Background:

The Independent Media Commission (IMC) is the permanent Kosovo audio-visual media regulator. The IMC superseded the Temporary Media Commissioner (TMC), in 2007. The Law on the IMC was amended and updated in 2012, and the new law is expected to be processed for approval during 2022. The IMC was established in line with the European best practices to be independent from political influence. The IMC is a member of the European Platform of Regulatory Authorities (EPRA) . The IMC is a constitutionally guaranteed independent responsible for managing, regulating and assigning resources of the Broadcast Frequency Spectrum in Kosovo, for issuing broadcast licenses, and for promoting the development of professional media and the freedom of expression in Kosovo. The IMC licenses and regulates over 200 audio-visual media, and plays a crucial role in educating the public about its role and functions regarding regulation of audio-visual media, and in taking actions against violation of applicable legal provisions by audio-visual media. The Press Council of Kosovo (PCK) is the self-regulatory body for print and online media, with over 50 regular members from newspapers, online media and news agencies. The OSCE Mission in Kosovo (OSCE) established the PCK in 2005. The PCK is the only mechanism in Kosovo that deals with the ethics of online media, and regularly reviews and adjudicates complaints from the public and institutions regarding violations of the press code of ethics. The PCK is member of the Alliance of Independent Press Councils of Europe (AIPCE). With views to enhance the effectiveness and efficiency of OSCE’s work in support to key media institutions, the OSCE wants to evaluate its past performance, which will serve to adjust its future programming.

Objective of Assignment:

OSCE Mission in Kosovo is seeking to hire an international consultant to evaluate its work in the field of media regulation and self-regulation in Kosovo over the period 2000-2021. The evaluation should incorporate the OSCE’s work and contribution on media regulation during Temporary Media Commissioner (TMC), contribution to the IMC on implementation of local audio-visual media regulation strategic objectives and on enhancing the communication with audio-visual media from all communities, and evaluate the OSCE’s work and contribution on media self-regulation since the establishment of the Press Council of Kosovo (PCK) in 2005.

The evaluation will focus on the following criteria: Relevance of the OSCE’s activities to address the needs of the IMC and PCK as beneficiaries, in compliance with the OSCE’s mandate and strategic priorities. Effectiveness of the extent the media regulation and self-regulation related interventions were effective in achieving the results, including the efficiency, impact and the sustainability of the OSCE interventions and contribution to the overall media regulation and self-regulation efforts in Kosovo. The evaluation will be spilt in two main phases: first phase will evaluate the period 2000 through 2007, and the second phase will evaluate the period from 2008 through 2021.

The evaluation will be based on a proposed methodology for the evaluation which will include feedback and approval by the OSCE.

Duration of Assignment:

The Consultant will be hired for 20 working days.

Tasks and Responsibilities:

The international consultant will work in co-ordination and under the supervision of the Project Manager. The international consultant will be expected to perform the following duties:

  • Conduct desk research through the review of existing data related to media regulation and self-regulation in Kosovo;
  • Design tools for primary data collection among all relevant stakeholders, beneficiaries and interlocutors, and collect the data;
  • Analyse the collected data and assess the performance of the OSCE’s initiatives on media regulation and self-regulation;
  • In consultation with the Project Manager identify results, progress, strengths and weaknesses of programming on media regulation and self-regulation; and
  • Formulate recommendations for future programming on media regulation and self-regulation, including potential activities and proposals for changes, if any, to be designed/implemented in the near- to mid-term.

Deliverables:

  • Within 5 days from the contract signature, to submit a detailed evaluation methodology with timelines;
  • Within 20 days conduct and finalize desk research and interviews;
  • Within 30 days deliver a first draft of the report. The draft is to be presented to the Project Manager, who will provide comments;
  • Within 45 days from the contract signature to submit the final evaluation report, considering feedback given by the OSCE Mission in Kosovo. The final evaluation report will be written in English and fully in line with OSCE Mission in Kosovo’s writing and reporting standards.

Necessary Qualifications:

  • University degree in media, law, public administration, political science, international relations, social sciences or similar;
  • A minimum of ten (10) years of proven expertise in delivering project/programme evaluation or impact assessments.
  • Proven experience in the field of media development, media regulation and self-regulation;
  • Familiarity with media landscape in Kosovo;
  • Familiarity with the region is an asset;
  • Outstanding writing and reporting skills;
  • Sound knowledge of Albanian and Serbian is an asset;
  • Fluent in written and oral English language.

Remuneration Package:

Remuneration will depend on the qualifications and experience of individual experts as well as the detailed work plan to be agreed upon and will be based on the current OSCE consultancy rates.
