  1. Background and rationale

The HIV situation in the country can be described as hidden and growing. Based on the HIV/AIDS & ART Registry of the Philippines (HARP) published by the Epidemiology Bureau of the Department of Health (DOH-EB) in February 20211, the number of HIV-positive reported cases in the country has reached a total of 84,610 since January 1984. Additionally, for the month of February 2021, 855 newly diagnosed cases were recorded.??

While the national HIV prevalence remains low at around 0.1%2, men having sex with men are disproportionately affected, accounting for 83% of all new infections. As before, newly diagnosed cases are mostly concentrated in the National Capital Region or Metro Manila, having the highest proportion of newly diagnosed cases in February 2021 among all the 17 regions in the country at 31%.?

The Philippines is also far from reaching the 95-95-95 targets of UNAIDS3. Among the estimated 97,000 people living with HIV in the Philippines, only around 73% are diagnosed. Among those diagnosed, only around 61% are enrolled to treatment. Viral load suppression remains, reaching only 28%, compared to the 95% target.?

Generally, the policies and programs implemented in the country are in line with the Republic Act (RA) 11166 or the Philippine HIV and AIDS Policy Act of 2018, which repealed RA 8504 also known as the Philippine AIDS Prevention and Control Act of 1998 and made health services for HIV more accessible to Filipinos. Various activities on prevention and control, treatment,?care?and support, including advocacy, training and other management costs were implemented in the previous years.??

In 2018 and 2019, UNDP supported and organized workshops on the development of Local Investment Plans for HIV with several LGUs across the Philippines. These areas include Angeles City,?Dasmariñas?City,?Mabalacat, Puerto?Princesa?City, Iloilo City, Bacolod City,?Danao?City,?Minglanilla, Toledo City, Zamboanga City, Davao City, Manila City, Quezon City, Caloocan City, Las?Piñas?City, Makati City, Malabon City, Mandaluyong City,?Marikina City, Muntinlupa City,?Navotas?City,?Parañaque?City, Pasay City, Pasig City, San Juan City, Taguig City, Valenzuela City, Pateros, Bacoor, Imus, Sta. Rosa, San Pablo, and?Biñan.?

With the physical distancing measures currently in place in the Philippines and uncertainties brought about by the COVID-19 pandemic, UNDP, in collaboration with UNAIDS?started to?develop massive open on-line courses on HIV and LGBTQI?in 2020. The initiative includes?at least?five?courses across three areas.??

Massive Open On-line Courses?

Massive Open On-line Courses or MOOCs are on-line courses aimed at unlimited participation and open access via the web. In addition to traditional course materials, such as filmed lectures, readings, and problem sets, many MOOCs provide interactive courses with user forums or social media discussions to support community interactions.?

MOOCs also offer adaptive learning methods amid the COVID-19 pandemic. Moreover, they improve access to classes, educational workshops, and seminars by providing an affordable alternative to residential learning and offering a flexible learning schedule. MOOCs help achieve the Sustainable Development Goals (SDGs) including SDG 4, by promoting inclusive and equitable quality education and lifelong learning opportunities for all.?

Course Descriptions??

Local AIDS Ordinances

This MOOC offers an overview of the contents of the 2018 Philippine HIV and AIDS Policy Act; a discussion on the role of Local Government Units in the implementation of the law; the significance of having Local AIDS Ordinance and Local AIDS Councils; and an orientation on the salient features of a Local AIDS Ordinance and the suggested minimum provisions to achieve its purpose. The main objective of this course is for the participants to create a local AIDS Ordinance based on locality’s needs and circumstances

SOGIESC-inclusive Anti-discrimination Ordinance

This MOOC offers an overview of the current situation of LGBTQI Filipinos in relation to their access to legal remedies; an introduction to the concept of human rights and its relevance in the discussion of LGBTQI rights; and an orientation on what an Anti-Discrimination Ordinance seeks to achieve and the proposed minimum provisions to achieve such purpose. Using a review of existing anti-discrimination ordinances highlighting their strengths and weaknesses, learners will be able to craft their own anti-discrimination ordinance suitable to their locality’s needs and circumstances.

UNDP requires the service of HIV Law expert who will provide technical assistance in reviewing the output of LGUs and guide the participants on finalizing their HIV local ordinances and LGBTQI Anti-discrimination ordinances to ensure their quality.

Duties and Responsibilities

  1. Scope of Work

To ensure successful implementation of the project, it is proposed that a Technical Reviewer be engaged as an Individual Contractor (IC) with the following scope of work:

  1. Review the draft HIV local AIDS ordinances and LGBTQI anti-discrimination ordinances of seventeen (17) LGUs in NCR and provide technical comments on how to improve their outputs and recommend areas for improvement, including how to ensure citizen participation and monitoring.
  2. To coordinate with partner Firm on how to navigate the MOOC as the participants need to revise their assignments in the system.

The IC will work with the Programme Analyst and HIV Response Officer (UNDP Philippines Institutions and Partnerships Team) with guidance from the Institutions and Partnerships Programme Team Leader, UNDP Bangkok Regional Hub HIV, Health and Development Team, DOH and UNAIDS.

  1. Institutional Arrangements

  2. The Individual Consultant will work under the overall guidance of the Programme Team Leader and close coordination with the Programme Analyst and HIV Response Officer of the Institutions and Partnerships Programme Team.

  3. UNDP shall provide comments and provide inputs within 5 working days upon receipt of output.
  4. UNDP Philippines shall be entitled to intellectual property and other proprietary rights over all materials that have direct relation to the project.
  5. Considering the COVID-19 pandemic and declaration of State of Public Health Emergency in the Philippines, all work of the Individual Consultant shall be done within the guidelines and protocols set by the local and national government.
  6. Following IATF Quarantine Restrictions, this consultancy shall be performed remotely and will be a home-based assignment. Coordination/meetings shall be done through phone or online communication.
  7. The Individual Consultant is expected to have his/her own equipment and workstation.

  8. Duration of Work

The Individual Consultant will be engaged 30 working days spread over 4 months unless revised in a mutually agreed upon timetable between the Consultant and UNDP. Changes in the duration of the contract will be implemented through issuance of a contract amendment.

  1. Scope of Price Proposal and Schedule of Payments

  2. The Contractor should send the financial proposal based on a lump-sum amount for the delivery of the outputs identified below. The total amount quoted shall be “all inclusive” (professional daily fees X number of days, communications, etc.) that could possibly be incurred by the Contractor should be factored into the final amount submitted in the proposal. Travel, as deemed relevant by UNDP and compliant with government guidelines on community quarantine, will be arranged and paid for by UNDP and should not be included in the financial proposal.

  3. Medical/health insurance must be purchased by the individual at his/her own expense, and upon award of contract, the Contractor must be ready to submit proof of insurance valid during contract duration
  4. The contract price will be fixed output-based price. Any deviations from the output and timeline will be agreed upon between the Contractor and UNDP.
  5. Payments will be done upon satisfactory completion of the delivery by target due dates. Outputs will be certified by the Programme Analyst of Institutions and Partnerships prior to release of payments.

  1. Criteria for Selection of the Best Offer

The Offers received will be evaluated using a combined scoring method - where technical proposal will be weighted 70 points and combined with the price offer which will be weighted 30 points.

The CV will be reviewed using the criteria in the table below. Only offerors who will obtain a minimum of 70% or 49 out of 70 obtainable points will be shortlisted and considered for evaluation of financial proposal.

If an Offeror is employed by an organization/company/institution, and he/she expects his/her employer to charge a management fee in the process of releasing him/her to UNDP under Reimbursable Loan Agreement (RLA), the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to UNDP.
