Overview

Background Information

The war against Ukraine brought a new range of challenges for the free legal aid (FLA) system. As a consequence, relevant amendments were made to Ukrainian legislation to meet the increased needs of vulnerable groups in free legal aid. In April 2023, a Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Simplifying Access to Free Legal Aid" was adopted to simplify access to free legal aid for vulnerable groups, including children. A restorative justice program has been approved involving minors who are suspects, accused of committing a criminal offense, and a pilot project is underway to involve psychologists in criminal proceedings involving minors through regional centers for free legal aid provision. Also, since 01 June 2023, a pilot project on the implementation of international standards of child-friendly justice in practical activities has been implemented in Ukraine.

The FLA system implements/is involved in the implementation of the specified pilot projects. However, the FLA system does not possess developed recommendations on quality standards for providing free secondary legal aid to children in legal proceedings based on international standards of child-friendly justice system. There is also lack of detailed algorithm of actions for staff of the FLA provision centers during the provision of free secondary legal aid to children.

The OSCE Support Programme for Ukraine (SPU) “Enhancing Access to Justice through Free Legal Aid” project (Project) aims to increase the capacity of the FLA system to provide quality legal aid to children, in particular those affected by armed conflict. For this purpose, the OSCE SPU is looking to recruit highly qualified consultants on legal issues related to children’s rights protection.

Please note that this is a vacancy notice to enlarge the roster. Successful candidates are expected to work within several short-term consultancy assignments throughout the Project implementation. The detailed information regarding the dates and the duration of the contracts will be provided at the later stage. The consultants will be required to work from home with the ability to travel to perform tasks, if necessary.

Tasks

1. Analysis of the standards of free legal aid for children, which should be applied by lawyers of the FLA system and attorneys who co-operate with it.
2. Facilitation, conducting focus groups with lawyers of the FLA system and attorneys who co-operate with it, on issues of studying the practice of providing free legal aid to children.
3. Development of recommendations regarding quality standards for providing free secondary legal assistance to children in civil and administrative proceedings and representation in criminal proceedings, taking into account international standards of a child-friendly justice system, as well as updated legislation in this area.
4. Development of methodological recommendations for FLA centers’ staff on the organization of free legal aid provision to children who have suffered from or witnessed criminal offenses, children who have committed a criminal offense or a socially dangerous act, including children who have found themselves in difficult life circumstances, have the need for an independent appeal to the court.
5. Development of informational materials for the population and main stakeholders in the field of protection of the rights and interests of children, taking into account the standards of child-friendly justice.
6. Development of training programs with reference to the Guidelines of the Committee of Ministers of the Council of Europe on child-friendly justice and conducting training for lawyers of FLA centers and lawyers who co-operate with the FLA system on representation and protection of children's rights in contact with the law.

Job Requirements

• University degree in the field of law, international relations, social sciences, or other related field.
• A minimum of three years of relevant professional experience at national and/or international level(s) in the legal field with a focus on implementing standards of child-friendly justice and effective protection of children's rights, providing them with legal assistance.
• Experience in the field of development of regulatory and legal acts, methodological materials, training programs as well as experience in conducting trainings.
• Thorough knowledge and understanding of issues related to the functioning of the FLA system, the organization of the provision of legal services both in civil and administrative cases, and in criminal proceedings.
• Mastery of the issue of ensuring the right to protection of children who are involved in the commission of a criminal offense or a socially dangerous act, and whose participation is being investigated.
• Knowledge of Ukrainian and international legislation in the field of human and child rights protection.
• Knowledge of national and international standards of the child-friendly justice system, the Guidelines of the Committee of Ministers of the Council of Europe on child-friendly justice.
• Knowledge of the judicial practice of national courts and the European Court of Human Rights in the context of ensuring the best interests of the child, when considering civil and administrative disputes that directly concern the rights and interests of the child, as well as in the context of ensuring the best interests of the child in contact with the law.
• Professional fluency in Ukrainian with excellent communication (both oral and written) skills.
• Professional fluency in English with excellent communication (both oral and written) skills would be an asset.
• Computer literacy with practical experience using Microsoft applications.
• Self-discipline and ability to work against deadlines.
• Demonstrated gender awareness and sensitivity, and ability to integrate a gender perspective into tasks and activities.
• Ability and willingness to work as a member of a team, with people of different nationalities, different cultural and religious backgrounds, different gender, and diverse political views, while maintaining impartiality and objectivity.

Remuneration Package

Remuneration will be paid in accordance with the OSCE Support Programme for Ukraine established consultancy rates. Candidates are encouraged to include in their applications their financial proposals for the foreseen services.

Стисла інформація про проєкт

Війна проти України поставила перед системою надання безоплатної правничої допомоги (БПД) нові виклики. Як наслідок, були внесені відповідні зміни до українського законодавства для задоволення збільшених потреб уразливих груп у безоплатній правничій допомозі. У квітні 2023 року було прийнято Закон України «Про внесення змін до деяких законодавчих актів України щодо спрощення доступу до безоплатної правничої допомоги», який спрощує доступ до безоплатної правничої допомоги для незахищених верств населення, включно з дітьми. В Україні затверджено програму відновного правосуддя за участю неповнолітніх, які є підозрюваними, обвинуваченими у вчиненні кримінального правопорушення та діє пілотний проєкт щодо залучення психологів до кримінальних проваджень за участю малолітніх, неповнолітніх осіб через регіональні центри з надання безоплатної правничої допомоги. Також, з 01 червня 2023 року в Україні дії пілотний проєкт щодо імплементації міжнародних стандартів правосуддя, дружнього до дитини, у практичну діяльність.

Система надання БПД реалізує/залучена до реалізації вказаних пілотних проєктів. Проте система БПД не має розроблених рекомендацій щодо стандартів якості надання безоплатної вторинної правничої допомоги дітям у судових процесах на основі міжнародних стандартів системи правосуддя, дружнього до дитини. Також відсутній деталізований алгоритм дій працівників центрів з надання БПД під час надання безоплатної вторинної правничої допомоги дітям.

Проєкт «Підвищення доступу до юстиції через безоплатну правову допомогу» (Проєкт), що реалізовується Програмою підтримки ОБСЄ для України (Програма), передбачає підвищення спроможності системи БПД надавати якісну правничу допомогу дітям, зокрема постраждалим від збройного конфлікту. З цією метою Програма має намір найняти висококваліфікованих експертів з правових питань у сфері захисту прав дітей.

Будь ласка, зверніть увагу, що це вакансія для розширення бази експертів. Успішні кандидати будуть працювати над короткостроковими експертними завданнями впродовж реалізації Проєкту. Детальна інформація щодо дат та тривалості контрактів буде надана пізніше. Експерти працюватимуть з дому, з можливістю подорожувати для виконання завдань у разі необхідності.

Опис завдання

1. Аналіз стандартів безоплатної правничої допомоги дітям, які мають застосовуватися юристами системи надання БПД та адвокатами, які з нею співпрацюють.
2. Фасилітація, проведення фокус-груп з юристами системи надання БПД та адвокатами, які з нею співпрацюють, з питань вивчення практики надання безоплатної правничої допомоги дітям.
3. Розробка рекомендацій щодо стандартів якості надання безоплатної вторинної правничої допомоги дітям у цивільних, адміністративних процесах та представництва у кримінальних процесах з урахуванням міжнародних стандартів дружньої до дитини системи правосуддя, а також оновленого законодавства у цій сфері.
4. Розробка методичних рекомендацій для працівників центрів БПД щодо організації надання безоплатної правничої допомоги дітям, які постраждали чи стали свідками кримінальних правопорушень, дітям, які вчинили кримінальне правопорушення чи суспільно небезпечне діяння, а також дітям, які опинилися у складних життєвих обставинах, мають потребу у самостійному зверненні до суду.
5. Розробка інформаційних матеріалів для населення та основних зацікавлених сторін у сфері захисту прав та інтересів дітей, з урахуванням стандартів правосуддя, дружнього до дитини.
6. Розробка тренінгових програм з орієнтацією на Керівні принципи Комітету міністрів Ради Європи року щодо правосуддя, дружнього до дитини та проведення навчання для юристів центрів БПД та адвокатів, які співпрацюють з системою надання БПД щодо представництва та захисту прав дітей у контакті з законом.

Вимоги до кандидатів

• Вища освіта у галузі права, міжнародних відносин, соціальних наук чи іншій суміжній галузі.
• Мінімум три роки відповідного професійного досвіду на національному та/або міжнародному рівнях у юридичній сфері з фокусом на впровадження стандартів правосуддя, дружнього до дитини, та ефективного захисту прав дітей, надання їм правничої допомоги.
• Досвід у сфері розробки нормативно-правових актів, методологічних матеріалів, тренінгових програм, а також досвід проведення тренінгів.
• Ґрунтовні знання та розуміння питань, пов'язаних з функціонуванням системи БПД, організацією надання правових послуг у цивільних та адміністративних справах, кримінальних процесах.
• Володіння проблематикою забезпечення права на захист дітей, які причетні до вчинення кримінального правопорушення або суспільно небезпечного діяння, та за участю яких проводяться слідчі дії.
• Знання українського та міжнародного законодавства у сфері захисту прав людини та дитини.
• Знання національних та міжнародних стандартів дружньої до дитини системи правосуддя, Керівних принципів Комітету міністрів Ради Європи року щодо правосуддя, дружнього до дитини.
• Знання судової практики національних судів та Європейського суду з прав людини в контексті забезпечення найкращих інтересів дитини при розгляді цивільних та адміністративних спорів, які безпосередньо стосуються прав та інтересів дитини, а також в контексті забезпечення найкращих інтересів дитини у контакті з законом.
• Професійне володіння українською мовою з відмінними навичками спілкування (усного та письмового).
• Професійне володіння англійською мовою з відмінними навичками спілкування (усного та письмового) буде перевагою.
• Комп'ютерна грамотність, включно з практичним досвідом використання програм Microsoft.
• Самодисципліна та вміння працювати у встановлені терміни.
• Обізнаність щодо гендерних питань, а також здатність враховувати гендерну проблематику при виконанні завдань та інтегрувати гендерно-орієнтовані підходи у робочий процес.
• Здатність та готовність працювати в якості члена команди з людьми різної національної, культурної та релігійної приналежності, різної статі та різних політичних поглядів, зберігаючи неупередженість та об’єктивність.
