Org. Setting and Reporting

The Legal Officer (Intake and Investigation) manages the intake of complaints and undertakes investigations into alleged violations of ITC regulations, rules and relevant administrative instructions, such as but not limited to, fraud, theft and embezzlement, corruption, sexual exploitation and sexual abuse, abuse of privileges and immunities or of authority, workplace harassment, bullying, whistle-blower retaliation or other acts of omissions in conflict with the general obligations of ITC personnel.

Responsibilities

Under the supervision and direction of the Executive Director of ITC, the incumbent, will be responsible for the following duties:

  1. Manage the Intake function by acting as the receiving point of allegations and complaints across all ITC personnel and outside ITC, liaising with complainants when needed and providing advice to the Executive Director regarding such cases for management decision and/or investigations.
  2. More specifically, the incumbent shall receive complaints into alleged violations of ITC regulations, rules and relevant administrative instructions, such as but not limited to, fraud, theft and embezzlement, corruption, sexual exploitation and sexual abuse, abuse of privileges and immunities or of authority, workplace harassment, bullying, whistle-blower retaliation or other acts of omissions in conflict with the general obligations of ITC personnel.
  3. The incumbent shall make preliminary assessments of the complaints, and provide advice based on ITC policies, past experience and case law on next steps for the decision of the Executive Director. Such advice may include conducting an internal investigation, an external investigation usually through OIOS, and advice on a management decision by the Executive Director before or after an internal or external investigation.
  4. If authorized by the Executive Director, undertake internal investigations, which includes: • Planning and conducting investigations to ensure that all appropriate lines of inquiry are identified, and investigation resources are used effectively and efficiently to factually determine the issues relevant to an investigation; • Collecting and managing of evidence; • Investigating complex cases by conducting in-depth review, including but not limited to the forensic review of electronic evidence, open-source research and the examination of internal databases and other internally and externally managed records; • Conducting investigative interviews of subjects and witnesses as required and in accordance with generally accepted best practice and procedures, and preparing witness statements of the interviews; • Preparing objective and factual investigation reports and other written products as required; • Undertaking duty travel as required.
  5. Manage, coordinate and oversee the liaison and responses on all matters concerning the above, to and from UN entities of related functions, including but not limited to the UN Tribunal, OSLA and OIOS
  6. Liaise with the Legal Office of ITC with regard to the implementation of decisions on disciplinary actions on ITC personnel.
  7. Ensure an open communication channel is maintained with all personnel, not only on awareness, but on updates around individual cases with individuals, and through an annual report on all cases reviewed along with the relevant statistics, to be made publicly available.
  8. Ensure that all progress is tracked and managed in a case management system, and well documented and kept confidentially on file.
  9. The incumbent shall together with the ITC Executive Director, participate in periodic donor briefing sessions and be responsible for providing up-to-date statistics to donors and ITC management.
  10. The incumbent shall oversee the evaluation of cases according to risk analysis, cost, duration and other criteria.
  11. Perform such other duties as may be assigned.

Education

Advanced university degree (Master's degree or equivalent) in Law or a related field. Note: A first level university degree in Law or a related field may be considered with an additional two years of qualifying experience.

Work Experience

A minimum of five (5) years of experience in planning, leading and executing investigations and preliminary assessments is required.

Experience in managing and conducting digital forensic examinations within an administrative and/or criminal investigation context is desirable.

Experience working in a legal capacity within an investigations or compliance function is desirable.

Languages

For the position advertised, fluency in English is required. Knowledge of another official United Nations language is an advantage.

Assessment

Evaluation of qualified candidates may include an assessment exercise which will be followed by competency-based interview.
