International Consultant (Trafficking in Persons and Migrant Smuggling Technical Expert

Result of Service 1. Follow up on document analysis and drafting final version of assessment. 2. Organize a meeting with relevant partners to discuss findings and integrate feedback to the final assessment and mapping. 3. Finalize the HRDDP risk assessment in light of the findings collected during the meetings with counterparts.

Duties and Responsibilities Under the overall guidance of the Coordinator of the project, GMCP, and direct supervision of the Crime Prevention and Criminal Justice Officer (Team Leader, Technical Cooperation) Human Trafficking and Migrant Smuggling Section (HTMSS), responsible for the implementation of this activity, the Consultant will perform the following specific tasks:

Desk Review: in coordination with GMCP, HTMSS and the Head of the UNODC Programme Office in Libya, the consultant will research and review open source and restricted documentations including but not limited to;

1. Existing legal frameworks and regulations in Libya related to SAR, migrant smuggling, trafficking in persons and detention facilities and assess their compliance with international conventions (UNTOC, TIP and SOM Protocols, CRC, CAT, etc.) 2. Agreements (MoU, Bilateral agreements) between Libya and other countries pertaining to SAR zone and responsible authorities for SAR operations 3. Existing Standard Operating Procedures (SOPs) related to SAR operations, disembarkation, post disembarkation and detention facilities 4. Identify the various referral systems in place for vulnerable migrants, asylum seekers and potential victims of trafficking or other crimes 5. Examine the different UN materials, reports, studies and risk assessments training manuals and technical assistance tools available for authorities related to SAR operations, disembarkation, post disembarkation and detention facilities 6. Review reports from other international or regional organizations, reports from international and local non-governmental organizations, information emanating from governmental security forces or other security sources, media reports).

Develop a detailed methodology and workplan for the mapping and assessment: mentioning clearly the methodology that will be used in the mapping and assessment exercise including targeted stakeholders (governments, UN agencies, CSOs, NGOs, embassies, etc.) and beneficiaries; the tools that will be used to conduct the mapping and assessment (development of questionnaires targeted to the different stakeholders; field visits and focus group discussions);

1. In coordination with GMCP, HTMSS and Programme Office in Libya, draft workplan of the various steps that will be taking place to conduct the mapping and assessment. 2. Develop the questionnaires that will be used to interview key stakeholders identified (between 10 to 20 interviews). 3. Incorporate feedbacks from the various UNDOC colleagues and finalize the workplan of the implementation of the mapping and assessment. 4. Conduct the interview and focus group discussions with key stakeholders identified in coordination with UNODC colleagues. 5. In coordination with UNDOC prepare and organize field visits of the different institutions identified as essential to obtain information for the development of the assessment and mapping exercise.

Draft of the assessment and mapping: in consultation with GMCP, HTMSS, and the Programme Office draft the assessment and mapping incorporating;

1. A detailed overview of the existing legislative frameworks, regulations and mechanisms in place related to the disembarkation and post disembarkation, as well as in detention facilities; 2. A detailed mapping of the various stakeholders notably national authorities (law enforcement agencies, ministries), UN agencies, CSOs and NGOs involved in SAR operations, disembarkation, and post disembarkation to the monitoring and management of detention facilities containing the level of cooperation and coordination intra-services, intra-agencies and international 3. A detailed analysis of the gap and needs in the existing frameworks, in terms of human rights compliance related to disembarkation, post disembarkation and detention facilities 4. Provide conclusions and recommendations on areas in need of improvement to ensure that proposed programme interventions of Libya will be compliant with human rights standards 5. Review and update the mitigation measures recommended in the previous HRDDP risk assessment and update the recommendations contained therein; propose disembarkation and post-disembarkation mitigation measures against human rights violations; include human rights at sea mitigation measures. 6. Develop an outline of a mechanism or entity that could be established to monitor human rights compliance upon disembarkation endowed with disciplinary and investigative powers.

Validation Meeting: after the validation of the assessment and mapping by UNODC HQ, Regional and Programme Office and under UNDOC guidance;

1. Moderate a meeting with relevant Libyan authorities to discuss the findings and recommendations of the assessment and mapping exercise as well as the proposed response 2. Finalize the assessment, mapping and recommendations by incorporating the feedback received by the Libyan authorities. 3. Incorporate the meeting report as an annex of the assessment, mapping and recommendations document.

Qualifications/special skills An advanced university degree (Master’s degree or equivalent) in law, criminology, or related field is required. A first level university degree in similar fields in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree.

1. A minimum of 10 years of relevant professional experience in the fields of international relations, criminal justice, criminal law, maritime law, human rights, and/or rule of law is required. 2. Experience in conducting research and/or conducting assessments and mapping of country situation in relation to human rights and the rule of law or responses to trafficking in persons and smuggling of migrants is required. 3. Experience in delivery of training and capacity building activities in trafficking in persons, migrant smuggling, rule of law and/or human rights is required. 4. Experience in engaging and collaborating with Governmental counterparts in Libya is desirable. 5. Experience within the United Nations system or similar international organizations is desirable.

Languages English and French are the working languages of the Unites Nations Secretariat. For this post, fluency in oral and written English is required. Knowledge of another official UN language is an advantage.
