Purpose of project (summary):

UNHCR is responsible to lead and coordinate international efforts to protect forcibly displaced and stateless persons. Central to this mission is assessing how national legal frameworks align with international standards. In support of these efforts, the Rights Mapping and Analysis Platform (RiMAP) provides a methodology to collect and analyze domestic laws and policies, focusing on eleven specific right categories: Asylum, Documentation, Education, Family Life, Freedom of Movement, Health, Housing, Land & Property, Liberty & Security of Person, Nationality & Facilitated Naturalization, Social Protection, and Work & Workplace Rights.

RiMAP is an online platform providing, for each country, information on access to rights and solutions for forcibly displaced and stateless persons, mapping international legal instruments, domestic laws and policies and an analysis of these laws and policies and their implementation. Through its research and country-specific responses, RiMAP aims to shed light on the legal context for refugees, internally displaced persons, and stateless persons, enabling the identification of gaps in law and practice, thereby promoting law and policy reforms to better protect forcibly displaced and stateless persons. It is therefore important to conduct rights mapping and analysis domestic laws and policies in Indonesia focusing on the eleven rights categories mentioned above relevant to protection of forcibly displaced and stateless persons.

The consultant will research various legal databases and other sources to collect relevant legislation, case laws/judicial precedents, policy and administrative directives, map state practices, Indonesia’s international law commitments etc. The consultant will gather and analyze applicable national instruments that affect rights enjoyment of forcibly displaced and stateless persons, and analyze them against international standards.

The role of the Individual Contractor would be to build comprehensive country information on Indonesia’s legal, policy and practice framework impacting access to varied rights for forcibly displaced and stateless persons for UNHCR’s RiMAP platform and Refworld, a global law and policy database operated by UNHCR.

Objectives

Build comprehensive country information on Indonesia’s legal, policy and practice framework impacting access to rights for forcibly displaced and stateless persons for UNHCR’s RiMAP platform and Refworld, a global law and policy database operated by UNHCR. This will be done by collecting relevant documentation and providing a written analysis/summary in response to the Indonesian protection environment and 11 rights categories.

Project duration and timeline

10 November - 15 November: Study and review refworld to understand the platform. Collect relevant national and international legal documents, policies, and case law related to the rights of forcibly displaced and stateless persons in Indonesia. This legal mapping should be as comprehensive as possible and include all the relevant legal legal documents that are relating to all the rights categories and legal context in RiMAP. This research should include documents already uploaded in Refword, as well as all other legal database relevant to the country. Consult with UNHCR focal point and upload relevant contents to refworld but also for a training on how to upload legal references in Refworld.

15 November – 30 November: Study the RiMAP methodology to understand the structured legal analytical framework and all requirements for the analysis. Identify key aspects and provisions that require further examination and clarification. Perform an in-depth analysis of each of the 11 rights categories using the RiMAP structured legal analytical framework. 20 November: Submit draft analysis to UNHCR Indonesia RiMAP focal point for all 11 rights category as well as the legal context.

1 December – 15 December: UNHCR provides feedback on draft analysis and ensure that the section relating to the challenges is dully filled out.

15 - 20 December: Upload approved contents to RiMAP and ensure validation in RiMAP so that the analysis could become viewable to external users upon the external release of RiMAP.

Methodology

Desk review of relevant legislation and consultation with engaged stakeholders to determine and assess access to the 11 rights categories and the Legal context – both under the law and in practice.

Expected deliverables In close coordination with UNHCR Indonesia RiMAP focal point, the consultant will be responsible for the following tasks in relation to the Rights and Mapping Analysis:

Conduct desk review to identify and record existing domestic laws and policies in Indonesia governing protection of forcibly displaced and stateless persons in Indonesia. This includes national legislation, international conventions, and relevant policies. UNHCR has conducted initial desk review as reference.

Review existing domestic legislations in Indonesia currently found in refworld and in other legal libraries, a global law and policy database operated by UNHCR. Upload to refworld, any domestic laws and policies in Indonesia identified during the previous desk review not currently found in refworld. UNHCR will provide guidance on uploading documents to refworld. Refworld is a repository of documents that would be referenced for the work on UNHCR Rights Mapping and Analysis Platform (RiMAP).

Review contents in Rights Mapping and Analysis Platform (RiMAP) relevant to Indonesia and conduct analysis of 11 specific rights categories: Asylum, Documentation, Education, Family Life, Freedom of Movement, Health, Housing, Land & Property, Liberty & Security of Person, Nationality & Facilitated Naturalization, Social Protection, and Work & Workplace Rights and the legal context Provide draft response to questions under each category. Response includes analysis of each question, linking to relevant domestic laws and policies and identify challenges that hinder access to rights. UNHCR will provide a template that could be used to facilitate the analysis. Guidance to help writing content for analysis, using the RiMAP platform and interpretative guidance have been prepared by UNHCR. The draft analysis will be shared with UNHCR for review, feedback and comments.

Following review of draft analysis by UNHCR, upload analysis to RiMAP. UNHCR will provide access to upload the analysis to RiMAP.

Provide regular feedback to the UNHCR Indonesia RIMAP Focal Point in view of improving and updating the development process and working instruction for the RiMAP if necessary.

The Consultant is expected to deliver the Rights Mapping and Analysis for Indonesia with all data entered into the online platform. The operation should ensure that the quality of the information uploaded is verified and completed.

Monitoring and oversight UNHCR will conduct weekly catch-up call (in person or online though MS Teams Call) with the consultant to understand progress of the tasks and address any challenges or potential challenges identified in completing the work.
