its Security Council mandate, the Team of Experts: (i) works closely with national legal and judicial officials and other personnel in the relevant governments’ civilian and military justice systems to address impunity, including by strengthening national capacity and drawing attention to the full range of justice mechanisms to be considered; (ii) identifies gaps in national response and encourages a holistic national approach in addressing conflict-related sexual violence, including by enhancing criminal accountability, judicial capacity and responsiveness to victims (such as reparations mechanisms); (iii) makes recommendations to coordinate domestic and international efforts and resources to reinforce governments’ ability to address conflict-related sexual violence; and (iv) acts in conjunction with a variety of UN mechanisms towards the full implementation of among other resolutions 1820 (2008), 1888 (2009), 1960 (2010), 2106 (2013), and 2467 (2019).

Objectives of the Review

Since January 2020, the Team of Experts has been operating under a five-year joint programme (January 2020 - December 2024) developed in coordination with DPO, OHCHR, the Office of the SRSG-SVC, and UNDP. The Team of Experts is seeking an individual to undertake a mid-term review of the work of the Team of Experts under the joint programme and produce a report.

The purpose of the mid-term review of the joint programme is to assess the effectiveness of the Team of Experts as a tool at the disposal of the UN system and Member States to assist national authorities in ensuring accountability for conflict-related sexual violence by identifying gaps, encouraging holistic responses, enhancing coordination, drawing attention to the full range of justice mechanisms, and supporting capacity building efforts. This includes evaluating the effectiveness of the joint programme as defined to deliver on the mandate, the Team of Experts’ ability to deliver on the joint programme objectives, and the need to review the joint programme assumptions and objectives regarding emerging demands.

NOTE: - The successful individual will receive lump sum fee of $27,000. - The round-trip economy class tickets will be provided from the home country to New York, as well as DSA for each day worked in New York based on the current UN rate. - Payment will be made upon completion of the consultancy.

Qualifications/special skills Advanced university degree (Master's degree or equivalent) in law, political science, international relations, or related field. A minimum of 10 years of professional work experience at the international level providing policy advice and programmatic support in human rights, rule of law, justice and gender-related issues Experience providing rule of law assistance in a conflict or post-conflict setting; reviewing projects and programs and undertaking monitoring & evaluation; Experience integrating conflict-related sexual violence considerations in UN polices, planning, operations and training; Familiarity with various entities engaged in the rule of law within the UN system, particularly DPO, OHCHR, Office of the SRSG-SVC, and UNDP; Excellent writing, analytical and presentation skills; and ability to meet tight deadlines
