Org. Setting and Reporting This position is located in the Competition and Consumer Policies Branch of the Division on International Trade and Commodities of the United Nations Conference on Trade and Development (UNCTAD).

The UNCTAD technical cooperation project on “Delivering block-chain based online dispute resolution for consumers as means to improve international trade and electronic commerce” (BODR), funded by the China Silk Road Group, aims to benefit at least two South-East countries. The project aims to identify best practices and policy options to promote consumer online dispute resolution and to define the legal, technical and infrastructure requirements for the development of online dispute resolution systems, including through the use of block-chain technology.

The incumbent reports to the UNCTAD BODR Project Officer.

Responsibilities In the framework of UNCTAD’s BODR project, within delegated authority and depending on location, the Associate Legal Officer will be responsible for the following duties:

•Conducts legal research on a diverse range of assigned issues in public and private international law and consumer protection and electronic commerce law and block-chain technology using multiple research sources; selects relevant material, analyzes information and presents findings for internal review. •Assists Legal Officers in the review of legal documents, instruments, or other material; identifies important issues, similarities and inconsistencies, etc. •Assists in the preparation of drafts of background papers, studies, reports, relating online dispute resolution for consumers in beneficiary countries and at regional and at global levels. . •Assists in the preparation of agreements and contracts with governments, NGOs and other public and private entities. •Assists in administering the technical assistance BODR project. •Assists in the preparation and delivers capacity building and training activities of the BODR project. •Assists Legal Officers in servicing diplomatic conferences, commissions, committees, task forces and other bodies, including preparation of background materials, summaries of issues and views of delegations, etc., •Performs other duties as assigned

Education An advanced university degree in international law is required. A first level university degree with two additional years of relevant experience may be considered in lieu of the advanced degree.

Work Experience A minimum of two years of progressively responsible experience in law, including legal analysis, research and writing is required. Experience acquired on consumer protection and related dispute resolution is desirable. Experience supporting technical cooperation projects for developing countries is desirable.

Languages Fluency in English (both oral and written) is required; knowledge of French is desirable. Knowledge of another UN official language is an advantage.

Assessment Evaluation of qualified candidates may include an assessment exercise which may be followed by competency-based interview.

Special Notice This is post is initially available for three months with a possibility of an extension. This is a project funded position, therefore, extension of the appointment is subject to the availability of the funds.

If the selected candidate is a staff member from the United Nations Secretariat, the selection will be administered as a temporary assignment. While this temporary assignment may provide the successful applicant with an opportunity to gain new work experience, the selection for this position is for a limited period and has no bearing on the future incumbency of the post. If the selected candidate is an external candidate, subsequent to the initial temporary appointment, new and successive temporary appointments may be granted for service in the same office or in a different office any number of times, for any duration, provided that the length of service does not exceed the period of 364 calendar days. An external candidate selected for this position is bound by the prevailing condition of the staff selection system under ST/AI/2010/3, as amended, and ST/AI/2010/4/Rev.1.

A staff member holding a temporary appointment who is recruited in the Professional and above categories on a temporary appointment, and placed on a position authorized for one year or longer may not apply for or be reappointed to his/her current position within six months of the end of his/her current service. This provision does not apply to staff members holding temporary appointments and placed on positions authorized for one year or more in duty stations authorized for peacekeeping operations or special political missions. The expression "Internal candidates", shall mean staff members who have been recruited after a competitive examination under staff rule 4.16 or after the advice of a central review body under staff rule 4.15. A staff member holding a temporary appointment shall be regarded as an external candidate when applying for other positions, and may apply for other temporary positions at any level, subject to section 5.7 below and staff rule 4.16 (b) (ii). Therefore, a staff member holding a temporary appointment in the General Service or related categories may only apply to positions within those categories. In its resolution 66/234, the General Assembly further "stressed that the Secretary-General should not recur to the practice of temporarily filling posts in the Professional and higher categories with General Service staff members who have not passed the General Service to Professional category examination other than on an exceptional basis, and requests the Secretary-General to ensure that temporary occupation of such posts by the General Service staff shall not exceed a period of one year, effective 1 January 2013…" Consequently, eligible candidates in the General Service or related categories for temporary job openings in the Professional category that have not passed the competitive examination may be selected only on an exceptional basis endorsed by the Office of Human Resources Management where no other suitable candidate could be identified.
