Background

The aim of the Project is to promote and implement integrated low-carbon urban systems in Ashgabat and Avaza to thereby reduce greenhouse gas emissions and create other environmental, social and economic development benefits.

The development of the use of renewable energy sources is one of the areas ensuring the reduction of greenhouse gas emissions. For a comprehensive and systematic introduction of new technologies based on the use of renewable energy sources (RES) in the national economy, it is necessary to create a legal and regulatory framework. At the end of 2019 and the first half of 2020, within the framework of the UNDP project "Sustainable Cities in Turkmenistan: Integrated Development of Green Cities in Ashgabat and Avaza", the project specialists and international consultant developed a draft of the new Law of Turkmenistan "On Renewable Energy Sources". The draft law was approved by the key ministries of Turkmenistan and, in accordance with the established procedure, was submitted for consideration to the Mejlis (Parliament) of Turkmenistan. Further, a special working group worked in the Mejlis of Turkmenistan to discuss and prepare the adoption of the Law of Turkmenistan "On Renewable Energy Sources", the project specialists actively participated in activities of the working group. On March 13, 2021, the Mejlis of Turkmenistan adopted the new Law of Turkmenistan "On Renewable Energy Sources".

In accordance with the relevant Decree of the President of Turkmenistan dated June 26, 2020, an Interdepartmental Working Group was created to develop a National Strategy for the Development of Renewable Energy. Its 1st meeting was held on July 9, 2020. Representatives of the UNDP project on the development of sustainable cities took active part in the meeting; UNDP proposed a draft structure for the future National Strategy of Turkmenistan. During the meeting, information was presented on the work done by the UNDP project on sustainable cities in the field of renewable energy and energy efficiency. Following the meeting of the working group, gratitude was expressed to UNDP for active cooperation aimed at the development of renewable energy in Turkmenistan and ensuring sustainable development of the electric power industry. Also, the UNDP project on sustainable cities was invited to continue active participation in the development of the draft National Strategy of Turkmenistan for the development of renewable energy.

Further, in 2020, within the framework of the UNDP project, project specialists and international consultant developed a draft "National strategy for the development of renewable energy in Turkmenistan until 2030". This National Strategy was approved by the Decree of the President of Turkmenistan No. 2007 dated 04.12.2020.

After adoption of the new Law of Turkmenistan "On Renewable Energy Sources" and approval of the "National Strategy for the Development of Renewable Energy in Turkmenistan until 2030", in order to achieve their goals and objectives, it was necessary to develop a number of regulatory legal acts in the field of renewable energy sources. In this regard, in 2020-2021, within the framework of the 1st stage, the UNDP project specialists and international consultant developed drafts of new regulatory legal acts (4 pieces) to the Law on RES and the National Strategy for the Development of RES. After approval by the relevant departments, these new regulatory legal acts were enacted by orders of the Ministry of Energy of Turkmenistan.

In connection with the successful implementation of the 1st stage and on the basis of a request from the Ministry of Energy as a National partner, the UNDP project plans to hire an International consultant to develop, within the framework of the 2nd stage of drafts, new normative legal acts (5 pcs.) in the field of renewable energy in accordance with the law requirements, National strategy and taking into account international experience. As a result of the development and adoption of new regulatory legal acts, broad opportunities will be created for the comprehensive development of the use of renewable energy sources in Turkmenistan.

Duties and Responsibilities

The main purpose of this assignment is to develop drafts of new regulatory legal acts (5 pieces) in order to implement the Law of Turkmenistan "On Renewable Energy Sources" and the National Strategy for the Development of Renewable Energy in Turkmenistan until 2030, and in accordance with the requirements of a green economy and taking into account international experience. In this regard, the International Consultant of the UNDP project "Sustainable Cities in Turkmenistan: Integrated Development of Green Cities in Ashgabat and Avaza" under the direct supervision of the project specialist on energy efficiency and coordinated by the project manager will be responsible for the following tasks:

Work as part of a working group, analysis of initial information and development of drafts of new regulatory legal acts (5 pcs.) in the field of renewable energy:

  1. Rules for international cooperation in the field of the use of renewable energy sources;
  2. Development rules, as well as mechanisms for their implementation and supervision of scientific and technical programs in the field of RES development;
  3. Rules for the implementation of achievements in science and technology in the field of development of renewable energy sources;
  4. Rules for the seizure and provision of land plots, as well as the transfer of land to other categories and types for the placement of installations for the use of renewable energy sources;
  5. Rules for accounting of information contained in the state cadaster of renewable energy sources, when developing schemes for the integrated territorial organization of administrative-territorial units, master plans, urban planning projects, special and detailed planning;

Submission of the final progress report.

Expected Outcomes:

Outcome 1:

1-1 Draft rules for international cooperation in the use of renewable energy sources. Number of expert days: 20 days.

1-2 Draft development rules, as well as mechanisms for their implementation and supervision of scientific and technical programs in the field of RES development.

Number of expert days: 25. Work completion time: 4 months from the date of the contract. Payment terms: 35% of the total contract amount.

Outcome 2:

2-1 Draft rules for the implementation of achievements in science and technology in the field of development of renewable energy sources.

Number of expert days: 20 days.

2-2 Draft rules for the seizure and provision of land plots, as well as on the transfer of land to other categories and types for the placement of installations for the use of renewable energy sources. Number of expert days: 20 days.

Work performance term: 6 months from the date of the contract. Payment terms: 30% of the total contract amount.

Outcome 3:

3-1 Draft rules for accounting for information contained in the state cadaster of renewable energy sources in the development of schemes for the integrated territorial organization of administrative-territorial units, master plans, urban planning projects, special and detailed planning. Expert days: 25 days.

3-2 Final progress report. Expert days: 15 days. Work performance term: 8 months from the date of the contract. Payment terms: 35% of the total contract amount.

Payment conditions:

Payment will be made in installments upon completion of the relevant tasks and approval by UNDP.

Competencies

  • The ability to collect, analyze and summarize the received information materials;
  • Good organizational skills, skill and ability to conduct a dialogue with government officials;
  • Ability to be positive about critical comments;
  • Ability to work effectively in a limited time frame;
  • Excellent skills and experience in writing and presenting reports in a professional manner (including graphs, pictures, charts and other graphical tools to improve the quality of the report).

Required Skills and Experience

Education:

  • Higher education in the field of energy, energy efficiency, industry, construction, economics.

Professional experience:

  • At least 15 years of experience in the power industry system and the field of energy saving;
  • Excellent knowledge of modern approaches and international best practices, business practices, policies and regulations in the field of renewable energy;
  • Experience in preparing reports and reviews, developing strategies, regulatory legal acts, standards, regulatory and technical documents in the field of renewable energy, energy and energy efficiency;
  • Minimum 10 years of experience in conducting energy audits of organizations in various sectors of the economy, including international experience, and rationing the costs of fuel and energy resources, the use of renewable energy sources;
  • Experience of policy and regulation acts development in the field of renewable energy, energy saving and energy efficiency in experience in CIS countries and Central Asian region;
  • Professional use of information technologies as tools and resource base; skills in the use of computer technology, including working with Word files, Excel, etc;

Language requirements:

  • Good knowledge of the Russian language;
  • Knowledge of English is preferred.

The interested candidates shall provide the below-listed documents (information) to show their qualification:

  • The applicant’s letter to UNDP confirming interest and readiness of the Individual Consultant for performance of these Terms of Reference representing the financial proposal of the Consultant. The financial proposal shall include payment of consultancy services, administrative expenses (if necessary), transport expenses and/or any other expenses, which candidates consider necessary for performance of these Terms of Reference. The financial proposal shall specify the total amount of an expected fee in a foreign currency (US Dollars) for a total scope of work.   • Resume (Curriculum Vitae) including a respective work experience and a list of developed sub-laws/strategies corresponding to the subject of these Terms of Reference;
  • Methodology/ Work approach specifying phases, tasks, methods, techniques, timetables, resources, accessibility and tools applied for successful performance of these Terms of Reference;

Evaluation of Proposals:

The Consultant selection will be conducted by a method of combined evaluation using the following criteria:

1. Technical part of the proposal - 70%:

  • Education – 20 points;
  • Professional experience in respective field (this will include the practical experience, international experience and developed sub-laws) – 35 points;
  • Language skills – 10 points;
  • List of developed sub-laws/strategies – 20 points
  • Methodology – 15 points;

2. Financial part of the proposal - 30%.

Additional Requirements for the Recommended Candidate:

The recommended contractors at the age of 65 years old and elder and in case if a working trip is required shall undergo a full medical examination including X-ray and obtain the medical authorization from the UN approved doctor prior to accept his assignment. The medical examination shall be approved by the UN doctor and cost covered by the Consultant.
