You have:

  • Advanced University Degree (Master’s level) in Human rights, Constitutional laws, Substantive laws, Procedural laws or related fields.
  • At least 8 years of professional experience in the fields of Law, Human rights, Legal Research and related fields.
  • Working experience as Lawyer, Prosecutor, and Judge at the national and/or international level would be an asset.
  • Demonstrated experience in conducting comprehensive research studies in fields of Law, Human rights, Sustainable Development.
  • Experience with UNDP or within the UN system would be an asset.
  • Experience with the legal systems in Lao PDR or in the ASEAN region would be an asset.
  • English proficiency, Lao would be an asset.

Background

Guided by the global UNDP Strategic Plan (2022 – 2025) and UNDP Country Programme for Lao PDR (2022 – 2026), UNDP in Lao PDR works closely with the line Ministries, mass organizations, civil society, development partners, and the private sector at both national and sub-national levels in pursuit of the national socio-economic development priorities defined in Lao PDR’s five-year National Socio-Economic Development Plan (NSEDP) and Sustainable Development Goals (SDGs). The UNDP’s work is strongly focused on the provision of policy advice and technical support to the Government of Lao PDR in the design and implementation of national legislation and strategies across four broad Priority Pillars – (1) inclusive growth and reduced inequalities, (2) UXO clearance and risk education, (3) natural resources, climate change and disaster risk reduction, as well as (4) effective, responsive, and accountable governance.

UNDP CO, Governance Unit: The UNDP CO’s programming on effective, responsive, and accountable governance, inter alia, focuses on the provision of policy advice and technical support to he Government to (1) enhance the rule of law and access to justice, (2) strengthen the role and capacities of the National Assembly and People’s Provincial Assemblies, (3) streamline the public administration reform and national initiative on decentralization (Sam Sang Directive), as well as to (4) expand public participation in the national policy and decision-making.

UNDP CO, Rule of Law: In the areas of the rule of law, access to justice and human rights, the Governance Unit partners with a number of the line Ministries (Ministry of Justice, Ministry of Foreign Affairs, Ministry of Public Security, Ministry of Planning and Investment, Office of Supreme People’s Prosecutor, People’s Supreme Court, National Assembly, Lao Bar Association, etc.), to expand evidencebased national legislation and policy development, improve access to justice and provide legal empowerment to marginalized and vulnerable populations, domesticate and fulfil Lao PDR’s international human rights obligations, and raise legal and human rights public awareness. In addition, the Governance Unit provides support to Civil Society Organizations (CSOs) in fulfilling their role in monitoring the national development and advocating for social change

The overall objective of the assignment is to draft the Project Document for the UNDP project ‘Strengthening the Role of Lawyers in Advancing Rule of Law and Access to Justice in Lao PDR’.

Duties and Responsibilities

The successful applicant will be expected to be responsible for the following: Under the supervision of the UNDP Team Leader for Governance, the International Consultant will be responsible for the following tasks:

Task 1: Desk Review.

• Conduct a Desk Review of (1) institutional arrangements and approaches toward capacity development of lawyers, (2) terms of reference and SOPs for capacity development of lawyers (3) knowledge products on capacity development for lawyers, (4) analysis and concluding recommendations on advancing rule of law and access to justice from international human rights reporting mechanisms, (5) emerging trends and analysis of good practices on strengthening capacity development of lawyers, particularly in the ASEAN region;

Task 2: Consultation with key partners (government, lawyers, CSOs, academia).

• Verify and complement the Desk Review through a number of key stakeholder interviews, together with UNDP team, with (1) relevant government agencies and institutions within the justice sector, (2) individual legal professionals and representative from the justice sector, (3) international development partners active in rule of law and access to justice, and (4) CSOs active in rule of and access to justice – operating at both national and sub-national levels;

Task 3: First draft the Project Document for review by UNDP using the update template in POPP

• Develop a draft Project Document in English (approximately 30 pages) that follows the UNDP project document template in POPP.

• Exchange with UNDP team on the draft including drafting meetings to incorporate feedback.

Task 4: Finalize the Project Document approved by UNDP

• Finalize the Project Document with approval from UNDP together with summary PPT of Project Document.

Project Document:

- The Project Document to be approved by UNDP must comply with UNDP POPP requirements, including relevant annexes, work plan and budget, results framework, as well as implementation arrangements and capacity requirements, in line with the corporate quality standards.

Required Skills and Experience

• Advanced University Degree (Master’s level) in Human rights, Constitutional laws, Substantive laws, Procedural laws or a related field (e.g, international law, international politics, comparative politics, constitutional law, civil law, criminal law, or related fields).

• At least 8 years of professional experience in the fields of Law, Human rights, Legal Research and related fields; working experience as Lawyer, Prosecutor, and Judge at the national and/or international level would be an asset

• Demonstrated experience in conducting comprehensive research studies in fields of Law, Human rights, Sustainable Development; experience in country-level legal assessments would be an asset

• Experience with UNDP or within the UN system would be an asset

• Experience with the legal systems in Lao PDR or in the ASEAN region would be an asset

LANGUAGE : English proficiency, Lao would be an asset
