Background Information

Expansion of the mediation services remains one of the priority directions for the development of the free legal aid (FLA) system of Ukraine. The process of forming the Register of Mediators, who are engaged by the centers for the provision of free legal aid for the possibility of guaranteeing and providing high-quality mediation services, continues. Within the framework of the project “Enhancing Access to Justice through Free Legal Aid” (Project), the OSCE Support Programme for Ukraine (SPU) is working on equipping the stakeholders of the FLA system with tools to develop its potential for mediation. In particular, the Project plans to develop recommendations and tools for effective implementation of mediation services in the FLA system; develop and implement targeted and interdisciplinary training programmes to improve the professional level of mediators and employees who co-ordinate mediation in the FLA system and conduct the relevant training; facilitate in creation of a network of specialists who provide mediation in the FLA system.

Please note that this is a vacancy notice to enlarge the roster. Successful candidates are expected to work within several short-term consultancy assignments throughout the Project implementation. The detailed information regarding the dates and the duration of the contracts will be provided at the later stage. The consultants will be required to work from home with the ability to travel to perform tasks, if necessary.

Tasks

• Development of recommendations and tools for effective implementation of mediation services in the FLA system, in particular regarding quality standards for the provision of mediation services provided by free secondary legal aid centers; mediation rules; the mechanism for advancing the professional level of mediators; the monitoring mechanism of their provision of services during mediation with the provision of principles of restorative justice; rules for organizing and conducting by the Co-ordination Center for Legal Aid Provision (CCLAP) basic and specialized training for mediators in various categories of conflicts (disputes), keeping the register of graduates by the CCLAP; proposals for improving the quality standards of providing free secondary legal aid.
• Development and implementation of targeted and interdisciplinary training programs (basic and specialized training programs for mediators), measures to advance the professional level of mediators and employees who ensure the conduct of mediation within FLA system.
• Conducting coaching, intervisions/supervisions for mediators and employees of centers providing free legal assistance.
• Development of recommendations for piloting the mechanism of recruitment of coaches (supervisors, intervisors) under the contract for the network of mediators, as well as instructions for their activities.

Job Requirements

• First-level university degree in law, social sciences, or other related field. University degree in law would be an asset.
• Minimum of (3) years of relevant professional experience at the national and/or international levels in the field of mediation and other methods of the ADR (alternative dispute resolution) system, of which at least three (3) years in co-operation with the FLA system.
• Experience in development (participation in development) of recommendations, methodological, informational materials, guides, other policies (legislative acts, organizational and administrative documents), in particular in the field of mediation.
• Experience of participation in building/implementation of pilot mechanisms, innovative/strategic solutions, instructions/"road maps"/algorithms, networking practices in the field of mediation in Ukraine.
• Experience in development of mediation training programs, conducting mediation training interventions, facilitations, supervisions/intervisions in the field of mediation and other methods of the ADR (alternative dispute resolution) system.
• Thorough knowledge and understanding of issues related to the functioning of the FLA system and mediation services based on it.
• Experience of participation in volunteer projects, initiatives in the field of mediation, in particular on public grounds.
• Knowledge of Ukrainian legislation in the field of mediation and issues related to the functioning of the FLA system.
• Experience in organizing the provision of mediation services in Ukraine. Having direct experience in providing mediation services will be an advantage.
• Self-discipline and ability to work against deadlines.
• Professional fluency in Ukrainian with excellent communication (both oral and written) skills. Fluency in English would be an asset.
• Computer literacy with practical experience using Microsoft applications.
• Demonstrated gender awareness, sensitivity, and ability to integrate a gender perspective into tasks and activities.
• Ability and willingness to work as a member of a team, with people of different nationalities, different cultural and religious backgrounds, different gender, and diverse political views, while maintaining impartiality and objectivity.

Remuneration Package

Remuneration will be paid in accordance with the OSCE Support Programme for Ukraine established consultancy rates. Candidates are encouraged to include in their application their financial proposals for the foreseen services.

Розбудова послуг з медіації залишається одним з пріоритетних напрямків розвитку системи безоплатної правничої допомоги (БПД) в Україні. Продовжується процес формування Реєстру медіаторів, які залучаються центрами з надання безоплатної правничої допомоги для можливості гарантування та забезпечення якісних послуг з медіації. У межах проєкту «Підвищення доступу до юстиції через безоплатну правову допомогу» (Проєкт), Програма підтримки ОБСЄ для України (ППУ) працює над оснащенням зацікавлених сторін системи БПД інструментами для розвитку її потенціалу для медіації. Зокрема, Проєктом передбачено забезпечити розробку рекомендацій та інструментів для ефективного впровадження послуг медіації у системі БПД; розробку цільових та міждисциплінарних навчальних програм для підвищення професійного рівня медіаторів та працівників, які координують медіацію в системі БПД та проведення відповідного навчання; сприяння створенню мережі фахівців, що забезпечують проведення медіації у системі надання БПД.

Опис завдання

• Розробка рекомендацій та інструментів для ефективного впровадження послуг медіації у системі надання БПД, зокрема щодо стандартів якості надання послуг з медіації, проведення якої забезпечують центри з надання безоплатної вторинної правничої допомоги; правил проведення медіації; механізму підвищення професійного рівня медіаторів; механізму моніторингу надання ними послуг під час проведення медіації із забезпеченням принципів відновного правосуддя; правил організації та проведення навчання Координаційним центром з надання безоплатної правничої допомоги базової та спеціалізованої підготовки медіаторів у різних категоріях конфліктів (спорів), ведення Координаційним центром реєстру випускників; пропозицій щодо удосконалення стандартів якості надання безоплатної вторинної правничої допомоги.
• Розробка та проведення цільових і міждисциплінарних навчальних програм (базової та спеціалізованої програми підготовки медіаторів), заходів з підвищення професійного рівня медіаторів та працівників, які забезпечують проведення медіації у системі надання БПД.
• Проведення коучингу, інтервізій/супервізій для медіаторів та працівників центрів з надання безоплатної правничої допомоги.
• Розробка рекомендацій щодо апробації механізму набору коучів (супервізорів, інтервізорів) за контрактом для мережі медіаторів, а також інструкцій для їх діяльності.

Вимоги до кандидатів

• Вища освіта на рівні бакалавра у галузі права, соціальних наук чи іншій суміжній галузі. Вища освіта у галузі права буде перевагою.
• Мінімум три (3) роки відповідного професійного досвіду на національному та/або міжнародному рівнях у сфері медіації та інших методах системи ADR (alternative dispute resolution), з яких не менше трьох (3) років у співпраці з системою надання БПД.
• Досвід у сфері розробки (участь у розробці) рекомендацій, методологічних, інформаційних матеріалів, посібників, інших політик (нормативно-правових актів, організаційно-розпорядчих документів), зокрема у сфері медіації.
• Досвід участі у формуванні/впровадженні пілотних механізмів, інноваційних/стратегічних рішень, інструкцій/«дорожніх карт»/алгоритмів, практик мережування у сфері медіації в Україні.
• Досвід у сфері розробки тренінгових програм з медіації, проведення навчань у сфері медіації, фасилітацій, супервізій/ інтервізій у сфері медіації та інших методах системи ADR (alternative dispute resolution).
• Ґрунтовні знання та розуміння питань, пов'язаних з функціонуванням системи надання БПД та послуг медіації на її базі.
• Досвід участі у волонтерських проєктах, ініціативах у сфері медіації, зокрема на громадських засадах.
• Знання українського законодавства у сфері медіації та питань, пов’язаних із функціонуванням системи надання БПД.
• Досвід організації забезпечення надання послуг з медіації в Україні. Наявність безпосереднього досвіду надання послуг з медіації буде перевагою.
• Самодисципліна та вміння працювати у встановлені терміни.
• Професійне володіння українською мовою з відмінними навичками спілкування (як усного, так і письмового). Володіння англійською мовою буде перевагою.
• Комп'ютерна грамотність, включно з практичним досвідом використання програм Microsoft.
• Обізнаність щодо гендерних питань, а також здатність враховувати гендерну проблематику при виконанні завдань та інтегрувати гендерно-орієнтовані підходи у робочий процес.
• Здатність та готовність працювати в якості члена команди з людьми різної національної, культурної та релігійної приналежності, різної статі та різних політичних поглядів, зберігаючи неупередженість та об’єктивність.
