Organizational Setting
Mozambique’s forest and wildlife resources are threatened by deforestation, forest degradation and forest fires, mainly caused by shifting cultivation, illegal logging, poaching, and uncontrolled firewood and charcoal production. As a means to address such challenges, the Government of Mozambique has expressed a significant level of commitment and ambition to promote sustainable forest management, reduce deforestation and increase forest cover, while contributing to biodiversity conservation. Mozambique’s Forest Investment Plan (MOZFIP) provides a framework for channelling international support to the country’s commitment for forest sector reform and transformational change, through national-level activities to improve the enabling environment towards the aim of reduced deforestation and on-the-ground investments in two targeted landscapes (the Cabo Delgado and Zambézia provinces). FAO is the lead United Nations (UN) agency for agriculture, forestry, natural resources management and rural development. In Mozambique, FAO has a long history of working for the development of the forest sector including assisting with the development of the first national forest inventory in 1980. The Government of Mozambique and the World Bank have acknowledged FAO’s extensive experience in carrying out forestry activities both at the national and international level and confirmed FAO’s support for technical assistance in MOZFIP activities. The project focuses on five (5) components, namely: (i) Forestry sector 20-year vision, formulation of a strategy and action plan in a transparent and participatory manner, developed and underpinned by a revised regulatory, institutional and policy framework; (ii) Transparency, accountability, equity and overall sustainability of forest production is ensured through the revision of the institutional framework for forest concessions; (iii) National forest sector planning and management are enhanced based on relevant and accurate information and data available through a Forest Information System; (iv) National Directorate of Forest (DINAF) staff and other stakeholders are empowered and have the knowledge, skills and capacity to manage the national forest endowment based on best forest management principles; and, (v) Project Monitoring and dissemination of results. The political and legal framework of the forest sector in Mozambique has been marked by social, economic, political and ecological dynamics, both at the national, regional and international levels It is now necessary to revise and adapt the Forest Policy and legal framework in order to respond to the current challenges of environmental sustainability, including climate change, and local and national socio-economic development priorities. Reporting Lines
The consultant will work in close collaboration with other national consultants involved in other components of this project, The consultant, while reporting directly to the National Coordinator of the project, will be under the overall supervision of the National Coordinator (NC) and/or Budget Holder (BH), the technical supervision of the Development Law Branch of FAO (LEGN), and in close collaboration with DINAF under the Ministry of Land and Environment (MTA) and the FAO Forestry Department (FOA).
Technical Focus
Legal and policy review, participatory consultations, formulation and implementation of forest law and regulation.
Tasks and responsibilities
The objective of this work is the technical support in the execution of the additional activity of the Component 1 of the project and compounding the technical team with emphasis to the following contributions: • Provide technical support to implementation of the Mozambique’s National Forest Programme, forest policy and forest law. • Support drafting and validation of forest legal and policy documents, including laws, decrees and applicable Regulations. • Provide technical and advisory support, based on national and international standards, to the governmental and non-governmental experts involved in public consultations and validation of forest legal and policy documents, including laws, decrees and applicable Regulations. • Collect policies, strategies, laws and by-laws directly and indirectly relevant for Forestry law. Monitor the legislation that is (and is not) included in FAOLEX and share the soft copies of the legislation not included in FAOLEX with the Legal Officer.
