UNICEF has been an active partner of the Government of the Philippines and civil society in realizing the rights of every Filipino child, in line with priorities to achieve the Millennium Development Goals. UNICEF efforts have been focused on the most vulnerable regions identified by the Government of the Philippines Development Plan, particularly in the regions of Visayas and Mindanao. To ensure that interventions are sustainable and scaled up, UNICEF will support primarily local government units (LGUs) as the main instruments of delivering services and building systems. The level of engagement with government institutions will take into account capacities, economies of scale and sector issues.

It has a field office in Cotabato City, the second largest city in Mindanao, southern Philippines, with some 300,000 population. The city is the regional administrative centre of the Autonomous Region of Muslim Mindanao and over 80 percent of the population is Muslim. Mindanao is both conflict-affected and prone to frequent earthquakes and typhoon storms.

How can you make a difference?

BACKGROUND

UNICEF is seeking the services of a Legal Consultant to support the preparations for the project with the Provincial Government of Samar. The project aims to demonstrate the use of leveraging public funds with market-based financing in delivering climate resilient sanitation facilities to 150 vulnerable families in the province of Samar. Implementing the project - “Household Sanitation using Blended Financing with Output-based Aid” in the province of Samar will contribute to setting up the systems for the province to adopt the modality, and also aid in national policy development, establishing evidence on the effectiveness and efficiency of such financing modality, and documenting good practices for other local governments to emulate.

To formalize the partnership among the micro finance institutions local government units of the Province of Samar, a memorandum of agreement (MOA) and a project implementation guideline is currently being drafted and will be circulated for review.

TERMS OF REFERENCE OR WORK ASSIGNMENT

Tasks:

  1. Coordinate with the respective legal offices of the the following project stakeholders in the reivew of the MOA and implementation guidelines:
  • Provincial government of Samar
  • Municipal governments of Basey, Jiabong and Paranas
  • ASA Philippines
  • Life Bank Microfinance Foundation Inc
  • Negros Women for Tomorrow’s Foundation
  1. Desk review of relevant legislation, policies and application of blended financing with output-based aid approach
  2. Review and revise the MOA and implementation guidelines to ensure that it is in line with government regulations and procedures, and based on feedback from respective project stakeholders.
