Since the beginning of the migrant and refugee influx, UNICEF is responding to the unique needs of children and women who are seeking asylum in Europe, on the move, stranded or pushed back. UNICEF-supported interventions in Italy continue also to focus on strengthening the protection system through capacity development of frontline workers and key stakeholders on GBV, CP and MHPSS standards and core concepts, working closely with ministries, universities, civil society organizations and more.

In this context, the UNICEF response team in Italy is looking for a consultant to contextualize, provide inputs and strengthen the legal contents of the training material of the workshop designed by UNICEF and implemented in 2020/2021 and 2021/2022 for the students at the University of Palermo (UNIPA) enrolled in the “Migrations, Rights and integration” Master (MIDI) under the Faculty of Law. This should include the inclusion of case studies which are informed by the national normative framework and jurisprudence and focused material on the challenges and bottlenecks faced by migrants and refugees to access the legal services. The workshop relayed also on the expertise of the local civil society organization Clinica Legale per i Diritti Umani (CLEDU). Preliminary findings from a participatory evaluation on the impact of the workshop on the competences and knowledge of former participants clearly pointed out to the need of strengthening the case study component of the workshop, stressing more how the principles and theory presented are applied into the national protection system, with a focus on the multisectoral response and legal assistance to Gender Based Violence (GBV) survivors and children in need.

Scope of Work:

The purpose of this consultancy is to contextualize, provide inputs and develop additional legal tailored training contents to the workshop materials on Gender Based Violence, Child Protection and Mental Health and Psycho-Social Support. The development and integration of practical legal studies based on real cases and contextualized to the Italian/Sicilian migration context would enrich the quality and effectiveness of the workshop, reaffirming key learning points and providing the students with the possibility to strengthen their professional legal expertise and knowledge on how to support vulnerable migrant or refugee children or women, as well as to build up their decision-making and interpersonal skills, providing them with a practical experience, which is fundamental in the framework of a Law degree. The task is performed under the supervision of UNICEF relevant experts and through a regular exchange with them. It will be important to ensure that the additional material developed promotes integration across the topics of the workshop. Key responsibilities of the legal expert will be:

  • Contributing to the data collection and analysis of the workshop evaluation in close collaboration with the Faculty of Law of the University of Palermo and the civil society organization Clinica Legale per i Diritti Umani (CLEDU);
  • Revising the workshop material (including facilitator guide, ppts and handouts) and identifying areas of integration and addition, also in view of a possible dissemination/publication where to include inputs and material on the normative legal framework;
  • Developing tailored and contextualised material to be integrated, such as detailed legal case studies (including key facilitation notes), in-depth description of specific legal topics concerning the migrant and refugee population in Italy with a focus on GBV, CP and MHPSS issues in close collaboration with the University of Palermo and the civil society organization Clinica Legale per i Diritti Umani (CLEDU). The cases studies should be informed by the national jurisprudence acquired through the documents and sentences issues by the national Commissioni Territoriali in assessing international protection individual cases;
  • Developing a 30-slides PowerPoint Presentation including facilitation notes on a GBV legal analysis highlighting the national normative framework, challenges in accessing legal and justice services and most common practices to support GBV survivors, with a focus on migrants and refugees, accessing them.

To qualify as an advocate for every child you will have

  • Advanced Degree is required in Law;
  • A minimum of 8 years of relevant experience as Lawyer for refugees and migrants;
  • Proven experience in providing legal assistance to GBV survivors;
  • Proven expertise on CP, GBViE and MHPSS framework;
  • Experience in developing and facilitating workshop on legal related topics with a focus on access to services by migrants and refugees
  • In depth knowledge of the protection system in Italy with a focus on the migration and refugee response in Italy and, specifically, in Sicily;
  • Fluency in Italian and English are required

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures, and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws.

The selected candidate is solely responsible to ensure that the visa (applicable) and health insurance required to perform the duties of the contract are valid for the entire period of the contract. Selected candidates are subject to confirmation of fully-vaccinated status against SARS-CoV-2 (Covid-19) with a World Health Organization (WHO)-endorsed vaccine, which must be met prior to taking up the assignment. It does not apply to consultants who will work remotely and are not expected to work on or visit UNICEF premises, programme delivery locations or directly interact with communities UNICEF works with, nor to travel to perform functions for UNICEF for the duration of their consultancy contracts.
