Legal Analysis and Proposal on Climate Change Governance Architecture with Emphasis on the Integration of Climate Change Adaptation Approach in the Ongoing Update or Development Process of the New Climate Change Law and Related Policies, Agreed Upon and Socialized. An executive or complete version in English language format for this product may be requested. Product 2 Report containing an analysis of the legal framework for climate change governance in Honduras. A chapter of the document shall consider existing laws and policies, such as the climate change law, decrees establishing the National Directorate of Climate Change (DNCC), the Interinstitutional Climate Change Committee (CICC), the Interinstitutional Technical Climate Change Committee (CTICC), Nationally Determined Contributions (NDCs), the National Adaptation Plan (NAP), among others; and their relationship with international climate policy instruments (Paris Agreement, United Nations Framework Convention on Climate Change (UNFCCC), among others), identifying gaps, obstacles, linkages, and implications of decrees issued, modified, and/or repealed during the period 2010-2023, directly or indirectly related to the themes of climate change and climate change adaptation.

Report containing an analysis of the institutional and operational compliance framework of climate change governance in Honduras, with a special emphasis on climate change adaptation.

Proposal for an instrument on the architecture and governance (legal, institutional, and operational) of climate change in Honduras. Ministerial Decree (MD) and/or policy in the Council of Ministers (PCM) with an emphasis on climate change adaptation.

Proposal of legal elements to incorporate the climate change adaptation approach. Report to contribute to the process of updating or drafting the new climate change law and/or related binding policies and initiatives.

Proposal of an instrument to institutionalize the National Adaptation Plan (NAP) and Nationally Determined Contributions (NDCs) as strategic planning tools for climate change in Honduras. (Ministerial Decree and/or Council of Ministers Policy).

Output 3

Legal Analysis and Proposal to Incorporate the Climate Change Adaptation Approach in Local Strategic Planning. An executive or complete version in English language format for this deliverable may be requested. Product 3 Report containing an analysis of the legal framework for climate change adaptation planning and territorial planning. A document that considers laws, policies, strategies, and other legally contextual elements to identify and analyze obstacles, gaps, and strengths in territorial planning and climate change adaptation planning with potential linkages (legal, institutional, and operational) to processes such as Nationally Determined Contributions (NDCs), the National Adaptation Plan (NAP), among others.

Proposal of legal elements to incorporate the climate change adaptation planning approach and land use planning. Report with legal elements and a detailed roadmap to institutionalize and integrate the climate change adaptation approach into strategic territorial planning. Potentially, a version in Ministerial Decree (MD) and/or Council of Ministers Policy (PCM) format may be requested for this product. Output 4

Legal Proposal of Institutional Arrangements for Submitting the Adaptation Communication to the UNFCCC. An executive or complete version in English language format for this deliverable may be requested. Product 4 Proposal of institutional arrangements for climate change adaptation communication. A document with legal elements from the national and international framework (especially Article 7, paragraph 10 of the Paris Agreement, while not excluding the incorporation of other relevant elements) necessary to ensure the submission and updating of the adaptation communication to the UNFCCC, with a detailed action plan on the steps to be taken. A Ministerial Decree (DM) and/or Council of Ministers Policy (PCM) may potentially be requested for this product.

Output 5

Supportive Documents for the Process Products and Systematization. Considering that all products should be developed under the approach of "consensus building and socialization with related sectors/actors." Product 5 Mapping and Characterization of Information Sources and Process Stakeholders. Report containing the stakeholders and information sources consulted for the development of each of the defined products, identifying stakeholders for potential success stories.

Process Systematization. Document based on the development of each defined product and the lessons learned from the overall process.

Support and Verification Means. Report providing evidence of the overall process development through the collection of meeting minutes, attendance lists, photographs, videos, and any other elements considered as supporting materials.

Duties and Responsibilities The United Nations Environment Programme is the leading global environmental authority that sets the global environmental agenda, promotes the coherent implementation of the environmental dimension of sustainable development within the United Nations system and serves as an authoritative advocate for the global environment.

The United Nations Environment Latin America and the Caribbean Office (LACO), located in Panama City, Panama, works closely with the 33 countries of the region and its activities are integrated into the Medium-Term Strategy and the Programme of Work approved by the United Nations Environment Assembly (UNEA).

Purpose

1.1 Explain the requirement for a consultant / individual

To implement the Agenda 2030 for Sustainable Development and its Sustainable Development Goals (SDGs), the United Nations Framework Convention on Climate Change (UNFCCC) and the Paris Agreement and the priority actions defined in countries’ Nationally Determined Contributions (NDCs).

In terms of supporting countries in the region to attain the global commitments signed within the framework of the Paris Agreement, UNEP’s Latin America and the Caribbean Sub-programme on Climate Change aims at strengthening the ability of countries to move towards climate-resilient and low emission strategies for sustainable development and human well-being. In this framework, the UNEP Sub-programme on Climate Change, through its Climate Change Unit leads and supports initiatives oriented at designing, promoting, and implementing innovative mitigation and adaptation solutions at the national and subnational levels, and strengthening the transparency framework of the countries.

The expected accomplishment regarding climate change adaptation is that adaptation approaches, including the ecosystem-based approach, are implemented and integrated into key sectoral and national development strategies to reduce vulnerability and strengthen resilience to climate change impacts. Furthermore, UNEP’s Sub-programme on Climate Change is also committed to ensuring that cross-cutting issues such as gender equity and women’s empowerment are effectively integrated into the development of its tasks to guarantee equitable development in line with its adaptation objectives.

The consultant for the analysis of: "Legal Analysis of Climate Change Adaptation in the Water Resources Sector of Honduras" will work from home and will operate under the general supervision of the UNEP Adaptation Program Management Officer in the Latin America and the Caribbean Office and work in close collaboration with the National Project Coordinator in the execution of the project. In addition, he/she will work closely with SERNA's DNCC and other related institutions and sectors.

The Ministry of Natural Resources and Environment (SERNA) of Honduras and UNEP have agreed on the implementation of the project Enabling environments to effectively plan, implement, monitor and report strategic National Adaptation Processes in Honduras, framed within the Readiness program of the Green Climate Fund (GCF), and referred as “Plan A Honduras Project: Strategic Planning of Climate Adaptation”.

The project aims to sustainably build country capacity in identifying, prioritizing, planning and implementing measures that address medium and long-term adaptation needs considering UNFCCC decisions 1/CP.16 and 5/CP.17 and all elements of the UNFCCC Technical Guidelines for National Adaptation Plans (NAPs). The ultimate objective of the project is to reduce the vulnerability of Honduras to the impacts of climate variability and change, by building adaptive capacity and resilience through the integration of climate change adaptation into planning and implementation within all relevant sectors and at different levels, as appropriate, including the different line ministries, local governments, private sector, and civil society organizations.

The project seeks to achieve its components and objective through: 1. Strengthening the institutional and technical capacity of the country and the participation of interested parties. 2. Strengthening strategic planning for national adaptation. 3. Financial flows and investment for adaptation measures under the National Adaptation Plan (NAP) and Nationally Determined Contributions (NDC) fostered. 4. Knowledge management of adaptation to climate change. 5. Strengthening the adaptation transparency framework. To meet the objective of the project, the UNEP Office for Latin America and the Caribbean is recruiting a consultant to prepare an analysis of the : "Legal Framework for Climate Change Adaptation in Honduras" who will be primarily responsible for providing assistance to the Project Management Unit, hereinafter Plan A Honduras Project Team, and coordinating with SERNA's National Directorate of Climate Change (DNCC) in the development of a series of instruments to improve strategic planning and decision-making within the Technical Inter-institutional Climate Change Committee (CTICC).

To achieve the project's objective, UNEP-LACO is hiring a consultant to develop a "Legal Framework for Climate Change Adaptation in Honduras" This consultant will primarily be responsible for providing assistance to the Plan A Honduras Project Team and supporting the National Directorate of Climate Change (DNCC) of SERNA in the development of a legal, institutional, and operational analysis for climate change in Honduras, considering the national and international context, with an emphasis on the climate change adaptation approach.

Specific tasks: The consultant will be responsible for the execution of the following activities:

a. Conduct a mapping of the stakeholders involved in the management of climate change adaptation policies and measures, as well as related institutional arrangements.

b. Collaborate in the process of reviewing the climate change policy framework in Honduras and its alignment with national context and priorities, including international commitments under the United Nations Framework Convention on Climate Change (UNFCCC) and other related instruments.

c. Develop a diagnosis of the systems, measures, and actions undertaken by the stakeholders involved in the management of climate change adaptation policies and measures.

d. Conduct a legal, institutional, and operational analysis of climate change adaptation policies and measures.

e. Develop a participatory process leading to the establishment of institutional arrangements to report on climate change adaptation communications to the United Nations Framework Convention on Climate Change (UNFCCC).

f. Document and systematize the processes and actions that lead to the development of consultancy products.

g. Coordinate actions with other projects and processes related to the products of this consultancy.

h. Maintain a consistent coordination and communication relationship with the Plan A Honduras project team and the National Directorate of Climate Change of SERNA through regular meetings to provide updates on the progress of the products.

i. Include in the development of various products legal elements that enable the government, from its role, to create a conducive environment for all sectors to contribute to climate change adaptation.

j. Include in the development of various products legal elements that represent the vision and approach of other sectors, such as the private sector, academia, local governments, indigenous and Afro-Honduran communities, considering their current and potential roles to promote climate change adaptation actions.

k. Include in the development of various products legal elements related to international cooperation, linked to national priorities and international commitments related to climate change adaptation actions.

l. Include in the development of various products legal elements related to the inclusion of gender perspective in climate change adaptation.

m. Validate the products and deliverables with the instances defined at the beginning of the consultancy.

n. Provide English language versions of the products and/or deliverables defined in both executive and comprehensive formats.

o. Deliver versions of the products in presentation format (power point ), when requested.

Qualifications/special skills ACADEMIC:

- A bachelor’s degree in law, political science or any related field is required. - Master’s degree in political science, law, economics, sustainable development, environment, climate change, or a related area is desirable.

EXPERIENCE: - A minimum of 6 years of experience in the legal area is required. - Experience in the elaboration of legal and/or political analyses in the areas of the environment, natural resources, climate change, sustainable development is desirable. - Experience in participatory processes for the development and application of public policies focused on climate change adaptation is desirable. - Proven experience working with international policy frameworks related to climate change will be valued. - Experience working with stakeholders from the public, private, civil society, academic, indigenous, and Afro-Honduran sectors will be valued. - Experience in gender integration processes will be valued. - Knowledge and understanding of theories, concepts and approaches of international conventions and treaties related to climate change is desirable. - Proven knowledge of environmental and climate change legislation in Honduras will be valued. LANGUAGE: - Fluent in Spanish is required. - Basic in English is required.
