Result of Service

The ultimate result of the assignment will be the identification of gaps and on best approaches to be adopted, including in terms of coordination recommendations on effective approaches in relation to contributing to improving administration of justice. This will be achieved from an understanding of the situation of overcrowding and existing conditions of detention in prisons and the establishment of partnership with key national actors, including MOJ, GDP, MOH and other relevant national stakeholders for cooperation.

Duties and Responsibilities

The International Consultant will be based essentially with OHCHR Country Office in Phnom Penh, and conducting regular visits to GDP and MOJ in Phnom Penh in the context of the Pilot Project. The International Consultant is also required to conduct frequent travels to Correctional Centers (when required). He/she will work under the direct supervision and guidance of the Country Representative and will be responsible for the following duties in support of OHCHR Cambodia Country Office:

a. Prepare and maintain monitoring plans to places of detention, and in this regard, assess existing standards in prison in relation to management and conditions of detention and define priority needs with the objective of improving administration of justice. b. Collect evidence-based information through interviews of inmates and prison personnel on different aspects related to prison management and conditions of detention, while identifying problems and issues to be addressed and proposing corrective actions. c. Participate in national workshops, seminars and training courses for GDP or MOJ personnel and other relevant stakeholders, and provide guidance, as required. d. Establish an effective and transparent partnership with GDP and MOJ as well as other relevant national stakeholders that are engaged in the field of criminal justice and prison administration, while ensuring follow-up actions. e. Liaise with MOH on relevant policies related to conditions related to health in Correctional Centers. f. Review a sample of prisoners’files with a view to advising on criteria and procedure to evaluate inmates who are eligible for parole g. Review the situation of those who have served their full sentences but are still in prison, and make recommendations for their immediate release, as well as how to avoid such situations in the future. h. Participate in the formulation and development of a national project on diversion from prosecution or the use of non-custodial sanctions during the sentencing process of convicted persons with MOJ, including by supporting needs assessment and programming. i. Draft notes on the pilot project activities, outcomes and objectives in line with OHCHR reporting requirements, and prepare other written outputs, such as briefings and presentations. j. Ensure close coordination with other technical assistance providers and the United Nations Country Team in the course of the pilot project implementation and maintain transparent contacts with national stakeholders as required. k. Draft and present a project proposal at the end of the consultancy, including best approaches to assist in reinforcing administration of justice in other prisons and detention centers nationwide. l. Perform other work-related duties as required.

Qualifications/special skills

Advanced university degree (Master of equivalent) in Law, Social Sciences or other related fields; or first degree (Bachelor or equivalent) in Law, Social Sciences or other related fields, with two additional years of relevant professional experience. At least 7 years (with advance degree), or 9 years (with Bachelor degree) of professional experience in law, human rights, social sciences or related field Experience in monitoring human rights violations, particularly conditions of detention Knowledge of international human rights standards, including on conditions of detention, prison management and overall administation of criminal justice. Experience in coordinating and delivering capacity building and technical assistance activities for state officials. Experience in conducting legal analysis in conformity with international human rights standards. Experience in project development, coordination and implementation of relevant to criminal justice policies
