Background: Under the OSCE Presence in Albania (hereinafter the Presence) Extra-budgetary Project “Strengthening Albania’s law-enforcement and prosecution capacities and multi-agency co-operation in combatting trafficking in human beings”, funded by the Governments of Norway and the United Kingdom of Great Britain and Northern Ireland, the Presence aims to support Albania’s efforts to strengthen the investigation, disruption and prosecution of all forms of human trafficking in Albania, as well as to enhance the prompt identification of victims by law-enforcement agencies. The project will address the legislation and operational framework for the investigation and prosecution of human trafficking offences in Albania through tackling the capacities, criminal justice co-operation and capability to disrupt and prosecute offenders’ activities, relevant guidance to investigate and prosecute trafficking in human beings (THB). In its first phase, the project will start with a Scoping Study that will analyse the THB trends, starting from traditional patterns such as irregular migration that creates vulnerabilities leading to THB, to new challenges like technology-facilitated THB. The Scoping Study will analyse the law enforcement and prosecution’s ability to investigate and prosecute cases, institutional efforts and infrastructure for THB data collection in order to identify gaps and provide recommendations on necessary interventions to improve the law enforcement and criminal justice co-operation and capability to disrupt and prosecute offenders. It will be conducted in close communication with the law-enforcement agencies, prosecutors, judges, services providers and trafficking victims advisory board to ensure their feedback, common understanding of the challenges and jointly develop recommendations.

Objective of Assignment:

For this purpose, the OSCE Presence will engage a team of international and national experts to conduct a consultative Scoping Study including stakeholder analysis and assessment of the legislation, political economy, policies, and resources employed for the investigation and prosecution of THB offences in Albania.

Duration of Assignment:

The expert will be working during the period of 10 December 2022 – 20 March 2023.

Tasks and Responsibilities:

Under the supervision and in coordination with the Presence National Anti-Trafficking Officer and in collaboration with the international anti-trafficking expert and other experts, the international expert on prosecution will:

1. Participate in the methodology for the Scoping Study on the aspects of the prosecution of human trafficking offences. Based on the methodology proposed by the lead expert, the expert on prosecution will contribute with inputs to the methodology in order to analyse the problem in the prosecution of THB cases in Albania. The methodology will include the approach in analysing the legislation and practice, through desk research of legislation and multi-agency framework, data analysis, interviews with stakeholders and THB cases analysis. 2. Conduct desk research and interviews-based analysis of the criminal law and criminal procedural law on the prosecution of human trafficking, using a comparative analysis approach that leads to recommendations on policy, legal and operational frameworks improvements. 3. Analyze methods employed in the evidence collection, including legal and operational opportunities that enable victimless prosecutions, financial and other proactive investigation methods, international cooperation in THB prosecution, a victim-oriented approach and multi-agency approach that enables the prosecution of all forms of human trafficking, including technology-facilitated human trafficking. 4. Based on the agreed methodology, draft a report on the main findings and formulate recommendations on the prosecution of THB offences in Albania, what must be improved, multi-agency cooperation, victim-centered, trauma-informed and gender sensitive approaches to enable the prosecution of all forms of THB, evidential issues in the prosecution of THB offences, organizational and jurisdiction issues and international cooperation. 5. Participate – remotely or in person - in the events envisaged in the project, including one consultation workshop and one final validation workshop and in at least 6 interviews with national institutions and the other experts. All will be facilitated by the Presence.

Deliverables:

D1. Scoping Study Methodology and structure that reflects the objective and tasks’ description. 22 December 2022 D2. Draft Scoping Study report on the prosecution of THB offences including edited inputs from other experts. 25 February 2023 D3. Final Scoping Study report on the prosecution of THB offences that reflects all inputs and consultations. 10 March 2023

Necessary Qualifications:

• Advanced University degree in law. • Proven international experience in conducting research on the prosecution of THB offences; • Work experience as prosecutor of human trafficking crimes is an asset. • Experience working with international organizations and/or high political institutions; • Knowledge of the institutional context Albania would be an added value. • Excellent analytical and writing skills;

Remuneration Package:

Remuneration will be based on the selected consultant's/expert's qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
