1. Organizational Context

  1. Organizational Setting

The post is located in the Copyright Law Division, within the Copyright and Creative Industries Sector. This Division is responsible for the implementation of WIPO’s strategic goal concerning the balanced evolution of the international normative framework for intellectual property in the area of copyright and related rights, including the adherence to and implementation of the Organization’s copyright and related rights treaties at the national level, and for providing assistance to Member States in drafting and updating their national legislation in the field of copyright and related rights. The Division also functions as the secretariat for the Standing Committee on Copyright and Related Rights (SCCR).

  1. Purpose Statement

The main role of the incumbent is to lead and coordinate the work of the Division in providing authoritative advice and legislative, regulatory and policy assistance to Member States with a focus on areas related to the implementation of the Organization’s copyright and related rights treaties. The incumbent directs, supervises and reviews the work of lawyers who provide legislative, regulatory and policy assistance to Member States in the design and implementation of balanced legislative, regulatory and policy frameworks in the area of copyright and related rights. The incumbent also leads and coordinates the lawyers working with Member States to adhere to and implement WIPO copyright and related rights treaties. The incumbent contributes to the related substantive work of the Secretariat, including providing copyright legal, regulatory and policy advice as part of cross-sectoral teams within the Organization.

The incumbent works under the supervision of the Director of the Copyright Law Division.

  1. Working Relations

The incumbent works closely with other professionals in CCIS, primarily from the Copyright Law Division, as well as the Copyright Management Division and the Copyright Development Division. The incumbent also collaborates frequently with other colleagues who provide legislative, regulatory and policy advice and assistance within the Organization.

2. Duties and Responsibilities

The incumbent will perform the following principal duties:

a. Provide authoritative written and oral advice, upon request, on all aspects of substantive copyright and related rights law and regulation, externally to Member States, and internally to other units within the Organization.

b. Lead and mentor other lawyers in the Division and, where appropriate, external consultants, in the delivery of legislative, regulatory, and policy advice on copyright and related rights to WIPO Member States, including assistance in adhering to and implementing WIPO copyright and related rights treaties.

c. Develop and execute a plan to document and standardize elements of WIPO copyright and related rights advice, and to develop benchmarking tools that can be used in providing such advice. Represent the Division in coordination of similar efforts across the Organization.

d. Design and coordinate projects involving delivery of legislative, regulatory and policy advice on copyright and related rights law and treaties on a regional basis or with groups of Member States that are similarly situated.

e. Undertake and supervise all stages of researching, drafting and revising various types of legal documents, including legislative advice and legal opinions.

f. Explore, initiate, develop and lead studies and strategies in new areas of the law related to copyright and related rights.

g. Plan, organize and lead seminars, workshops, specialized meetings and training courses (including preparation of teaching documents and delivery of lectures) related to adopting and implementing WIPO copyright and related rights treaties, as well as related laws and regulations, at the national level.

h. Design and implement ongoing training curriculum, including at the advanced level, for internal and external WIPO experts involved in advising Member States with respect to copyright and related rights law, regulations, policy, and related WIPO treaties.

i. Represent the Organization in conferences and meetings with other organizations or institutions, as requested.

j. Foster and maintain cordial and cooperative contacts, at different levels, with public and private sector copyright and related rights legal and regulatory stakeholders at the international, regional and local levels.

k. Prepare work plans, reports, and other administrative documents.

l. Perform other related duties, as required.

3. Requirements

Education (Essential)

Advanced university degree in law. A first-level university degree plus two years of relevant experience in addition to the experience requested below may be accepted in lieu of the advanced university degree.

Education (Desirable)

Postgraduate specialization in intellectual property law including copyright and related rights.

Experience (Essential)

At least ten years of relevant professional experience and subject matter expertise in intellectual property, with some experience in the field of copyright and related rights.

Experience in drafting legislative, regulatory and policy advice, ideally in the area of copyright and related rights.

Knowledge of WIPO’s copyright and related rights treaties.

Experience (Desirable)

Experience with the copyright and related rights legal systems in developing countries.

Experience in a multilateral intergovernmental organization providing legislative, regulatory and policy advice related to international normative instruments.

Language (Essential)

Excellent written and spoken knowledge of English and French.

Language (Desirable)

Good knowledge of another official United Nations language.

Annual salary****:

Total annual salary consists of a net annual salary (net of taxes and before medical insurance and pension fund deductions) in US dollars and a post adjustment. Please note that this estimate is for information only. The post adjustment multiplier (cost of living allowance) is variable and subject to change (increase or decrease) without notice. The figures quoted below are based on the October 2022 rate of 71%.
