TERMS OF REFERENCE

Purpose of Activity/Assignment: The purpose of the assignment is to provide technical assistance to the government of Kenya to operationalize the Monitoring plan/framework of (i) the National Prevention and Response Plan on Violence against Children (NPRP on VAC) 2019-2023 and (ii) the National Plan of Action to address Online Child Sexual Exploitation and Abuse (NPA to address OCSEA) by developing a data consolidation system which includes guides/SOPs and a set of monitoring, data collection and reporting tools, as well as by strengthening capacities of national and county level stakeholders to utilize these tools. In addition, mentorship support to ensure institutionalization of these tools will be provided. Similarly, technical support will be provided for producing annual reports of the implementation of the Plans.

Scope of Work: (see end note below ) Background and Justification In Kenya, the 2019 Violence against Children (VAC) survey was carried out as the 2nd nationally representative survey on violence against children, following the 2010 VAC survey. The 2019 VAC survey, launched in July 2020, revealed a high prevalence of childhood violence, affecting close to half of females (45.9%) and more than half of males (56.1%). The survey found that physical violence has the highest prevalence rate among all forms of violence with parents and caregivers being the most common perpetrators. The prevalence of violent discipline including corporal punishment and psychological aggression against children was also found to be high where almost half of females (48.2%) and males (41.7%) aged 13-17 being affected in the past 12 months. Witnessing physical violence in the home is common with more than half of females (52.0%) and males (51.5%) aged 18-24 observed violence in the home before age 18. Service seeking behavior was however found to be low among survivors and childhood violence negatively affects their mental health status.

The government developed the 5-year National Prevention and Response Plan on Violence against Children 2019 – 2023 (NPRP on VAC), based on these key findings from the 2019 VAC survey as well as globally available evidence-based strategies and prudent programmes in Kenya. The six strategies of the NPRP on VAC are: 1. Laws and Policies to effectively implement them to protect children from violence 2. Family Support and Economic Strengthening to promote positive parenting practices and economic strengthening aimed at reducing violence within the family 3. Education and Life skills to promote and strengthen a safe and enabling school environment and life skills training for children 4. Community Interventions addressing Norms and Value to promote norms and values that support non-violent, positive and gender equitable relationships with and for children 5. Response and Support Services to improve access to quality health services, social welfare services and justice for all children 6. Coordination to improve mechanisms to prevent and respond to violence against children in Kenya

The NPRP on VAC 2019- 2023 has its Theory of Change and Monitoring and Evaluation plan. Section 5 of the NPRP on VAC Monitoring and Evaluation Plan (page 49 – 53) describes core indicators, data collection and use, data quality assurance and coordination along with data collection and reporting structure. One of the emerging concerns related to violence against children is online protection. The risk has exacerbated during the COVID-19 pandemic when children and adolescents spend more time online for both their studies and socialization during the school closure in Kenya. In 2019, the Government of Kenya joined the WeProtect Alliance and carried out an extensive desk review of national, regional and international OCSEA related documents. Through a participatory development process, including interviews and consultations with key stakeholders between October 2019 to December 2020, a report entitled Assessment of the National Response to Child Online Sexual Exploitation in Kenya, using the WeProtect National Model Response Framework, was completed in June 2020. The costed National Plan of Action to address Online Child Sexual Exploitation and Abuse (NPA to address OCSEA) is being finalized. The NPA to address OCSEA will support all key stakeholders to work with and respond to the rapidly changing world of the internet and its impact on children. The Plan supports key strengths and gaps in Kenya’s child protection system in relation to both the prevention and response to OCSEA. It is grounded in the WeProtect National Model Response and has been contextualized to Kenya’s unique situation. The NPA to address OCSEA has its Theory of Change and Monitoring and Evaluation Framework.

What is now required is to develop a data consolidation system for these two National Plans with guides/SOPS and a set of monitoring, data collection, data storage, analysis and reporting tools including (i) indicator reference sheet, (ii) data collection forms, (iii) data reporting forms, (iv) online data base to consolidate all inputs and (v) guides/SOPs on monitoring, data collection, reporting and compilation. This will support stakeholders at National, county and sub-county level to monitor and report progress made against indicators in the Result Matrix of the NPRP on VAC and the Monitoring Framework of the NPA to address OCSEA.

The process should consider the existing policy and guidelines of the Government of Kenya (in particular Monitoring and Evaluation Directorate, State Department for Planning (https://monitoring.planning.go.ke/) including National Monitoring & Evaluation Policy (2012) and Methodological and Operational Guidelines for Implementation of the National Integrated Monitoring and Evaluation Systems (NIMES) (2015).

Upon development of these tools, stakeholders at National and County level (which include key line ministries who have leading and supporting roles for strategic actions in the NPRP on VAC and the NPA to address OCSEA as well as members of Area Advisory Committees at county and sub-county level) need to be trained on the guides/SOPs and a set of monitoring, data collection and reporting tools. Follow up and mentorship support will also be required to ensure the smooth utilization and institutionalization of these tools.

The Department of Children’s Services (DCS) already consolidates child protection related data through Child Protection Information Management Systems (CPIMS). The aforementioned tools to be developed to monitor the NPRP on VAC and the NPA to address OCSEA therefore need to be fully aligned with CPIMS as well as other existing relevant IMS from relevant sectors. In the medium term, it will be important for to integrate the data collection process and system for the NPRP on VAC and the NPA to address OCSEA into the existing monitoring and evaluation frameworks of the MDAs responsible as well as the National Integrated Monitoring and Evaluation System (NIMES) managed by Monitoring and Evaluation Directorate. Therefore, the consultant will be required to make recommendations accordingly.

Given the background, UNICEF is seeking for an individual consultant to support the development of a data consolidation systems with guides/SOPs and tools as well as to build capacities of stakeholders at national and sub-national level to utilize them and mentor its operationalization.

Scope of Work Goal: Under the supervision of UNICEF child protection specialist and the technical guidance of the CEO NCCS, the consultant will support the government, to operationalize the monitoring plan/framework of (i) the NPRP on VAC and (ii) the NPA to address OCSAE by developing a data consolidation systems which include guides/SOPs as well as tools for monitoring, data collection, reporting, analysis and online database for systematic tracking of the progress made to implement the two National Plans to address violence against children. Objective: 1) To review the NPRP on VAC 2019-2023 and the NPA to address OCSEA M&E framework and identify possible linkages with the existing M&E frameworks across all MDAs responsible for delivering the two national action plans. 2) To develop a data consolidation system with (i) guides/SOPs and (ii) tools for monitoring, data collection, reporting, and analysis of the NPRP on VAC and the NAP to address OCSEA (which are in line with CPIMS) and have them validated by relevant MDAs. 2) To train 50 master trainers on newly developed guides/SOPs and monitoring, data collection and reporting tools 3) To facilitate 5 sets of virtual training sessions, reaching to 1,000 stakeholders at National, County and Sub-County level to utilize the newly developed guides/SOPs and tools for monitoring, data collection and reporting. 4) To support production of the first, interim progress report basis (for a fiscal year July 2020-June 2021) for the NPRP on VAC 2019-2023 and production of the first annual reports (for a fiscal year July 2021 – June 2022) for the NPRP on VAC 2019-2023 and the NPA to address OCSEA 2020-2024. 5) To provide mentorship and technical support to help institutionalize monitoring, data collection, data consolidation and reporting process for the NPRP on VAC and the NPA to address OCSEA (in line with CPIMS). 6) To make recommendations on ways to integrate the data consolidation systems for the NPRP on VAC and the NPA to address OCSEA into the existing M&E frameworks across MDAs and the National Integrated Monitoring and Evaluation System (NIMES) managed by Monitoring and Evaluation Directorate. The consultancy contributes to UNDAF Strategic Results Area 2, Outcome 6: By 2022, marginalized and vulnerable people have increased access to and utilize social protection, and services for prevention and response to gender-based violence and violence against children. In the UNICEF Country Program Document, the assignment contributes to: Outcome 3: Children and adolescents are increasingly protected from exposure to HIV and AIDS, violence, abuse, exploitation and harmful cultural practices, and benefit from increased access to prevention, care, treatment, support, justice and other services needed to ensure their physical, mental and social wellbeing, and more specifically Output 3.4: Social welfare, justice systems and schools, at national level and in target counties have improved capacities with skilled workforce and adequate budgets to prevent, detect, refer and care for girls and boys who are victims of violence, abuse and exploitation and including those are living with HIV. Activities and Tasks Under the leadership of National Council for Children’s Services (NCCS) with the support of the Dept of Children’s Services (DCS) in the Ministry of Labour and Social Protection, with supervision of the UNICEF Child Protection Specialist at UNICEF Kenya Country Office (KCO), the consultant will conduct the following activities:

1. To review the NPRP on VAC and NPA to address OCSEA M&E framework and identify possible linkages with the existing M&E frameworks across all MDAs responsible for delivering the two national action plans.

2. Develop a data consolidation system with guides/SOPs and a set of monitoring, data collection, storage, analysis and reporting tools aligned to the NPRP on VAC result matrix and the NAP to address OCSEA monitoring and evaluation framework to facilitate tracking of results on the implementation of the Plans

The process of designing and developing a data consolidation systems with guides/SOPs and a set of monitoring, data collection, storage, analysis and reporting tools for monitoring, data collection and reporting for the NPRP on VAC and the VAC to address OCSEA will be participatory, including close consultation with members of the multi-sectoral technical working groups and the inter-ministering steering committees on VAC to ensure appropriate contextualization of the tools and the sense of ownership by all stakeholders who will use them (both governmental and non-governmental). The leadership will be provided by the NCCS with support of DCS. 3. Training of 50 master trainers on newly developed SoPs/Guides and monitoring, data collection and reporting tools The consultant will train both government and non-governmental stakeholders at National and sub-national levels who will be ‘master trainers’ to further disseminate and train stakeholders at national and sub-national levels on the guides/SOPs and tools developed. 4. Training of at least 1,000 stakeholders at National, County and Sub-County level on the tools and the SOPs The consultant will organize and carry out 5 sets of virtual training sessions reaching to 1,000 stakeholders at National and sub-national levels on the guides/SOPs and tools developed. It is estimated that approximately 3 representatives from close to 290 Sub-Counties will require virtual training to enable utilization of the tools at Sub-County level. The virtual training will be complimentary to the efforts ‘master trainers’ will be making to build capacities of stakeholders in their respective sectors and localities. 5. Support producing an annual report on a pilot basis (for a fiscal year from July 2020-June 2021) for the NPRP on VAC and producing the first annual reports (for a fiscal year from July 2021-June 2022) for the NPRP on VAC and the NPA to address OCSEA. The consultant will also support the production of an annual report for the fiscal year from July 2020 to June 2021 on a pilot basis for the NPRP on VAC. The consultant will thereafter support producing the first annual report of the NPRP on VAC and the NPA to address OCSEA covering the fiscal year from July 2021 to June 2022. The pilot annual report of the NPRP on VAC (for the fiscal year from July 2020 to June 2021) will be produced with the aim of pre-testing the process of producing an annual report and gaining lessons for the actual process of annual reporting a year later. Annual reports of the Plans will be used to demonstrate the progress made to ending violence against children in Kenya as well as to hold all actors involved accountable and to promote necessary resource mobilization. 6. Mentorship support for institutionalizing of the data consolidation system The consultant will provide mentorship support and technical assistance to the NCCS and other key stakeholders. Specifically, mentorship support will be provided to national level stakeholders for data consolidation, storage and translating consolidate data into analysis for an annual reporting process. The consultant will also ensure the utilization of online data base. Virtual mentoring sessions will also be provided for the master trainers to check in the progress being made at County and Sub-County level for monitoring, data collection and reporting as well as for clarifying any questions in institutionalizing these tools. 7. Make recommendations on ways to integrate the data consolidation systems for the NPRP on VAC and the NPA to address OCSEA into the existing M&E frameworks across MDAs and the National Integrated Monitoring and Evaluation System (NIMES) managed by Monitoring and Evaluation Directorate. The consultant will carry out consultation with relevant stakeholders including MDAs responsible for implementing two National Plans and the Monitoring and Evaluation Directorates of the State Department of Planning and make recommendation on ways to integrate the monitoring and data consolidation systems of the NPRP on VAC and the NPA to address OCSEA into the existing M&E frameworks across MDAs and the National Integrated Monitoring and Evaluation System (NIMES) managed by Monitoring and Evaluation Directorate. ***As the process of developing a data consolidation system for the NPRP on VAC and the NPA to address OCSEA is evolving in consultation with the government and non-governmental stakeholders, there might be additional activities/tasks required in the process which will be mutually agreed upon. Work relationships The consultant will undertake the assignment in close collaboration with the NCCCS, the DCS and other relevant line Ministries and organizations which are part of the technical working group on VAC. Under the supervision of the UNICEF Child Protection Specialist, the consultant will be accountable for the production and finalization of the deliverables as outlined in the individual consultancy contract with UNICEF. Outputs/Deliverables The deliverables will hence be: 1. Short Inception Report, outlining the background, methodology, workplan to achieving the objectives of this assignment as well as the results of the review of the monitoring plan/framework of the NPRP on VAC and NPA to address OCSEA which identifies possible linkages with the existing M&E frameworks across all MDAs responsible for delivering the two national action plans. 2. A data consolidation system with a set of monitoring, data collection, reporting tools including (i) indicator reference sheet, (ii) data collection forms (iii) data reporting forms, (iv) online data base to consolidate and store all reporting inputs and (v) Guides/SOPs on monitoring, data collection, reporting, compilation and analysis to support stakeholders at National, county and sub-county level (to monitor and report on indicators in the Result Matrix of the NPRP on VAC and the monitoring framework of the NPA to address OCSEA). It is possible that some additional tools are identified in the course of the work which will be mutually agreed upon. 3. Train 50 master trainers on the use of the Guides/SOPs and the tools 4. Facilitate 3 series of virtual learning sessions for at least 1,000 National, County and Sub-County level stakeholders from 286 Sub-Counties trained on the use of these tools 5. A Pilot Annual Report on implementation of NPRP on VAC for the fiscal year (July 2020-June 2021) 6. The first Annual Report on implementation of NPRP on VAC and the NPA to address OCSEA for the fiscal year (July 2021 – June 2022) 7. Mentoring the use of data collection and reporting tools and collation of data at national level as well as facilitation of virtual mentoring sessions for master trainers 8. One Progress report that highlight the progress and process of developing the data consolidation systems, training stakeholders and mentoring for institutionalization and key challenges and recommended way forward 9. Final report that highlights key recommendations for integrating the data consolidation systems for the NPRP on VAC and the NPA to address OCSEA into the existing M&E frameworks across MDAs and the National Integrated Monitoring and Evaluation System (NIMES) managed by Monitoring and Evaluation Directorate.

Minimum Qualifications required:

Masters degree in Economics, Public Policy, Social Sciences, Political Science, information management or other relevant disciplines.

Knowledge/ Expertise/ Skills Required:

1. Minimum 8 years of relevant experience in Monitoring and Evaluation field 2. Demonstrated experience in developing / managing information/data management systems 3. Prior experience in monitoring child protection related programme is a clear advantage 4. Experience in monitoring of implementation national policies/frameworks and development of necessary tools an advantage 5. Demonstrated experience in providing facilitation, adult learning and capacity development 6. Familiarity in government M&E procedures, existing administrative data collection systems at national and county level Fluency in English is required. Fluency in Kiswahili is a plus
