Based on the Terms of Reference, the consultant will produce the following outputs:

1. Draft and submit outline of the Compendium, methodology and detailed plan for the implementation of this project 2. Conduct a review of existing literature and consultations with relevant stakeholders as relevant, with a focus on the ASEAN Member States 3. Draft the Compendium with consolidated findings and recommendations, including short executive summary, recommendations and annexes, for feedback 4. Finalise the Compendium based on comments received according to the UNODC standards 5. Deliver presentation on the final output at a workshop

Duties and Responsibilities 1. Background of the assignment

Addressing the smuggling of migrants and irregular migration are key priorities for ASEAN Member States. ASEAN Member States are affected as the source, transit and/or destination of people seeking protection or opportunities abroad. Through national legislation and other practical measures, ASEAN Member states have criminalized the smuggling of migrants, worked to prevent irregular migration and protect the rights of smuggled migrants. At the regional level, the commitment to respond to the smuggling of migrants collectively among ASEAN Member States is mainstreamed into the regional frameworks of the ASEAN Ministerial Meeting on Transnational Crime (AMMTC) and the Senior Officials Meeting on Transnational Crime (SOMTC). The Government of Malaysia assumed the role of the Voluntary Lead Shepherd for People Smuggling, under the purview of the AMMTC and SOMTC frameworks. Recently, the SOMTC Work Programme to Combat People Smuggling (2022-2024) was developed and approved in 2022.

The United Nations Office on Drugs and Crime (UNODC) is the guardian of the Protocol against Smuggling of Migrants by Land, Sea and Air (the SOM Protocol), which supplements the United Nations Convention against Transnational Organised Crime. The UNODC Regional Office for Southeast Asia and the Pacific promotes the adherence to these instruments and is actively supporting the governments of Southeast Asia and their efforts to effectively counter the crime of smuggling of migrants.

To capture the measures and efforts undertaken by ASEAN Member States to counter the smuggling of migrants by land, sea and air, UNODC, in partnership with Malaysia’s Council for Anti-Trafficking in Persons and Anti-Smuggling of Migrants (MAPO), is developing an ASEAN Compendium of Good Practices on Countering Smuggling of Migrants by Land, Sea and Air (the Compendium).

The Compendium will examine good practices and lessons learnt from the region’s counter-smuggling experiences. The analysis of good practices and lessons learned provided in the Compendium will identify strengths and gaps in addressing the complexities of migrant smuggling and will contribute towards guiding future actions in preventing and address the smuggling of migrants in the Southeast Asia region. The Compendium will also offer a series of recommendations to governments, law enforcement actors and criminal justice practitioners in ASEAN Member States regarding law, policy and existing practices towards strengthening the region’s response to the smuggling of migrants.

2. Objective of the assignment

The objectives of this assignment are:

  • Identify and analyze good practices and lessons learned in responding to the smuggling of migrants by land, sea and air, with a focus on the ten ASEAN Member States;
  • Identify case studies of effective responses and challenges in countering the smuggling of migrants by land, sea and air, with a focus on the ten ASEAN Member States; and
  • Develop recommendations for responding to identified gaps and challenges in ASEAN Member States’ response to the smuggling of migrants, taking into consideration aspects of gender and human rights. The Compendium will be disseminated to governments and relevant stakeholders in the ASEAN Member States during a regional workshop.

3. Specific tasks to be performed by the Consultant:

Under the direct supervision of the Regional Coordinator for Human Trafficking and Migrant Smuggling (based in Bangkok, Thailand), the consultant will carry out the following tasks:

  • Draft outline of the Compendium, methodology and detailed work plan of the project activities;
  • Conduct literature review related to good practices related to countering migrant smuggling, with a focus on ASEAN Member States;
  • Conduct consultations (in-person or virtual) with relevant stakeholders on countering migrant smuggling as relevant, with a focus on ASEAN Member States;
  • Draft interim Compendium, with recommendations for inputs and comments; and
  • Finalize the Compendium based on the feedback received from the UNODC Regional Office for Southeast Asia and the Pacific.

    Qualifications/special skills An advanced university degree (Master’s degree or equivalent) in law, social sciences, research or other related fields is required. A first level university degree in similar fields in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree. A minimum 5 years of policy and legal research experience, preferably related to migrant smuggling is required. Knowledge and understanding of the current body of research literature on laws and policies related to migrant smuggling in Southeast Asia is required. Knowledge and understanding criminal justice responses to transnational organized crime, including migrant smuggling is required. Experience in conducting and analyzing legislation and policies is required. Experience in handling sensitive data and ethical collection, analysis and presentation of data is desirable. Having a proven record of published relevant research publications is desirable. Experience in using research findings to identify policy recommendations is desirable. Experience in researching migrant smuggling in Malaysia is desirable. Experience working with UNODC is desirable.

    Languages English and French are the working languages of the United Nations Secretariat. For this position, fluency in English, with excellent drafting and communication skills, is required. Knowledge of another United Nations Secretariat language is an advantage.
