Overview

Support the Ministry of Health and UNICEF on legislative drafting related to breastfeeding laws.

You have:

  • Master's degree in social sciences or humanities or equivalent.
  • At least 10 years of experience in health law, nutrition, marketing of food products or early childhood development in Tunisia.
  • At least 10 years of professional experience in analysis, revision, synthesis, and drafting legal texts.
  • Deep knowledge of institutions, legal framework, and governance in the health sector in Tunisia.
  • Proven experience of at least 5 years in facilitating participatory workshops.
  • Fluency in Arabic and French.

La Tunisie, signataire du Code International de Commercialisation des SLM et des résolutions de l'AMS a promulgué un cadre législatif dès 1983, modérément aligné au Code selon l’évaluation de NetCode. Les pratiques contrevenant au Code sont par conséquent nombreuses et fréquentes, ce qui porte atteinte à la santé des enfants avec des effets à long terme. D'où l'urgence de renforcer les initiatives visant çà protéger l’allaitement pour atteindre l’objectif de 50% d'allaitement exclusif à six mois (Cible ODD pour 2025).

En novembre 2022, le Ministère de la Santé a mis en place un comité technique chargé de réviser le texte législatif relatif à l’allaitement maternel. Ce comité a pour mission de réviser les textes juridiques liés à l’allaitement maternel et à l’alimentation de l’enfant, de réglementer des publicités pour les SLM et de mettre en place un plan d’action pour la mise en œuvre du cadre juridique. Lors de sa dernière réunion du 16 mars 2023, le comité a formulé plusieurs recommandations à savoir la collecte de l’ensemble des textes régissant l’application du code, l’analyse du texte juridique en identifiant ses points faibles et forts et la proposition des mesures législatives pour le renforcement de l’application de l’article. Pour réaliser cet objectif, le Ministère de la Santé a inscrit cette activité dans son programme de coopération 2024 – 2025 avec l’UNICEF afin de mobiliser une expertise.

Dans ce cadre, l'UNICEF cherche à recruter un(e) juriste national(e) spécialisé(e) en droit de la santé pour analyser les lois et réglementations existantes, rédiger le nouveau texte législatif, et définir les mécanismes de gouvernance, de mise en œuvre et de suivi pour garantir l'application du Code et des résolutions de l'AMS.

How can you make a difference?

Le(a) consultant(e) national(e) recruté(e) appuiera les efforts du Ministère de la Santé, l’UNICEF et la consultante experte en allaitement maternel pour réviser la loi de 1983 et la rédaction du projet de texte juridique intégrant les résolutions les plus récentes de l’AMS.

Il s’agira pour le consultant de : i. Effectuer une analyse approfondie des lois et réglementations existantes relatives à l’allaitement maternel en capitalisant sur les études existantes ; ii. Réaliser une analyse des parties prenantes pour garantir l’inclusion de tous les acteurs concernés ; iii. Intégrer les recommandations internationales ; iv. Rédiger un projet de texte juridique conformément aux normes légales et constitutionnelles ; v. Développer les mécanismes de mise en œuvre et suivi de l’implémentation du Code.

Afin d’assurer la réussite de la consultation, la méthodologie devra adopter une approche participative des différents acteurs visant à renforcer leurs capacités.

To qualify as an advocate for every child you will have…

  • Un diplôme de niveau master en sciences sociales ou sciences humaines ou équivalent

  1. Technical Evaluation
  • Expérience dans le domaine du droit de la santé, de la nutrition, de la commercialisation des produits alimentaires ou du développement de la petite enfance en Tunisie (15 points) : moins de 5 ans = 5 points, 5 à 10 ans = 10 points, 10 ans et plus = 15 points ;
  • Expérience avérée d’au moins 10 ans dans la rédaction et la révision des textes législatifs (20 points) : moins de 5 ans = 5 points ; 5 à 10 ans= 10 points ; 10 ans et plus= 20 points ;
  • Connaissance profonde des institutions, du cadre juridique et de la gouvernance du secteur de la santé en Tunisie (15 points) ;
  • Expérience avérée d’au moins de 5 ans dans la facilitation d’atelier participatif (15 points) : moins de 5 ans = 5 points, 5 à 10 ans = 10 points, 10 ans et plus = 15 points ;
  • Maitrise de l’arabe et du français (10 points)

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures, and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws.

The selected candidate is solely responsible to ensure that the visa (applicable) and health insurance required to perform the duties of the contract are valid for the entire period of the contract. Selected candidates are subject to confirmation of fully-vaccinated status against SARS-CoV-2 (Covid-19) with a World Health Organization (WHO)-endorsed vaccine, which must be met prior to taking up the assignment. It does not apply to consultants who will work remotely and are not expected to work on or visit UNICEF premises, programme delivery locations or directly interact with communities UNICEF works with, nor to travel to perform functions for UNICEF for the duration of their consultancy contracts.
