Result of Service The incumbent will support the implementation of the UNCTAD Programme for Portuguese-speaking developing countries in the field of Competition law and policy through advice and assistance to the initial law enforcement and advisory function of the Cabo Verde Competition Authority as requested, and therefore, will be drafting the Competition law of Timor Leste in close cooperation with the beneficiary’s authorities (Ministry of Trade), other governmental bodies and relevant stakeholders’ representatives, and within the framework of Timor Leste’ s ongoing formal accession to the World Trade Organization.

In addition, the consultant will deliver draft proposals on the assessment of anticompetitive practices, cooperation agreements, MoUs and a report on key recommendations regarding the launch of the Competition Authority, from a legal and institutional point of view.

Duties and Responsibilities Under the supervision of the Head of CCPB, the consultant will undertake tasks in line with the objective of this consultancy which involves key issues of interest in the field of Competition law and policy for the beneficiaries of the UNCTAD Programme for Portuguese-speaking developing countries and other developing countries.

The objective of this consultancy is twofold within the UNCTAD Programme for Portuguese-speaking developing countries: 1) assisting the initial implementation of the Cabo Verde’s competition law and policy mandate by the recently established Competition Authority as per the formal technical cooperation request sent to UNCTAD; 2) draft the Competition law of Timor Leste as per the formal technical cooperation request sent to UNCTAD.

The consultant will offer guidance on the preliminary analysis of mergers notified to the Authority, including the assistance in the assessment of urgent cases as requested. In addition, the consultant will draft notices to assist the assessment of possible anticompetitive practices identified by the Authority as requested and draft cooperation agreements and MoUs with sectoral regulators. The consultant will also offer assistance to the review of the Authority’s organizational structure and its institutional requirements as requested.

Qualifications/special skills Candidate is required to have an advanced university degree, a Master's in Law or in a related field. A PHD in Law or in a related field would be an advantage. Candidate is required to have at least 5 years of work experience in the field of Competition Law and Policy. Experience with competition agencies, Governments, and European entities with Portuguese speaking countries is required.

Languages Candidate is required to have fluency in both oral and written English and Portuguese.
